Cabinet of Ministers Regulations No. 590 in 2015 (13 October. No 54 20) at national and European Union aid modalities for rural development Sub-measure "implementation of actions in accordance with the community-driven local development strategy" Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the European Union support for the project submission open competition in the form of rural development in 2014-2020 under "implementation of actions in accordance with the community-driven local development strategy" (Sub-measure code-19.2) activities for strengthening the local economy "initiative" and "potential development initiative "(sub). 2. Sub goals are: 2.1. promote public engagement initiatives strengthening local economies, so creating new values in the local area, more productive using local resources, promoting cooperation, and domestic consumption, as well as the development of new business models that improve rural quality of life and promote competitiveness and local socio-economic development of the territory; 2.2. promoting public engagement in local natural, physical, social and human capital building and cultural capital, strategic and sustainable use and development of the initiative, thereby increasing rural population, as well as the location of the drošumspēj potential and attractiveness that can become a pre-requisite for the new integrated tourism, culture, health and other related services and products. 3. the Action shall be implemented in accordance with the laws of the State of the Union aid society-driven local development strategy preparation and implementation: measures 3.1 "support LEADER local development (community-driven local development)" community driven local development strategy (hereinafter referred to as the local development strategies) for implementing a specific area; 3.2. valuation of the local action groups and society-driven local development strategy approved by the selection Committee of the local development strategies. 4. supports the applicant's application and the conditions for receiving the aid, project submission, evaluation and selection procedures, the adoption of the decision, the conditions of project implementation review evaluation and decision-making procedures for requesting public financing and payment arrangements, project monitoring and sanctions shall also determine the laws on the national and European Union aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period insofar as they do not conflict with these rules. II. conditions for receiving aid under the Sub-measure 5 local development strategy provides support for the following activities (may include projects and implement several activities): 5.1. activity "strengthening the local economic initiatives": 5.1.1 new product and service creation, existing product and service development, the quality of the market and the implementation of the working conditions; 5.1.2. processing of agricultural products, the market and the quality of the implementation of the working conditions; 5.1.3. the creation or improvement of the environment, which is realized in local production, and the introduction of new forms of marketing; 5.1.4. worker productivity exponentiation; 5.2. activity "potential development initiatives": 5.2.1 local territories, including natural and cultural objects, to organize, to improve the availability, quality and affordability; 5.2.2. public activities (including training and interest clubs, social care, culture, environmental protection, sports and other leisure activities) to diversify. 6. the meaning of these provisions: 6.1. processing of agricultural products in line with the Commission's June 17, 2014 Regulation (EU) No 651/2014, by which certain categories of aid compatible with the internal market, the application of the Treaty and article 107.108, paragraph 10 of article 2 definition. For the processing of agricultural products is regarded as a transaction with any agricultural product, including heating, smoking, curing, maturing, drying, marinating, extraction, extrusion, mincing, freezing or several at the same time these processes that change the original product, except for the activities necessary to prepare the first sale of the products; 6.2. creating jobs is a contract of employment for at least a year with the employee to determine the normal working time or self-employed economic activities, or more jobs, seasonal work, in which the total number of hours worked during a calendar year corresponds to normal working time, and are made to the State social security payments; 6.3. the public good project is a project that implements the activity "potential development initiatives", in which the purpose is not commercial in nature and which do not qualify as State aid. On public good of project results is not charged; 6.4. joint project is a project that implements the activity "strengthening the local economic initiatives", except for those provisions referred to in paragraph 5.1.4., and in which investment is used in common, if submitted: 6.4.1. Association or foundation which is running at least three years before the submission of the project, and at least three members (if the project is submitted by society) or founder (if the project submitted to the Foundation) is a trader or farm; 6.4.2. the agricultural service cooperative society, or appropriate forestry services cooperative society; 6.4.3. this rule 8.1.1., 8.2.1., 8.3. the tenderer referred to in point (other than the society or Foundation) for the implementation of joint activities between the members of the joint venture contract has been concluded. The joint venture has no more than three members; 6.4.4. the local authority owned or owned a business infrastructure for legal persons (including Association, Foundation, cooperative agricultural services company or relevant forestry services cooperative society), carrying out economic activities between the members of the joint venture contract has been concluded; 6.5. the related persons shall comply with the Commission's March 2014 25 June of the Regulation (EU) No 702/2014, by which certain categories of aid in the agricultural and forestry sectors and rural areas recognised as compatible with the internal market, the application of the Treaty on the functioning of the European Union and article 107.108, annex 1. paragraph 3 of article 3; 6.6. one single organization meets the Commission's 13 December 18, Regulation No 1407/2013 for the Treaty on the functioning of the European Union and article 107.108. application of the de minimis aid (hereinafter Regulation No 1407/2013). 