No 55 50) amendments to the Cabinet of Ministers of 17 April 2007 No. 267 "provisions of the European agricultural guarantee fund, the European agricultural fund for rural development and the European Fisheries Fund Administration order" Issued under the agricultural and rural development Act article 5 eighth draw of the Cabinet of Ministers of 17 April 2007 No. 267 "provisions of the European agricultural guarantee fund, the European agricultural fund for rural development and the European Fisheries Fund Administration order" (Latvian journal in 2007, 69.177. No.) the following amendments: 1. Replace the text of the words: "certifying authority" (the fold) with the words "certification authority" (the fold);
1.2. "audit body" (fold) with the words "audit body" (fold).
2. Supplement with 13.14. subparagraph by the following: "13.14. two representatives of the Ministry of the environment."
3. To supplement the provisions of section 15.14 as follows: "15.14. a representative from the Ministry of environment."
4. Express 18 as follows: "6. If the beneficiary is: 18.1 the budgetary authority, with the exception of the municipalities, the aid shall be granted in the following order: 18.1.1. the budget authority for the implementation of the project required funding plan and payments from the funds provided for in its ministries or other Central Government institutions in the current year's budget, which is subordinated to the beneficiary. The project features intended for the individual financing plan;
18.1.2. the budgetary authority shall draw up the payment request and agreement on financing in the order submitted to the paying authority;
18.1.3. payment authority examine the payment claim and, if it includes expenditure complies with laws and regulations concerning the granting of aid, eligible expenditure approved amount, the payment order shall be prepared for the actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the State budget revenue;
18.1.4. If payment contained in the request does not comply with the laws and regulations on the granting of aid, the payment authority does not match any amount of expenditure does not endorse and shall inform the beneficiary;
18.1.5. If the payment request contained in part with legislation on the granting of aid, the payment authority approved eligible expenditure, prepared payment order for actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the State budget by cat rolling in revenue. With the payment request includes expenditure which does not comply with the laws and regulations on the granting of aid, the payment authority acting in accordance with the provisions of section 18.1.4.;
18.2. the municipality, the aid shall be granted in the following order: 18.2.1. payment authority in the contract on financing within the time limits and in order to transfer an advance to the municipality to the extent specified in the contract but not more than 20% of the total project, the European Union granted funding and the State budget funding. Advances and interim payments, as well as the entire project to cover the necessary resources the municipality opens account in the Treasury;
18.2.2. the municipality, in implementing the project, all payments shall be made only from this provision in the accounts referred to in paragraph 18.2.1. features;
18.2.3. the municipality shall prepare the payment request and agreement on financing in the order submitted to the paying authority;
18.2.4. payment authority, conducting advance and the various intermediate payments to the municipality, the condition that the total may not exceed 90% of the project, the European Union granted funding and the State budget funding. If the beneficiary of the common project the eligible expenditure is less than the projected eligible costs of the project and there was a beneficiary of aid paid in European Union funding and the State budget funding overpayment, the beneficiary of the payment request by the authorities of the specified account shall repay the excess funding of the European Union and the State budget funding;
18.2.5. If the municipality project used a loan from the State budget, payment authority examine the payment request and approve eligible expenditure corresponding to the regulations concerning the granting of aid requirements and prepares a payment order for the financing of the European Union and the State budget funding transfer to the State budget in repaying a loan account, on the basis of the information provided by the municipality on the Finance Ministry's decision to approve the granting of loans to local government. While payment authority prepare for information about local Government repaid the loan in the account, indicating the amount of the funds transferred and date;
18.2.6. payment authority examine the payment claim and, if it includes expenditure complies with laws and regulations concerning the granting of aid, eligible expenditure approved amount, draw up a payment order for the reimbursement of expenses for the beneficiary according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury;
18.2.7. If payment contained in the request does not comply with the laws and regulations on the granting of aid, the payment authority does not match any amount of expenditure does not endorse and shall inform the beneficiary;

18.2.8. If the payment request contained in part with legislation on the granting of aid, the payment authority approved eligible expenditure, prepared payment order for reimbursement of expenditure actually paid out according to the approved project submission, in particular European Union funding and the State budget funding ratio, and submit them to the Treasury to transfer beneficiary. With the payment request includes expenditure which does not comply with the laws and regulations on the granting of aid, the payment authority acting in accordance with the provisions of section 18.2.7.;
18.3. the Corporation in which the shares of the holder is a Ministry or other central public authorities, the aid shall be granted in the following order: 18.3.1. ministries or other central national authority which is the receiving part of the capital, a project for implementation of the State budget funding including the beneficiary in the account at the Treasury. The beneficiary of the payments from that account;
18.3.2. the Corporation shall prepare the payment request and agreement on financing in the order submitted to the paying authority;
