General questions 1. determines: 1.1. procedures for implementing the action programme "growth and employment" priority axis "ICT accessibility , e-Government and services "2.1.1. specific objective" to improve the accessibility of electronic communications infrastructure in rural areas "(hereinafter referred to as the specific objective) the first selection round; 1.2. the specific purpose of the aid; 1.3. specific objectives of the aid to the first application round project available for funding; 1.4. the requirements of the European regional development fund project applicant; 1.5. the eligible cost of the operation and the conditions of the question; 1.6. the agreement for the implementation of a project of cooling-off unilateral conditions; 1.7. procedures for ensuring the fulfilment of the conditions of State aid. 2. the specific objective is to improve the availability of electronic communications networks for users in rural areas, providing infrastructure in areas where no electronic communications operator provides and the nearest three years does not plan to provide internet access services with enhanced data transmission parameters, using all or part of the fibre optic elements consisting of broadband access networks, and provides a data rate of at least 30 Mbit/s (hereinafter referred to as the "white" areas). These restrictions do not apply to services which are related to national defence and security functions, as well as national sovereignty; 21.2. must not profit from the resulting infrastructure, ensuring that project income and expenditure are in balance. The beneficiary must reimburse any possible surpluses from the operation of the network, the Ministry of transport, who will oversee the funding requested for annual accounting statements and reviewed the amount of the refund; 21.3. provide any electronic communications operator to equal conditions of access. 22. The beneficiary shall ensure that: 22.1. sustainability of the project results in at least seven years after the completion of the project; 22.2. the project results and the necessary resources for the maintenance of the 20 years of results after completion of the project. 23. The project site is the Republic of Latvia. 24. the project shall be implemented in accordance with the agreement for the implementation of a project, but no longer than until 2020 December 31. 25. cooperation authority have the right to unilaterally withdraw from the agreement in any of the following cases: 25.1. the beneficiary fails to fulfil a contract for the project implementation, including non-compliance with the time limits set out in the project or have other circumstances occurred which negatively affects or may affect the specific aid objectives, outcome indicators and monitoring indicators; 25.2. in other cases provided for in the conditions of the agreement for the implementation of a project. V. the State aid conditions and monitoring their implementation 26. State aid rules and the monitoring of optical network is created for the Monitoring Committee (hereinafter the Committee) during project implementation and for at least 20 years after the project is created and the optical network access point into decision-making ensure State aid rules, including: 26.1. monitor the optical network access point of the creation of the order of priority; 26.2. the beneficiary before initiating operation of infrastructure in development planning proposals for the "white" area map, approve the planned rectification access point list and places it in the tīmekļvietn by the Ministry of transport; 26.3. Approves the optical network access tariffs and their detection methodology; 26.4. Approves the optical network access conditions. 27. The beneficiary collects data on electronic communications merchant connections, optical network infrastructure and provide proposals to the Committee to better broadband infrastructure for electronic communications and electronic communications operators to attract optical network infrastructure, including optical network access points. 28. the Committee is a collegial institution which functions and activities are determined by the Ministry of transport approved the rules of procedure of the Committee. 29. the Committee shall consist of the following members of the Committee with voting rights: the Ministry of transport 29.1. as the representative of the Ministry of industry, the Chairman of the Committee and Vice-Chairman of the Committee; 29.2. The composition of the Committee in an advisory capacity: 30.1. may participate in the public service Regulatory Commission representative; 30.2. the competition Council representative; 30.3. the beneficiary representative. 31. the Committee may participate as observers: 31.1. a representative of the Ministry of finance; 31.2. the Central Finance and contracting agency representative; 31. the representative of the authority responsible. 32. during the implementation of the project, and 20 years after the project is created in the optical network and the access point into making the beneficiary at least once a year, shall submit to the Committee a report on the optical network and access points including financial information related to the operation of the network, and information on the optical network and the access point for users. 33. The Ministry of transport in its tīmekļvietn the publishes information on approved State aid scheme and its implementation of the provisions of the full text, the name of the beneficiary of the aid, the amount of the aid, the aid intensity and the technology used.