7. in paragraph 5 of these rules the steps local authorities can not be implemented in the city, which is the interest of the Republic city or regional centre for the development of meaning. 8. supports the applicant is: 8.1. This provision, 5.1.1. transaction referred to: 8.1.1. legal person (including the society and Foundation), or a natural person who carries out an economic activity and that turnover is not more than 70 000 euro a year ago concluded the project submission; 8.1.2. the legal person (including the society and Foundation) or the natural person who intends to carry out an economic activity; 8.1.3. adequate agricultural service cooperative society, or appropriate forestry services cooperative society; 8.1.4.6.4.4. these provisions in the case referred to in local government; 8.2. the provisions referred to in subparagraph 5.1.2 action: 8.2.1. legal or natural person who is a food and veterinary service of the registered or recognized in the food chain company which deals with agricultural products (except fishery products) and whose turnover is not more than 70 000 euro a year ago concluded the project submission; 8.2.2. a legal or natural person who intends to engage in the processing of agricultural products, excluding fishery products processing; 8.2.3. the Association or foundation if its turnover is not more than 70 000 euro a year ago concluded the project submission; 8.2.4. the agricultural service cooperative society. If the appropriate agricultural service cooperative society engaged in agricultural products (except fishery products), it is a food and veterinary service of the registered or recognized in the food business; 8.2.5.6.4.4. these provisions in the case referred to in local government; 8.3. the provisions referred to in paragraph 5.1.3. transaction – legal person (including the society and Foundation) or the natural person conducting economic activity and that turnover is not more than 70 000 euro a year ago concluded the project submission, and appropriate agricultural service cooperative society. If the project is implemented in the city, which has more than 15 000 inhabitants, the applicant is a producer of agricultural products, processor of agricultural products or agricultural service cooperative society, and this person is registered in the local action groups in the territory; 8.4. the provisions referred to in paragraph 5.1.4. transaction – legal person conducting activities of a commercial nature and that turnover is not more than 70 000 euro a year ago concluded the project submission; 8.5. This provision 5.2.1 and 5.2.2. activities referred to in point-legal person (including local authority, Association and Foundation) or the natural person who will implement these rules referred to in point 6.3 public good project. 9. If the activity "strengthening the local economic initiatives" to support the applicant is a natural person, and before the commencement of the project acquires merchants, farmers or self-employed status. 10. This provision of the aid referred to in paragraph 8.2.2. the applicant to submit a request for payment to the rural support service in the register or be accepted by the food and veterinary service. 11. in determining the amount of the applicant's turnover of aid, this aid should also take account of the applicant's related companies, including one single company. 12. The essential, in implementation of the project, use this rule 8.2. the aid referred to by the applicant, are agricultural products, referred to in the Treaty on the functioning of the European Union annex I, but excluding fishery products. 13. Public funding of this provision in paragraph 5 the following can be obtained if: 13.1. project complies with the local development strategy; 13.2. project implementing the local development strategy, except on the territory of public relations activities. If the project is for the participation of employees in training for use as performance enhancers in also participate outside of the local development strategy. If the project is intended to buy this provision referred to 37.11. mobile equipment, the applicant is registered or declared residence (a natural person who performs or intends to start economic activities as a self-employed person) are the local action groups in the territory. If the tenderer receives support activity "strengthening the local economic initiatives", that in addition to the provisions of paragraph 13 of the said conditions, the following requirements shall be met: 14.1 does not replace your assets; 14.2. in the application of the project supports the applicant (except for local governments) its economic viability. Economic viability is positive cash flow of the project in the year of application, all project implementation years and years after the implementation of the project. Cash flow statement cash balance at the end of each year is positive. The project attached to the application of the cash flow statement, the production volume and cost of the project in the year of application, in all the years of implementation and a year after the implementation of the project acknowledge the possibility to implement the project and achieving project goals. 