The Saeima has adopted and the President promulgated the following laws: For the 1979 Bonn Convention on the conservation of migratory species of wild animals article 1. 23 June 1979 Bonn Convention on the conservation of migratory species of wild animals (hereinafter referred to as the Convention) and its annex I and annex II (hereinafter referred to as Annex) by this law are accepted and approved. 2. article. The law shall enter into force on the date of its promulgation. With the law put the Convention and Annex in English and their translation into Latvian language. 3. article. The protection of the environment and regional development Ministry to coordinate the Convention and fulfilment of the obligations provided for in the annexes. 4. article. The Convention and the annexes shall thereupon enter into force laid down in article XVIII of the Convention at the time and in the order, and shall notify the Ministry of Foreign Affairs Gazette "journal". The law adopted by the Parliament of 11 March 1999.  The President g. Ulmanis in Riga on 25 March 1999, the Convention on the Conservation of Migratory Species of Wild Animals in the CONTRACTING parties, RECOGNIZING that wild animals in their innumerabl form with an irreplaceable part of the earth's natural system which must be conserved for the good of mankind; Aware that each generation of man holds the resources of the earth for future generations and has an obligation to ensur that this legacy is conserved and, where utilized, is used wisely; Conscious of the ever-growing value of wild animals from environmental, ecological, genetic, scientific, educational, recreational, cultural, aesthetics, social and economic points of view; CONCERNED particularly with those species of wild animals that the across or outside migrat national jurisdictional boundaries; RECOGNIZING that the States with and must be the protectors of the migratory species of wild animals that live within or pass through their national jurisdictional boundaries; CONVINCED that conservation and effective management of migratory species of wild animals require the concerted action of all States within the national jurisdictional boundaries of which such species spend any part of their life cycle; RECALLING Recommendations 32 of the Action Plan adopted by the United Nations Conference on the Human Environment (Stockholm,1972) and noted with satisfaction at the Twenty-seventh Session of the General Assembly of the United Nations, have AGREED as follows: article I Interpretation 1. For the purpose of this Convention: a) "Migratory Species" means the entire population or any geographically separate part of the population of any species or lower taxon of wild animals , a significant proportion of whose members cyclically and predictably cross one or more national jurisdictional boundaries; (b)) "Conservation status of a migratory species" means the sum of the influence of acting on the migratory species that may be its long-term affec distribution and abundance; (c)) "Conservation status" will be taken as "favourabl" when: (1) population dynamics data indicates that the migratory species is maintaining itself on a long-term basis as a component of it is viabl ecosystems; (2) the range of the migratory species is not currently being reduced, nor ither is likely to be reduced, on a long-term basis; (3) there is, and will be in the foreseeabl future, sufficient Habitat to maintain the population it of the migratory species on a long-term basis; and (4) the distribution and abundance of the migratory species approach historic coverage and levels to the exten that the ecosystems the potentially suitabl to exist and to be consistent with the exten wise wildlife management; (d)) "Conservation status" will be taken as "unfavourabl" if any of the conditions set out in sub-paragraph (c) of this paragraph is not met; e) "Endangered" in relations to a particular migratory species means that the migratory species is in danger of extinction throughout all or a significant portions of its range; f) "range" means all the areas of land or water that a migratory species inhabit, stay in, or crosss-OK to at any time on overfl its normal migration route; g) "Habitat" means any area in the range of a migratory species which contains suitabl living conditions for that species; h) "range State" in relations to a particular migratory species means any State (and where appropriate any other Party referred to under sub-paragraph (k) of this paragraph) that exercises jurisdiction over any part of the range of that migratory species, or a State, flag vessel of which are engaged outside national jurisdictional limits in taking that migratory species; I) "Taking" means taking, hunting, fishing, capturing, harassing, deliberate killing, or attempting to engage in any such conduct; j) "agreement" means an international agreement relating to the conservation of one or more migratory species as provided for in articles IV and V of this Convention; and k) "Party" means a State or any regional economic integration organization constituted by sovereign States which has competence in respect of the negotiation, conclusion and application of international agreements in matters covered by this Convention for which this Convention is in force. 2. In matters within their competence, the regional economic integration organizations which are parties to this Convention shall in their own name exercise the rights and fulfil the responsibilities which this Convention attributes to their member States. In such cases the member States of these organizations shall not be entitled to exercise such rights individually. 