Cabinet of Ministers Regulations No. 72 in Riga 2008 February 5 (pr. 7. § 29) market-oriented research project funding distribution order Issued in accordance with the law of scientific activity article 36 i. General questions 1. determines the order in which the Ministry of education and Science (hereinafter the Ministry), based on scientific and economic expertise, distribution finance market-oriented research projects (hereinafter the project). 2. Projects applying for and implement scientific institutions (hereinafter referred to as the authority). 3. Support for small and medium sized companies under these rules shall be in accordance with the European Commission of 12 January 2001, Regulation (EC) No 70/2001 on the Treaty establishing the European Community and article 87.88, giving State aid to small and medium-sized enterprises, and the European Commission on 25 February 2004, Regulation (EC) no 364/2004 amending Regulation (EC) No 70/2001 as regards the extension of its scope to include aid for research and development (hereinafter referred to as Commission Regulation No 70/2001). 4. Support scientific institutes and universities for the implementation of the project granted by the European Commission of 15 December 2006, Regulation (EC) No 1998/2006 on 87 and 88 of the Treaty. application of article de minimis aid (hereinafter referred to as Commission Regulation No 1998/2006). 5. For aid applicants who can apply: 5.1. by a decision of the Court of Justice recognized as insolvent, including reorganisation process undertaken it or (according to the business register information) winding-up proceedings, or the economic activity it has ended;
5.2. legal deadlines have not paid full taxes and other State and local Government-required minimum payments. 6. Minimum permissible national financial contribution to the project is late, about 20000 maximum-140000 lats. 7. Financial contribution to the project, which is calculated based on the total eligible costs of the project are: 7.1. public investment: 7.1.1. industrial research project – 60% of the total eligible costs of the project;
7.1.2. precompetitive development project-35% of the total eligible costs of the project;
7.2. the manufacturing sector contribution: 7.2.1. industrial research project-at least 40% of the total eligible costs of the project;
7.2.2. precompetitive development project-at least 65% of the total eligible project costs. 8. The rules set out in section 7 of the amount of the aid may be increased according to the Commission Regulation No 70/2001, article 5 (a) of paragraph 4 shall not exceed the 75% for industrial research and 50% for precompetitive development projects. The manufacturing sector provides the appropriate co-financing for the implementation of the project. 9. The manufacturing sector's financial contribution to the project implementer's account of the periods laid down in the Treaty. 10. the project is financed from the current year for the national budget. 11. Project funding for such a project eligible costs: 11.1. personnel costs (researchers, technicians and other supporting staff to the extent employed on the research project);
11.2. the scientific equipment used in the project and equipment costs. If such instruments and equipment service life exceeds the length of the research project, considered as eligible only the depreciation costs corresponding to the life of the research project, as calculated on the basis of good accounting practice;
11.3. the scientific project of buildings and land use fees. In respect of buildings considered as eligible only the depreciation costs corresponding to the life of the research project, as calculated on the basis of good accounting practice. As regards the land considered as eligible costs of the commercial transfer or actually incurred capital costs;
11.4. the consultant service and similar services, if those services are used only for the research activity (including the research, technical knowledge and patents or licences in the market it costs by purchasing them from other sources, if the transaction has been carried out and there is no element of collusion involved). These costs are considered eligible if they do not exceed 70% of the total cost of the project justifies Thai;
11.5. additional overheads incurred in implementing research projects;
11.6. other operating expenses, including costs of materials, supplies and similar products incurred directly as a result of the research activity. 12. Support for projects granted in accordance with these terms, do not combine with the support of the projects implemented under other aid schemes or individual aid projects. 13. The provisions of paragraph 3 of the said institutions provide support for the implementation of projects in all sectors, pursuant to Commission Regulation No 70/2001, article 1, paragraph 2, and article 6, paragraph 2 limits. 14. The provision in paragraph 4, the said institutions provide support for the implementation of projects in all sectors, pursuant to Commission Regulation No 1998/2006 article 1 point 1 limits. II. Project submissions and their expertise 15. Project submissions (hereinafter application) the Ministry adopted twice a year-in March and the last working day of September. 16. Submission (annex 1) the Ministry shall be submitted in triplicate in paper form and electronically (media). Application shall be published in at least one daily newspaper, which is distributed all over the territory of Latvia, and placed in the Ministry's home page on the internet. The application shall be accompanied by a mutually signed agreement on manufacturing sector partner commitment to invest in the project (annex 2). 17. If the project promoter for the last three years has received from fundamental and applied research or national research programme funds financing a similar topic to research, the application provides a brief summary of the results and justify that sought and received funds will not be used for the financing of the project at the same time. 18. In the month following the submission of the application the Ministry assesses its compliance with the administrative eligibility criteria (annex 3), as well as provides scientific and economic application expertise according to the scientific and economic expertise criteria (4. and annex 5). If objective reasons this time limit cannot be met, the Ministry may be renewed the administrative procedure law. 19. If the application does not meet the criteria for administrative compliance, the Ministry within 10 working days of registration of the application, inform the applicant of the project by sending an appropriate notification of discrepancies identified. 14.6. the project's contribution to sustainable development, environmentally friendly technologies and approaches. 24. If the nature of the project in question does not comply with the Latvian Science Council science topics for the Commission of experts, application for inspection upon economic sectors concerned professionals. 25. Economic inspection by independent industry experts. Economic inspection assessed: 25.1. manufacturing sector partners interest in the use of the project results, including the ability to provide for the investment project;
25.2. the validity of the financial estimates (cost efficiency);

25.4. the possibility of commercial use of the planned project results in the light of market conditions, demand for product (service), its estimated price and profits (if any);

25.5. the importance of the project for Latvia, the European Union and the world (expected eksportspēj a product or service, the opportunity to gain international patent). 26. in pursuing scientific and economic expertise, experts valued the application's compliance with these rules (including this provision in annex 4 and 5) the established criteria for the evaluation of the application. If all the experts average rating is equal to or greater than 37 points in it, but the criterion of "reasonableness of financial projections" of the expert average rating is less than 8 points, but not less than 5 points, funding may be reduced by decision of the Commission, on the basis of the comments and recommendations of the expert assessment. 35. If all the experts average rating is equal to or greater than 33 points but less than 37 points and criteria of "reasonableness of the financial estimates of the average rating of not less than 5 points, funding may be reduced on the basis of the comments and recommendations of the expert assessment, the Commission shall decide on whether additional information or need additional expertise and, on the basis of the information or expertise shall decide on the application, reinstall the approval or rejection. 36. If the national budget for the year in the bottom of the allocated funds are not sufficient to ensure the national co-financing of all submissions that meet these rules 32, 33, 34 and 35, the main funding criteria (in order of priority): 36.1. the largest number of points economic and scientific expertise rating;
36.2. the larger financial contribution of partners (as a percentage of all eligible project costs);

III. obligations and rights of the Commission, its creation and composition, voting and project evaluation procedures 37. it is the responsibility of the Commission to take a decision on the project approval and funding, or the rejection of a project based on project application expertise results (according to this provision, 32, 33, 34, 35 and 36). 38. the Commission establishes a State Secretary at the Ministry. The Commission includes representatives of five ministries (Ministry of personnel), four in Latvia invited Science Council representatives and the Ministry of the economy.