8.1.2. If the applicant is Association or Foundation – compared to the first year after the conclusion of the project increases the volume of the services; 14.4. at the project implementation the provisions of 8.1.2. and 8.2.2. the tenderer referred to in point (except for agricultural service cooperatives, cooperatives of forestry service and local) amounted to at least one of the following indicators of economic activity and ensure its implementation throughout the project monitoring: 14.4.1. creating new jobs; 14.4.2. compared to the first year after the conclusion of the project increases the net turnover for the third year by at least 30 percent of the project investment and do not reduce the whole project monitoring; 14.4.3. If the applicant is Association or Foundation – compared to the first year after the conclusion of the project increases the volume of the services; 14.5. the project for the agricultural service cooperative society and forestry services cooperative society supports at least one of the following operating parameters: 14.5.1.10 percent increase in the number of members; 14.5.2. in comparison with the last year concluded before the submission of the project by 10 percent increase net annual turnover with the cooperative society members or about 30 percent of annual net sales increase with the cooperative society members; 14.5.3. in comparison with the last year concluded before the submission of the project by 10 percent increase net annual turnover from products processing or a 30 percent increase in the annual net turnover of invested amount investment, or increase the physical volume of production; 14.6. this rule 8.4. the tenderer referred to in the agreed with the workers employed by the project to continue for at least 18 months (for staff are made to the State social security payments). 15. If a natural person, which launched business operations, acquire self-employed status, it achieves both these provisions and 14.4.2 14.4.1. referred to economic indicators. 16. For the replacement of fixed assets not considered: 20.1. additional investments in existing fixed assets of more than 10 years. Adding to existing fixed assets of less than 10 years, they must be retained for at least five years from the submission of the project or up to 10 years for depreciation of the fixed asset; 20.2. the acquisition of fixed assets, power, productivity, capacity is at least 25 percent greater than the aid applicants to the existing production capacity of fixed assets; 20.3. the fixed asset acquisition project that significantly changes the nature of the production or technology; 20.4. new construction, conversion, construction installation, housing placement and housing renewal. III. Public funding, and about 21. Aid intensity of the project's total eligible cost amounts are up to 70 percent, but: 21.1. public goods project – up to 90 percent; 21.2. the ventures – up to 80 percent. 22. in paragraph 5 of these rules the following, one aided project (including joint ventures), the maximum eligible cost amount: 22.1. activity "strengthening the local economic initiatives" business infrastructure projects if the investment in the construction of the business infrastructure is at least 70 percent of the eligible cost of the project amounts to 100 000 euro is; 22.2. other projects not exceeding 50 000 euros. 23. the local action group of local development strategies can reduce both the amount of the aid for that activity, "strengthening the local economic initiatives" is not less than 20 000 euros and the aid intensity. 24. the support activity "strengthening the local economic initiatives" under Regulation No 1407/2013.25. If support is provided in accordance with the provisions of paragraph 24:25.1. aid granted during the last three fiscal years does not exceed the Regulation No 1407/2013 article 3 (2) the maximum size of one single company level of Regulation No. 1407/2013 article 2 referred to in paragraph 2 of one single definition for a company; 25.2. the aid shall be granted to the economic sectors and activities referred to in Regulation No 1407/2013 article 1 paragraph 1; 25.3. subject to the provisions of Regulation No 1407/2013 article 5 (1) and (2), de minimis aid may not be cumulated with other de minimis aid until Regulation No 1407/2013 article 3 paragraph 2 or other de minimis regulation laid down in the relevant limit values and may be cumulated with other State aid in respect of the same eligible costs or other public aid for the same venture funding measure If is not exceeded the maximum aid intensity or aid amount laid down in another State aid programme or the European Commission decision; 25.4. If the applicant is also the sectors referred to in Regulation (EC) No 1407/2013 article 1, paragraph 1, "a", "b" or "c", this ensures that industry or the cost of separation in accordance with Regulation No 1407/2013 article 1, paragraph 2; 25.5. the applicant and the field support service information on de minimis aid provided is maintained for 10 fiscal years from the date on which, under this Sub-measure last granted aid; 15.9. the support shall be granted up to 2021 30 June, in accordance with Regulation No 1407/2013.26. Aid shall not be granted if the applicant has been declared by a Court of insolvency proceedings or the judgment of the Court is the legal protection process, or by a decision of the Court of Justice is an out-of-court redress process, the previous bankruptcy, reorganisation or appropriate composition, or the economic activity it has ended that it complies with national legislation certain criteria to request the appropriate creditors in insolvency proceedings. 