3. Where this Convention provides for a decision to be taken by either a two-thirds majority or a unanimous decision of the of "the Parties present and voting" this shall mean "the Parties present and casting an affirmativ or negative vote". Those abstaining from voting shall not be counted amongs the "the Parties present and voting" in determining the majority. Article II Fundamental principles 1. The parties acknowledg the importanc of migratory species being conserved and of range States agreeing to take action to this end whenever possible and appropriate, paying special attention to migratory species the conservation status of which is unfavourabl, and taking individually or in co-operation appropriate and not cessary steps to conserve such species and their habitat. 2. The parties acknowledg the need to take action to avoid any migratory species becoming endangered. 3. In particular, the parties: (a)) should promote, co-operate in and support research relating to migratory species; (b)) shall endeavour to provide immediate protection for migratory species included in Appendix I shall endeavour to c); and the conclud agreements covering the conservation and management of migratory species included in Appendix II. Article III the Endangered Migratory Species: Appendix I Appendix 1 I shall list migratory species which are endangered. 2. A migratory species may be listed in Appendix I provided that reliable evidence, including the best scientific evidence available, indicates that of the species is endangered. 3. A migratory species may be removed from Appendix I when the Conference of the parties of that: (a) determin) reliable evidence, including the best scientific evidence available, indicates that of the species is no longer endangered, and (b)) the species is not likely to become endangered again because of loss of protection due to its removal from Appendix i. 4. Parties that are range States of a migratory species listed in Appendix I shall endeavour : a) to conserve and, where feasibl and appropriate, restore those habitats of the species which with of importanc in removing the species from danger of extinction; (b)) to prevent, remove or minimize compensat, for, as appropriate, the adverse effects of activities or of that seriously imped removes or prevent the migration of the species; and (c)) to the exten to feasibl and appropriate, to prevent, reduce or control factors that are endangering or are likely to further endanger the species, including strictly controlling the introduction of, or controlling or eliminating, already introduced exotic species. 5. Parties that are range States of a migratory species listed in Appendix I shall be prohibi the taking of animals belonging to such species. Exception may be made to this prohibition only if: (a)) the taking is for scientific purpose; (b)) the taking is for the purpose of enhancing the propagation or survival of the affected species; (c)) the taking is to accommodate up the needs of traditional subsistenc users of such species; or (d)) of these require extraordinary circumstanc; provided that such exception with precise axis of their content and limited in space and time. Such taking should not operate to the disadvantage of the species. 6. The Conference of the parties may recommend to the parties that are range States of a migratory species listed in Appendix I that they take further measure considered appropriate for it to benefit the species. 7. The Parties shall as soon as possible inform the Secretariat of any exception made to paragraph 5 of the pursuan article. Article IV Migratory Species to be the subject of agreements: Appendix II Appendix II shall list 1 migratory species which have an unfavourabl of conservation status and which require international agreements for their conservation and management, as well as those which have a conservation status which would significantly benefit from the international co-operation that could be achieved by an international agreement. 2. If the Council so warrant, a circumstanc migratory species may be listed both in Appendix I and Appendix II. 3. Parties that are range States of migratory species listed in Appendix II shall endeavour to conclud-agreements where these would benefit the species and should give priority to those species in an unfavourabl of conservation status. 4. Parties are encouraged to take action with a view to concluding agreements for any population or any geographically separate part of the population of any species or lower taxon of wild animals, members of which periodically cross one or more national jurisdictional boundaries. 5. The secretariat shall be provided with a copy of each agreement concluded pursuan to the provision of this article. Article V guidelines for agreements 1. The object of each agreement shall be to restore the migratory species concerned to a favourabl conservation status or maintain it in it in such a status. Each agreement should deal with those aspects of the conservation and management of the migratory species concerned which serve to achieve that object. 2. Each agreement should cover the whole of the range of the migratory species concerned and should be open to accession by all range States of that species, whethers or not they are parties to this Convention. 3. An agreement should, wherever possible, deal with more than one migratory species. 4. Each agreement should: (a) identify the migratory species) covered; (b)) the rank and describ the migration route of the migratory species; (c) provide for each Party) it is the national authority concerned designat it with the implementation of the agreement; (d) establish, if not cessary), appropriate machinery to assist in carrying out the aims of the agreement, to monitor its effectiveness, and to prepare reports for the Conference of the parties; e) provides for procedures for the settlement of the dispute between the parties to the agreement; and (f)) at a minimum, be in relations to a prohibi migratory species of the Order Cetace, any taking that is not permitted for that migratory species under any other multilaterals agreement and provide for accession to the agreement by States that are not range States of that migratory species. 