18.3.3. payment authority examine the payment claim and, if it includes expenditure complies with laws and regulations concerning the granting of aid, eligible expenditure approved amount, the payment order shall be prepared for the actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the State budget revenue;
18.3.4. If payment contained in the request does not comply with the laws and regulations on the granting of aid, the payment authority does not match any amount of expenditure does not endorse and shall inform the beneficiary;
18.3.5. If the payment request contained in part with legislation on the granting of aid, the payment authority approved eligible expenditure, prepared payment order for actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the State budget revenues. With the payment request includes expenditure which does not comply with the laws and regulations on the granting of aid, the payment authority acting in accordance with the provisions of section 18.3.4.;
18.4. the Association or Foundation, implementing the project of rural development programmes 2007-2013 4. axis ' Leader approach ' or the action programmes under the European Fisheries Fund for the implementation of aid in Latvia 2007-2013 priority axis 4 "sustainable development of fisheries in the region", the aid shall be granted in the following order: 18.4.1. society or foundation of the suppliers of goods, works or bailiff service providers receive bills for actions taken in the implementation of the project or measure;
18.4.2. society or Foundation in the agreement on financing within the time limits and procedures presented 18.4.1 of these rules. documents referred to in the payment institution;
18.4.3. payment authority after this provision 18.4.1. referred to conformity checks shall be carried out to establish or transfer to society, you must open an account to the Treasury under the approved project submission provided for in European Union funding and the State budget funding ratio;
18.4.4. Association or foundation for suppliers of goods, works or services in healthcare providers pay the full amount of the action taken in implementation of the project. Association or Foundation has been authorized to pay from your account before this provision transfers referred to in subparagraph 18.4.3.. For payments made before these rules referred to in paragraph below 18.4.3 the remittance receipt, society or foundation of an open Treasury settlement account restores funds in your account. Such transfer, accompanied by the opinion of the authority for payment transfers out of the society or Foundation account;
18.4.5. Association or Foundation prepares the payment request and agreement on financing in the order submitted to the paying authority;
18.4.6. the paying authority shall consider the request and payment, if it includes expenditure complies with laws and regulations concerning the granting of aid, eligible expenditure approved amount, the payment order shall be prepared for the actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the State budget revenue;
18.4.7. If payment contained in the request does not comply with the laws and regulations on the granting of aid, the payment authority does not match any amount of expenditure does not endorse and shall inform the beneficiary;
18.4.8. If the payment request contained in part with legislation on the granting of aid, the payment authority approved eligible expenditure, prepared payment order for actual eligible expenditure according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the State budget revenues. With the payment request you include expenditure which does not comply with the laws and regulations on the granting of aid, the payment authority acting in accordance with the provisions of subparagraph; 18.4.7.
18.5. the other person, which is not mentioned in this rule 18.1, 18.2, 18.3 and 18.4. bottom point., aid shall be granted in the following order: 18.5.1. the party concerned in implementing the project, payments shall be made from its own resources;
18.5.2. the person concerned shall make the payment request and agreement on financing in the order submitted to the paying authority;

18.5.3. payment authority examine the payment claim and, if it includes expenditure complies with laws and regulations concerning the granting of aid, eligible expenditure approved amount, the payment order shall be prepared for the actual reimbursement of expenses attributable to the beneficiary according to the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury of the transfer to the beneficiary;
18.5.4. If payment contained in the request does not comply with the laws and regulations on the granting of aid, the payment institution shall take appropriate action on legislation that supports the Administration in the order;
18.5.5. If the payment request contained in part with legislation on the granting of aid, the payment authority to apply the appropriate amount of expenditure prepared payment order for actual eligible expenditure corresponding to the beneficiary in the approved project submission provided for in European Union funding and the State budget funding ratio, and submit them to the Treasury to transfer beneficiary. With the payment request includes expenditure which does not comply with the laws and regulations on the granting of aid, the payment institution shall act in accordance with this rule at the bottom point. "18.5.4.
5. Supplement with 18.1 points as follows: "the decision on the suspension of appropriations 18.1, renewal or revocation of this provision the beneficiaries referred to in point 18.1 accounts Treasury adopt Field Services in accordance with the laws and regulations on the allocation of the suspension, restoration or withdrawal in accordance with the procedure laid down."
6. To supplement the provisions of the following paragraph 24: "24. to ensure that the European agricultural fund for rural development, as well as the visibility of the European Fisheries Fund, this Fund Administration the authorities concerned and the beneficiaries, implementation of information and publicity measures, the use of these provisions, in annex to the appropriate fund logo."
7. To supplement the provisions of the annex as follows: "Cabinet of Ministers of 17 April 2007 regulations No 267 European agricultural fund for rural development and the European Fisheries Fund logo 1. European agricultural fund for rural development logo: 2. European Fisheries Fund logo:".
