The Saeima has adopted and the President promulgated the following laws: criminal law amendments to make the criminal law of the Republic of Latvia (Saeima and the Cabinet of Ministers rapporteur, 1998, no. 15; 2000, no. 12, 13, 15; 2001; 2002, nr. 11, 16, 22, 23 no; 2003, 10, 15; 2004, nr. 2, 3, 4, 6, 11, 12, 13 no, 2; 2005, 11, 12, 13 no; Latvian journal, 2005, nr. 156.) the following amendments: 1. Add to article 42, the third part of the sentence the following wording: "the Court, in determining the property confiscation in criminal offences against road safety, apply partial confiscation of property and extending it to the vehicle."
2. Add to the third subparagraph of article 260 of the sanctions with the words "and confiscating property or without confiscation of property."
3. Express article 262 as follows: "article 262. Drink, drugs, psychotropic, toxic or other intoxicating substances affect (1) The driving or learning to drive alcohol, narcotic, psychotropic, toxic or other intoxicating substances, if done repeatedly during the year — punishable by deprivation of liberty for a period of up to two years or with arrest or forced labour, or by a fine of up to fifty minimum monthly salary, minus the driving they implement it for up to five years and confiscated the belongings or without confiscation of property.
(2) For driving or learning to drive, if not driving right (driving rights in a fixed order is acquired or taken away) and if the driver is alcohol, drugs, psychotropic, toxic or other intoxicating substances, — punishable by deprivation of liberty for a period of up to two years or with arrest or forced labour, or by a fine of up to fifty minimum monthly salary, minus the driving they implement it for up to five years and confiscated the belongings or without confiscation of property. "
4. To supplement the law with article 262.1 as follows: "article 262.1. Withdrawal from alcohol, drugs, psychotropic, toxic or other intoxicating substances checks On driving off from the medical tests to determine the concentration of alcohol in the blood or narcotic, psychotropic, toxic or other intoxicating substances impact checks if it repeatedly during the year — punishable by deprivation of liberty for a period of up to one year, or with the arrest or forced labour, or by a fine of up to fifty minimum monthly wages in the by subtracting the driving right on time from three to five years and confiscated the belongings or without confiscation of property. "
The Parliament adopted the law in 2005 to 6 October.