5. Where appropriate and feasibl, each agreement should provide for, but not be limited to: (a) periodic review of the conservation) status of the migratory species concerned and the identification of the factors which may be harmful to that status; (b) co-ordinated conservation) and management plans; c) research into the ecology and population dynamics of the migratory species concerned, with special regards to migration; (d)) the exchange of information on the migratory species concerned, special regard being paid to the exchange of the results of research and of relevant statistics; e) conservation and, where required and feasibl, restoration of the habitats of the importanc in maintaining a favourabl conservation status, and protection of such habitats from disturbanc, including strict control of the introduction of, or control of already introduced, exotic species detrimental to the migratory species; f) maintenance of a network of habitats appropriately disposed in the suitabl relations to the migration routes; (g)) where it will appear, the provision of desirabl new habitats favourabl to the migratory species or reintroduction of the migratory species into a favourabl habitats; (h)), to the elimination of maximum possible, or compensation be exten for activities and of which hinder or removes imped is migration; (I) the prevention, reduction or control) of the release into the Habitat of the migratory species of substances harmful to that migratory species; "based on the sound of the j) ecological principles to control and manage the taking of the migratory species; (k) procedures for co-ordinating) action to suppress illegal taking; l) exchange of information on substantial threats to the migratory species; emergency procedures whereby conservation m) action would be considerably and rapidly strengthened when the conservation status of the migratory species is seriously affected; and n) making the general public aware of the contents and aims of the agreement. Article VI range States 1 A list of the range States of migratory species listed in the annexes I and II shall be Appendic kep up to date by the Secretariat using information it has received from the parties. 2. The Parties shall keep the secretariat informed in regards to which of the migratory species listed in the I and II they consider Appendic themselves to be the range States, including the provision of information on their flag vessel engaged outside national jurisdictional limits in taking the migratory species concerned and, where possible, future plans in respect of such taking. 3. The parties which are range States for migratory species listed in Appendix I or Appendix II should inform the Conference of the parties through the Secretariat, at least six months prior to each ordinary meeting of the Conference, one measure of that ut300r2u taking it implementations that the provision of this Convention for these species. Article VI of the Conference of the parties 1. The Conference of the Parties shall be the decision-making organ of this Convention. 2. The secretariat shall call a meeting of the Conference of the parties not later than two years after the entry into force of this Convention. 3. Thereafter the Secretariat shall ordinary meetings of the conven of the Conference of the parties at intervals of not more than three years, unless the Conference decide otherwise, and of extraordinary meetings at any time on the written request of at least one-third of the parties. 4. The Conference of the Parties shall establish and keep under review the financial regulations of this Convention. The Conference of the Parties shall, at each of its ordinary meetings, the adop budget for the next financial period. Each Party shall contribute to this budget according to a scale to be agreed upon by the Conference. Financial regulations, including the provision on the budget and the scale of contributions as well as their modification, shall be adopted by unanimous vote of the Parties present and voting. 5. At each of its meetings the Conference of the Parties shall review the implementation of this Convention and may in particular: (a) review and assess) the conservation status of migratory species; (b) review the progress) made towards the conservation of migratory species, especially those listed in the annexes I and II; Appendic c) make such provision and provide such guidance as may be not cessary to enable the Scientific Council and the Secretariat to carry out their duties; (d) receive and consider any) reports presented by the Scientific Council, the Secretariat, any Party or any standing body established to an agreement pursuan; e) make recommendations to the parties for improving the conservation status of migratory species and review the progress being made under agreements; f) in those cases where an agreement has not been concluded, make recommendations for the convening of meetings of the parties that are range States of a migratory species or group of migratory species to discuss measure to improve the conservation status of the species; g) make recommendations to the parties for improving the effectiveness of this Convention; and (h)) decide on any additional measure that should be taken to implementations that the objective of this Convention. 6. Each meeting of the Conference of the parties should determin the time and venue of the next meeting. 