27.6.4.3. Eligible and ineligible costs 28. This provision, 5.1.1, 5.1.2 and 5.1.3. the activities referred to in subparagraph apply are the following: 28.1. new fixed asset and software acquisition and installation costs; 28.2. the construction of a new building, rebuilding, installation of construction (construction engineering structures Assembly, or to hold the base-or design), parking structures (construction of prefabricated constructions Assembly of ready elements intended to shed, not constructing foundations or foundations deeper than 30 centimeters) and building restoration costs, if the building is technically or functionally enhanced (for example, if your production needs required to improve the energy efficiency of buildings, modify or adapt the space without changing the size of the construction or bearing part bearing capacity) on the basis of contracts with third parties who are responsible for carrying out the works; 28.3. the new acquisition cost of building materials, construction building permits on the basis of the mark on the design conditions drawn up by the applicant, if the applicant būvvald issued the memorandum (a receipt card); 28.4. the public relations costs necessary for the product or service identity image building; 28.5., license, patent, copyright and trademark use or costs that are directly associated with the project preparation or implementation and does not exceed 10 percent of the total eligible cost of the project; 28.6. General costs, including architects, engineers and consultation fees, inspection, building and autoruzraudzīb services, legal services, feasibility study, preparation of the energy efficiency audit costs, as well as the costs for the registration of land lease contracts, which are directly linked to the preparation or implementation of a project and not more than seven percent of the rest of the rules referred to in paragraph 28 of the total eligible costs, including: two percent of 28.6.1. this rule 28.1. , 28.4 and 28.5.. costs mentioned in points; 28.6.2. seven percent from 28.2. these provisions and 28.3. costs mentioned in points. 29. This rule 5.1.3 transaction referred to in subparagraph internetveikal is also applicable. 30. General costs, including architects, engineers and consultation fees, inspection, building and autoruzraudzīb services, legal services, feasibility study, preparation of the energy efficiency audit costs, as well as the costs for the registration of land lease contracts, if they are directly linked to the preparation or implementation of a project and not more than seven percent of the rest of the rules referred to in paragraph 31 of the total eligible costs, including: two percent of 31.7.1. this rule 19.3. 31.5., and 19.6. costs mentioned in points; 31.7.2. seven percent of this provision, and 19.5 19.4 19.4.. the costs referred to in point. 32. This rule 31.5. the costs referred to in subparagraph does not apply to the acquisition of fixed assets. 33. This provision 5.2.2. activities referred to in point (except if the project contains only this rule 31.5. the costs referred to in (a)) years after completion of the project is also subject to a project related staff remuneration costs (including related taxes and fees) and operating costs if they do not exceed 15 percent of the total eligible costs of the project amount. If the applicant does not provide public funding for installation, public funding of these facilities only receive after their commissioning and supporting documents of the Field support service. 37. in paragraph 5 of these rules the following does not apply are the following: 37.1. interest payments, money transfers, Currency Exchange Commission payments and exchange rate fluctuations suffered damage; 37.2. fines, penalties and costs of legal proceedings; 37.3. the subcontracting, which artificially and unduly increase the cost of the project and the fee is fixed as a percentage of the total cost of the project; 37.4. costs associated with the supply of any services or work for which there is no appropriate procurement procedures carried out in accordance with the laws and regulations on the application of the procurement procedure; 37.5. the existing structure, assets and purchased software maintenance costs; 23.4. property or the purchase of shares; 37.7. maintenance, spare parts and operating costs; 23.5. the remuneration of staff, except for this provision, paragraph 33; 23.5. any premium for the extra work, overtime work or work on public holidays, bonuses, incentives and prize money; 37.10. taxes and fees (except this rule 28.6. and 19.7 in, as well as 33 and 34 cases referred to in paragraph); 37.11. moped, motorcycle, motor tricycle, quadricycle, buses, cars and trucks (excluding services of general interest and special vehicles, tailored to specific tasks, which are installed in a specific function execution equipment and has a mobile service) acquisition costs; 37.12. expenditure related to the implementation of any action abroad; 37.13. fee for the training, which is part of general secondary education or higher education programs; 37.14. local road construction and rebuilding costs; 37.15. costs incurred prior to the application of the project (except this rule 28.6. and 19.7. the costs referred to in point); 37.16. other costs that are not eligible under the European Parliament and of the Council of 17 December 2013 Regulation (EU) no 1305/2013 on support for rural development by the European agricultural fund for rural development (EAFRD) and repealing Council Regulation (EC) No 1698/2005.38. Costs incurred by rural support service exceeds the average costs of the assessment, as well as the implementation of the activities and objectives of the time period specified by the schedule of costs considered eligible costs. Local action group project paper copy of the application along with proof of registration of the project shall be returned to the applicant; 43.2. the applicant's statement in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period; 43.3. If real estate in which to implement the project and to set up fixed assets, support the applicant lease or loan, lease or loan contract copy (lease or loan contract concluded for a period of at least seven years from the date of submission of application). If for new construction, alterations, construction housing placement, installation or construction of housing and real estate in which to implement the project, the applicant is hired, that together with the project application or before the commencement of the project submitted to the long-term lease that land which is registered in the rental period is not less than nine years from the date of submission of the application.
