Cabinet of Ministers Regulations No. 389 Riga, June 2, 2008 (pr. No 36) provisions on the trans-European network projects and their evaluation and submission of amendments, the European Commission Issued in accordance with the trans-European networks project management article 4 of the law on a fifth issue i. General provisions 1 determines: 1.1. Trans-European networks project application (hereinafter referred to as project submissions) evaluation criteria and requirements for applicants;
1.2. the order in which the trans-European network budget managing authority (hereinafter referred to as the managing authority): 1.2.1. European Commission publishes uzsa Kuma;
1.2.2. accept and assess the project submissions, and submit it for approval to the European Commission;
1.2.3. assess the European Commission proposals for the amendment of the decision and shall submit it for approval to the European Commission. II. The European Commission's publication of the paper, 2. the managing authority shall, on the basis of published in the official journal of the European Union, the European Commission's paper, determine the project submission deadline for the submission of the managing body. Deadline is determined no later than two weeks before the European Commission in a specific project for the submission of applications to the European Commission. 3. the managing authority shall be published in the newspaper "Gazette" and a leading authority on the internet home page of the project information on the deadlines for the submission of the application, the paper of the European Commission's conditions as well as with the project application to the submission and evaluation of related information. III. submission of Project acceptance and evaluation 4. project the applicant prepares a project application and appended to these regulations, paragraph 6 the European Commission and the documents mentioned in the paper. 5. the managing authority shall register the project submissions on trans-European networks project application to the registry. 6. the managing authority within five working days after the application for registration of the project: assess project 6.1 the applicant's compliance with the following criteria: 6.1.1. the project the applicant's compliance with the European Commission's paper, the eligibility criteria set out in;
6.1.2. the authority for the implementation of the project has sufficient financial times in the early stage, in order to implement the project, and is added to the supporting documents;
6.1.3. the authority for the implementation of the project has sufficient technical support to implement the project, and is added to the supporting documents;
6.2. assess the adequacy of the project the following criteria: 6.2.1 design meets the industry's development strategy and guidelines;
6.2.2. the project complies with the trans-European network guidelines (European Parliament and Council of 23 July 1996, decision No 1692/96/EC on Community guidelines for the development of the trans-European transport network and the European Parliament and of the Council of 6 September 2006 decision 1364/2006/EC laying down guidelines for trans-European energy networks and repealing Decision 96/391/EC and decision 1229/2003/EC) the objectives set;
6.2.3. the project complies with the trans-European networks in the annual or multi-annual European communications network Pro gramm objectives;
6.2.4. the investment (construction) project by implementing it will be in the trans-European networks;
6.2.5. the project required trans-European networks budget, the percentage of co-financing with the European Council of 20 June 2007 Regulation (EC) No 680/2007, which laid down general rules for the granting of Community financial aid in the field of trans-European networks;
6.2.6. The Cabinet of Ministers has adopted a decision on support for the State budget for co-financing (if the project requires State budget co-financing);
6.2.7. the project (or its part) is not and has not been financed or co-financed from other Union financial sources as well as State and local budget resources;
6.2.8. the implementation of the project will not exceed the European Commission's paper on the deadline (when the European Commission in the Kuma uzsa is specified);
6.3. evaluate project compliance with the application of the following criteria: 6.3.1 has been chosen the correct paper of the European Commission in the project attached to the application form;
6.3.2. the project application is properly and fully completed and is accompanied by all required attachments and documents;
6.3.3. the project application is not arithmetic error in the calculation of the budget for the project;
6.3.4. the project application in the English language;
6.3.5. the project in the project attached to the application form provided for in the application, with the environmental impact linked documents according to the law "on environmental impact assessment". 7. If the applicant does not comply with these rules and the criteria set out in the paper, the managing authority shall take a decision on the rejection of the application for the project. 8. If a project or project is not specified in the application a complete application referred to in paragraph 6, the managing authority shall prepare draft opinions and send them to the applicant, indicating the specified project to the application deadline. 9. the project shall be submitted by the applicant institution the managing project application specified in opinion within the time limit specified. Clarify the application of the project managing authority assesses one workday and shall take a decision on the application of the project approval and submission to the European Commission or the rejection of the application for the project. 10. If the project applicant project application specified is not submitted by the managing authority within the time limit indicated in the opinion, the managing authority shall take a decision on the rejection of the application for the project as an appropriate project application evaluation criteria. 11. If the managing authority shall take a decision on the application of the project in the equestrian, approved by the project applicant project application together with the attachments, the one working day after receipt of the decision of the managing authority shall submit to the managing body: 11.1 in paper form in two copies (original and copy);
11.2. electronic form, if a document is drawn up according to the electro electronic check movement of regulatory documents regulatory requirements;
11.3. in another form, as determined by the paper of the European Commission. 12. the managing authority shall approve the project submissions, together with the original by vadvēstul returned to the applicant of the project sent to the European Commission, but the copy saves the project case (where the application is submitted electronically). 13. the project applicant is responsible for the application of the project European Commission paper of the European Commission for a specified time and place. 14. the managing authority shall send the draft to the European Commission for electro under the electronic check the European Commission's requirements set out in the paper. 15. the managing authority within five working days of receipt of the information from the European Commission shall inform the beneficiary that the project has been approved by the horse or rejection the European Commission co-financing of trans-European networks budget. IV. amendment of the decision of the European Commission proposal evaluation, approval and submission to the European Commission of 16. Beneficiaries or implementing authority may submit a justified decision of the European Commission's proposals for amendment to extend the period of project implementation or amend other provisions of the European Commission decision relating to the project (for example, if you have changed the beneficiary base data (contact information and bank details), the planned changes in the term of implementation of the project, the expected results and auditable in values to change the total amount of eligible costs or the breakdown of the project activities). Decision of the European Commission, the amendments may not change the overall project objectives. 17. the beneficiary or implementation authority in good time, but not later than three months before the decision of the European Commission in the end date of the project shall prepare and submit to the leading body for the assessment of the written decision of the European Commission's proposals for amendments. 18. the managing authority within two weeks of receipt of the decision of the European Commission evaluated the proposals for amendments and, if they are incomplete, request the recipient institution to clarify or implementation of decisions of the European Commission's amended proposal, setting a deadline for the submission of the proposal specified. 19. If the managing authority does not object to the amendment of the decision of the European Commission proposals, the managing authority the request for amendment of the decision of the European Commission not later than one month prior to the decision of the European Commission in the end date of the project shall be forwarded to the European Commission. 20. The managing authority shall have the right to initiate, prepare and submit to the European Commission decision of the European Commission, the amendments before it in written agreement with the beneficiary or implementation authority.