7. Any meeting of the Conference of the Parties shall adop determin and rules of procedure for that meeting. Decision at a meeting of the Conference of the Parties shall require a two-thirds majority of the Parties present and voting, except where otherwise provided for by this Convention. 8. The United Nations, its Specialized agencies, the International Atomic Energy Agency, as well as any State not a party to this Convention and, for each agreement, the body designated by the parties to that agreement may be represented by an observer at meetings of the Conference of the parties. 9. Any agency or body technically qualified in protection, conservation and management of migratory species, in the following categories, which has informed the Secretariat of its desire to be represented at meetings of the Conference of the parties by the observer shall be admitted unless, at least one-third of the Parties present object: (a) international agencies or bodies), either governmental or non-governmental , and national governmental agencies and bodies; and (b) national non-governmental) agencies or bodies which have been approved for this purpose by the State in which they are located. Once admitted, these observer shall have the right to it is not to be participat vote. Article VIII of the Scientific Council At its 1 meeting, the first Conference of the Parties shall establish a Scientific Council to provide advice on scientific matters. 2. Any Party may be a qualified expert appoin as a member of the Scientific Council. In addition, the Scientific Council shall include as members qualified experts selected and appointed by the Conference of the parties; the number of these experts, the criteria for their selection and the terms of their appointments shall be as determined by the Conference of the parties. 3. The Scientific Council shall meet at the request of the Secretariat as required by the Conference of the parties. 4. Subject to the approval of the Conference of the parties, the Scientific Council shall establish its own rules of procedure. 5. The Conference of the Parties shall determin the functions of the Scientific Council, which may include: (a) providing scientific advice) to the Conference of the parties, to the Secretariat, and, if approved by the Conference of the parties, to any body set up under this Convention or an agreement or to any Party; (b)) recommending research and the co-ordination of research on migratory species, evaluating the results of such research in order to ascertain the conservation status of migratory species and reporting to the Conference of the parties on such status and measure for its improvement; c) making recommendations to the Conference of the parties as to the migratory species to be included in (I) or (II), of Appendic together with an indication of the range of such migratory species; d) making recommendations to the Conference of the parties as to specific conservation and management measure to be included in agreements on migratory species; and (e)) recommending to the Conference of the parties to problems relating solutions to the scientific aspects of the implementation of this Convention, in particular with regard to the habitats of migratory species. Article IX the Secretariat of 1 For the purpose of this Convention shall be a secretariat established. 2. Upon entry into force of this Convention, the Secretariat is provided by the Executive Director of the United Nations Environment Programme. To the exten to and in the manner he will consider appropriate, he may be assisted by an intergovernmental or non-governmental suitabl, international or national agencies and bodies technically qualified in protection, conservation and management of wild animals. 3. If the United Nations Environment Programme is no longer able to provide the Secretariat, the Conference of the Parties shall make alternative arrangements for the Secretariat. 4. The function of the Secretariat shall be: (a)) and service the arrang for meetings: (i)) of the Conference of the parties, and (ii)) of the Scientific Council; (b)) it maintains liason with and promote Liason between the parties, the standing bodies set up under agreements and other international organizations concerned with migratory species; (c) to obtain from any appropriate) source reports and other information which will further the objective and implementation of this Convention and to arrang for the appropriate dissemination of such information; (d) to invite the attentions) of the Conference of the parties to any matter pertaining to the objective of this Convention. (e) to prepare for the) Conference of the parties reports on the work of the Secretariat and on the implementation of this Convention; (f) to maintain and publish a list) of range States of all migratory species included in Appendix II; Appendic and g) to promote, under the direction of the Conference of the parties, the conclusion of agreements; (h)) it maintains and make available to the parties a list of agreements and, if so required by the Conference of the parties, to provide any information on such agreements; (I) to maintain and publish a list) of the recommendations made by the Conference of the parties to subparagraph pursuan (e), (f) and (g) of paragraph 5 of article VII or of decisions made it the sub-pursuan paragraph (h) of that paragraph; (j)) to provide for the general public information concerning this Convention and its objective; and to perform any other function) entrusted to it under this Convention or by the Conference of the parties. Article X amendment of the Convention this Convention 1 may be amended at any ordinary or extraordinary meeting of the Conference of the parties. 2. Proposals for amendment may be made by any Party. 3. The text of any proposed amendment and the reasons for it shall be communicated to the Secretariat at least one hundred and fifty days before the meeting at which it is to be considered and shall promptly be communicated by the Secretariat to all parties. Any comments on the text by the Parties shall be communicated to the Secretariat not less than sixty days before the meeting begins. The Secretariat shall, immediately after the last day for submission of comments, communicate to the parties all comments submitted by that day. 4. Amendments shall be adopted by a two-thirds majority a of Parties present and voting. 5. An amendment adopted shall enter into force for all parties which have accepted it on the first day of the third month following the date on which two-thirds of the parties have deposited an instrument of acceptance with the Depositary. For each Party which deposits an instrument of acceptance after the date on which two-thirds of the parties have deposited an instrument of acceptance, the amendment shall enter into force for that Party on the first day of the third month following the deposit of its instrument of acceptance. Article XI amendment of the Appendic. I and II may be Appendic amended at any ordinary or extraordinary meeting of the Conference of the parties. 2. Proposals for amendment may be made by any Party. 3. The text of any proposed amendment and the reasons for it, based on the best scientific evidence available, shall be communicated to the Secretariat at least one hundred and fifty days before the meeting and shall promptly be communicated by the Secretariat to all parties. Any comments on the text by the Parties shall be communicated to the Secretariat not less than sixty days before the meeting begins. The Secretariat shall, immediately after the last day for submission of comments, communicate to the parties all comments submitted by that day. 4. Amendments shall be adopted by a two-thirds majority a of Parties present and voting. 5. An amendment to the Council shall enter into force Appendic for all Parties ninety days after the meeting of the Conference of the parties at which it was adopted, except for those parties which make a reservation in accordanc with paragraph 6 of this article. 6. During the period of ninety days provided for in paragraph 5 of this article, any Party may by notification in writing to the Depositary make a reservation with respect to the amendment. A reservation to an amendment may be withdrawn by written notification to the Depositary and thereupon the amendment shall enter into force for that Party ninety days after the reservation is withdrawn. Article XII effect on International Convention and Other Legislation 1. Nothing in this Convention shall prejudice the codification and development of the law of the sea by the United Nations Conference on the Law of the sea convened pursuan to Resolution 2750 C (XXV) of the General Assembly of the United Nations nor the present or future claims and legal views of any State concerning the law of the sea and the nature and exten of coastal and flag State jurisdiction. 2. The provision of this Convention shall in no way be affec the rights or obligations of any Party deriving from any existing treaty, convention or agreement. 3. The provision of this Convention shall in no way be affec the right of parties to be stricter domestic measure of adop concerning the conservation of migratory species listed in Appendix II or the Andean Appendic adop a domestic measure concerning the conservation of the species not listed in the annexes I and II Appendic. Article XIII settlement of Dispute 1. Any dispute which may «arise between two or more parties with respect to the interpretation or application of the provision of this Convention shall be subject to negotiation between the parties involved in the dispute. 2. If the dispute cannot be resolved in accordanc with paragraph 1 of this article, the parties may, by mutual consent, submit the dispute to arbitration, in particular that of the Permanent Court of Arbitration at the Hague, and the parties submitting the dispute shall be bound by the CAS decision. Article XIV reservations 1. The provision of this Convention shall not be subject to general reservations. Specific reservations may be entered in accordanc with the provision of this article and article XI. 2. Any State or any regional economic integration organization may, on depositing its instrument of ratification, acceptance, approval or accession, enter a specific reservation with regard to the presence on either Appendix I or Appendix II or both, of any migratory species and shall then not be regarded as a Party in regard to the subject of that reservation until ninety days after the Depositary has transmitted to the parties notification that such reservation has been withdrawn. Article XV Signature this Convention shall be open for signature at Bonn for all States and any regional economic integration organization until the twenty-second day of June 1980 article XVI Ratification, acceptance, Approval of this Convention shall be subject to ratification, acceptance or approval. The instrument of ratification, acceptance or approval shall be deposited with the Government of the Federal Republic of Germany, which shall be the Depositary. Article XVII Accession After the twenty-second day of June 1980 this Convention shall be open for accession by all non-signatory States and any regional economic integration organization. Instruments of accession shall be deposited with the Depositary. Article XVIII Entry into force this Convention shall enter 1 into force on the first day of the third month following the date of deposit of the fifteenth instrument of ratification, acceptance, approval or accession with the Depositary. 2. For each State or each regional economic integration organization which ratif, approve of or accept this Convention or accede after the deposit of the theret of the fifteenth instrument of ratification, acceptance, approval or accession, this Convention shall enter into force on the first day of the third month following the deposit by such State or such organization of its instrument of ratification acceptance, approval or accession,. Article XIX Denunciation Any Party may denounc this Convention by written notification to the Depositary at any time. The denunciation shall take effect twelve months after the Depositary has received the notification. Article XX Depositary 1. The original of this Convention, in the English, French, German, Russian and Spanish languages, each version being equally authentic, shall be deposited with the Depositary. The Depositary shall transmit certified to each of the cop of these versions to all States and all regional economic integration organizations that have signed the Convention or deposited instruments of accession to it. The Depositary shall, after consultation with the Governments concerned, prepare an official version of the text of this Convention in the Arabic and Chinese languages. 3. the Depositary shall notify all the signatory and acceding States and all signatory and acceding regional economic integration organizations and the Secretariat of signatures, deposit of instruments of ratification, acceptance, approval or accession, the entry into force of this Convention, amendments to the specific reservations theret and notifications of denunciation. 4. As soon as this Convention enter into force, a certified copy thereof shall be transmitted by the Depositary to the Secretariat of the United Nations for registration and publication in accordanc with article 102 of the Charter of the United Nations. In WITNESS WHEREOF the undersigned, being duly authorized to that effect, have signed this Convention. Migratory Species included in this Appendix are referred to: (a)) by the name of the species or subspec. or (b)) as being all of the migratory species included in a higher taxon or designated part thereof. 2. Other than the reference to tax the higher spec with for the purpose of information or classification only. 3. The abbreviation "(s.l.)" is used to denot that the scientific name is used in its extended meaning. 4. An asterisk (*) placed against the name of a species indicates that the species of, or a separate population of that species, or a higher taxon which includes that species is included in Appendix II.

Agreed to the following: (I) article the concept of explanation 1. Article III of the endangered migratory species: 1. Annex I annex I should include the endangered migratory species; 2. A migratory species may be listed in annex I, provided that sufficient evidence exists, including potentially complete scientific data indicates that the species is endangered. 3. A migratory species may be removed from Annex I, if the Conference of the parties determines that: (a) reliable evidence exists), including possible scientific data that shows that the species is no longer endangered, and (b)), for all I know no longer become compromised due to the termination of the protection by turning it off from Annex I. 4. Parties included in annex I that are range States of a migratory species should seek: (a)) to protect and, where possible and appropriate, to restore its living environment, which is important to protect the species from the threat of extinction; (b)) to prevent, remove, compensate for or minimize, as appropriate, of activities or negative consequences, which seriously hamper, or even prevent the migration of the species; c) as and where appropriate, to prevent, reduce or control factors that are endangering or are likely to further endanger the species. This includes the introduction of strict control or already introduced, exotic species, destruction. 5. Parties included in annex I that are range States of a migratory species, this species should be prohibited in mining. Exceptions to this prohibition only if: (a)) got serves for scientific purposes; (b)) the taking is for the purpose of promoting the reproduction or survival of the species; (c)) the taking is for the purpose-to meet the traditional subsistence users of such species existence; or d) extraordinary circumstances so require; provided that such exceptions are precise as to content and limited in space and time. The Conference of the parties may recommend to the parties that are listed in annex I of the range States of migratory species, take further measures considered appropriate to benefit the species. 7. The parties as soon as possible, inform the Secretariat of any exceptions that allow for this article. Article IV of the migratory species that may be the subject of the contract: 1. Annex II annex II lists migratory species, which have an unfavourable conservation status and which require conservation and management of international agreements, as well as those which have a conservation status which would significantly benefit from the international cooperation that could be achieved by an international agreement. 2. a migratory species may be simultaneously included in annexes I and II, if it is necessary. 3. The Parties included in annex II range States of a migratory species, to try to conclude an Agreement that would benefit the species and should give priority to those species which are not more favourable conservation status. 4. the parties are encouraged to enter into contracts for any of the populations of wild animals, or any geographically delimited part of the population of a species or lower taxon which representatives periodically cross one or more national jurisdictional boundaries. 5. each according to the provisions of this article, a copy of the contract must be sent to the Secretariat. The fundamental principles of the Treaty article v 1. each objective of the Treaty is the migratory species concerned to a favourable conservation status of the renovation or maintenance. Each contract must include these migratory species conservation and management aspects, which serves this purpose. 2. Each agreement should cover the whole of the migratory species concerned and should be open to all range States of that species, to join regardless of whether or not States parties to the Convention. 3. The contract must include, where possible, with more than one migratory species. 4. Each contract shall require: (a)) to specify the migratory species covered; b) describe the migratory species concerned and the migration path; (c)) provide that each Party shall appoint their national authorities responsible for the implementation of the agreement; (d)) where necessary to create a suitable mechanism to promote the attainment of the objectives of the Treaty, its effectiveness, and reporting to the Conference of the parties; (e)) provide for procedures for the settlement of disputes between Contracting Parties; f) at least prohibit any cetacean of the migratory species, which does not allow any other multilateral agreement and provide for the opportunity to join this Treaty States that are not range States of that species. 5. Where it meets and probably each contract, but not limited to: (a) must be provided for it) given the conservation status of the migratory species for periodic review and identification of the factors which may be harmful to that status; b) protection and management plan coordination; (c) research on this) the ecology and population dynamics of the migratory species, especially taking into account the migration; d) exchange of information on the migratory species concerned, special regard being paid to the results of research and the corresponding statistical data exchange; e) the living environment, which is important to ensure the favourable conservation status, and, if possible and necessary, the renewal of such living environment protection from interference, including strong exotic species, or already introduced, migratory species, species of harmful exotic; f) applied, in relation to the migration routes in the appropriate way, the living environment of the deployed network maintenance; g) when it is desirable, new to the migratory species-friendly living environment or reintroduction of the migratory species in a favourable living environment; h) option to terminate or maximum offset transactions and remove obstacles that hinder or impede migration; (I)) to prevent, reduce and control the migratory species of substances harmful to migratory species living environment. j) on sound ecological principles based migratory species of control and management measures; k) measures to coordinate activities for the prevention of illegal mining; l) exchange of information on major threats to migratory species; m) extreme measures to rapidly and significantly step up protection, where the conservation status of the migratory species is seriously affected; and n) making the general public aware of the contents and purpose of the Treaty. Article vi 1. Range States, the Secretariat is constantly renewed in the annexes I and II of the range States of migratory species list using the information received from the parties. 2. The Parties shall inform the secretariat about it, for which contained in annexes I and II, migratory species, they consider themselves in a range of countries, including information on ships flying the flag of that country and deals with migratory species of outside national jurisdictional boundaries, as well as, where possible, of such mining plans in the future. 3. The Parties included in annex I and II to the range States of a migratory species should inform the Conference of the parties through the Secretariat no later than six months before the current meeting of the Conference on measures to enforce the Convention's conditions for these species. Article VII 1. The Conference of the parties to the Conference of the parties to this Convention have authority. 2. the Secretariat shall convene the Conference of the parties not later than two years after the entry into force of the Convention. 3. The secretariat then convened the Conference of the parties regularly at least once every three years, unless the Conference of the Parties decides otherwise, and extraordinary meetings at any time, if they make a request in writing at least one third of the parties. 4. The Conference of the parties should establish and regularly review the financial rules of the Convention. Each regular Conference of the parties adopt the next financial period budget. Each party must make its contribution to the budget according to the amount fixed in the Conference. The Conference of the parties to be considered at each meeting of the realization of the Convention, in particular: (a)) to consider and assess the conservation status of migratory species; (b)) to examine the results in the conservation of migratory species, especially in annex I and III species; c) to adopt the conditions and instructions, which can prove necessary scientific Council and the Secretariat, to carry out their duties; d) receive and consider any reports presented by the Scientific Council, the Secretariat, any party or any standing body created under contract; e) provide Parties recommendations for migrating to improve the conservation status of the species and to examine the performance of the contract; (f)) in cases where the contract has not been concluded, make recommendations for the convening of meetings of the parties, which are of a migratory species or group of migratory species to discuss measures to improve the conservation status of the species; g) provide recommendations to the parties The effectiveness of the Convention; and (h)) decide on any additional measure that should be taken for the realization of the objectives of the Convention. 6. each meeting of the Conference of the parties to determine the next meeting place and time. 7. each meeting of the Conference of the Parties shall determine and adopt rules of procedure for that meeting. The Conference of the Parties decision requires a two-thirds majority of those present and voting in the majority of Parties who participated in, except for the cases when the Convention provides otherwise. 8. The United Nations, its specialized agencies, the International Atomic Energy Agency, as well as any State not party to the Convention, or whether each individual treaty bodies appointed by the parties to the Convention by the Conference of the parties may be represented by observers. 9. any organization or body which is technically competent in the protection of migratory species, in the conservation and management of, belong to the categories listed below and has informed the Secretariat of its wish to be represented as observers in the meeting of the Conference of the parties should be given the chance, unless at least one third of the participating party to make it: (a) international agencies) and organizations like the national non-governmental, and national governmental agencies and bodies; and (b)) national non-governmental organizations and agencies for that purpose made their home countries. Single observers shall have the right to participate but not to vote. Article VIII 1. The Scientific Council shall at its first meeting, the Conference of the parties to establish a Scientific Council to provide advice on scientific matters. 2. Each Party may appoint a qualified expert as a member of the Scientific Council. In addition, the Scientific Council should include experts, chosen by and appointed by the Conference of the parties. The number of experts, the selection criteria and the nomination period should be determined by the Conference of the parties. 3. the Scientific Council shall meet at the request of the Secretariat, at the request of the Conference of the parties. 4. the Scientific Council shall draw up its rules of procedure as approved by the Conference of the parties. 5. Article IX 1. Secretariat for the implementation of the objectives of this Convention must create a secretariat. 2. The secretariat shall after the entry into force of the Convention establishing the United Nations Environment Program Executive Director. In numbers and in such a manner as he considers necessary. Article x of the Convention text Corrections 1. Corrections in the text of this Convention can be done during the current or extraordinary Conference of the parties. 2. Proposals for amendments may be made by any party. 3. the text of any proposed amendment and the reasons therefor must be notified to the Secretariat, no later than one hundred and fifty days before the meeting at which it is to be considered, and the Secretariat, they should immediately notify all parties. Any comments on the text of the parties, be referred to the Secretariat not later than sixty days before the beginning of the meeting. Any comments on the text of the parties, be referred to the Secretariat not later than sixty days before the beginning of the meeting. The Secretariat immediately after the closing date for the submission of comments must be sent to the parties all comments submitted by that day. 4. Amendments shall be adopted by a two-thirds majority of the members participating in the vote and a majority of the parties. 5. Fix the annexes shall enter into force for all Parties ninety days after the meeting of the Conference of the parties at which it was adopted, except for those parties that have adopted the disclaimers, according to paragraph 6 of this article. 6. in paragraph 5 of this article, the ninety-day period provided for in either party by written notice to the depositary may make a reservation in relation to the correction. Disclaimer for the correction may be withdrawn by written notification to the depositary. Fix party shall enter into force ninety days after the reservation cancellation. Article XII effect on international conventions and other legislation 1. Nothing in this Convention shall not adversely affect the development of maritime law and codification by the United Nations Conference on the law of the sea, convened in accordance with United Nations General Assembly resolution 2750 C (XXV), no current or future requirements and any State legal opinions on the law of the sea, nature, land or flag State jurisdiction. 2. The provisions of this Convention shall not in any way affect the rights of any party, or obligations arising from existing treaties, conventions or agreements. 3. The provisions of this Convention shall not in any way affect the right of parties to introduce the more stringent requirements of annexes I and II for the protection of species or more stringent requirements not included in annexes I and II for the protection of species. Article XIII Dispute settlement 1. any dispute which may arise between two or more parties about the interpretation of the provisions of this Convention, to izdiskut or use the negotiations between the parties to the dispute. 2. Specific reservations may be established in accordance with this article and the provisions of article XI. 2.
