The Saeima has adopted and the President promulgated the following laws: for the 1995 International Convention on fishing vessels, staff training and certification, and Watchkeeping standards of article 1. 7 July 1995 International Convention on fishing vessels, staff training and certification, and Watchkeeping standards (hereinafter referred to as the Convention) with this law is accepted and approved. 2. article. Fulfilment of the obligations provided for in the Convention are coordinated by the Ministry of transportation. 3. article. The Convention shall enter into force on its article 12 within the time and in order, and the Ministry of Foreign Affairs shall notify the newspaper "journal". 4. article. The law shall enter into force on the day following its promulgation. With the law put the Convention in English and its translation into Latvian va ball. The law adopted by the Parliament in 2006 October 12, State President v. Vaira Vīķe-Freiberga in Riga in 2006 November 1 INTERNATIONAL CONVENTION ON standards OF TRAINING, CERTIFICATION AND WATCHKEEPING FOR FISHING VESSEL PERSONNEL, 1995. The parties TO this CONVENTION, NOTING the International Convention on standards of Training, Certification and Watchkeeping for Seafarer, 1978 (hereinafter referred to as the "1978 STCW Convention"), (MENU RNGTON LINE4) to further promote safety of life and property at sea and the protection of the marine environment by establishing in common agreement international standard of training, certification and watchkeeping for fishing vessel personnel employed on board, CONSIDERING that this end may be best achieved by the conclusion of an International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel, hereinafter referred to as "the Convention", have AGREED as follows: article 1 General obligations 1 the parties to give effect to undertak to the provision of the Convention and the annex of theret , which shall be an integral on the constitut of the Convention. Every reference to the Convention at the same of the constitut time a reference to the annexe theret. 2 the parties to promulgat all undertak law, Decree, orders and regulations and to take all other steps which may be not cessary to give the Convention full and complete effect so as to ensur that, from the point of view of safety of life and property at sea and the protection of the marine environment, fishing vessel seagoing personnel are qualified and fit for their duties. Article 2 Definition For the purpose of the Convention, unless expressly provided otherwise: a 1 Party means a State for which the Convention has entered into force. 2 Administration means the Government of the Party whose flag the vessel is entitled to fly. 3. Certificate means a valid document, by whatever name it may be known, issued or recognized in accordanc with the provision of the Convention, authorizing the holder to serve as stated in this document or as authorized by national regulations. 4 means properly Certificated holding a certificate. 5 Organization means the International Maritime Organization. 6-General Secretary means the Secretary-General of the Organization. Fishing vessel or vessel 7 means any vessel used commercially for catching fish or other living resources of the sea. 8 Seagoing fishing vessel means a fishing vessel other than those which navigate exclusively in inland waters or in waters within, or closely adjacent to, sheltered waters or areas where port regulations apply. Article 3 the Convention shall apply to the applications personnel serving on board seagoing fishing vessel is entitled to fly the flag of a Party. 4. Communication of information article Each Party shall communicate to the Secretary-General the following information: 1 a report on the measure it has taken to give full and complete effect to the provision of the Convention, including a specimen of the certificates issued in compliance with the Convention; and other information which may be 2 specified or provided for in regulation I/5. Article 5 interpretation 1 and All the Other treats prior to convention and treats a subject relating to standards of training, certification and watchkeeping for fishing vessel personnel in force between the parties, shall continue to have full and complete effect during the terms thereof as regards: 1 fishing vessel personnel to whom this Convention does not apply; and fishing vessel personnel whom it 2 this Convention applies, in respect of matters for which it has not expressly provided. 2 To the exten, however, that such treats, or arrangements of the convention conflict with the provision of the Convention, the Parties shall review their commitment under such treats, and arrangements with the convention a view to ensuring that there is no conflict between these commitment and their obligations under the Convention. 3 All matters which are not expressly provided for in the Convention remain subject to the legislation of the parties. Article 6 shall be certificated personnel Certification Fishing vessel in accordanc with the provision of the annex to this Convention. Article 7 National provision Each Party shall 1 establish processes and procedures for the impartial investigation of any reported incompetency, act or omission, that may pose a direct threat to safety of life or property at sea or to the marine environment, by the holder of a certificate issued by or for the endorsement of that Party in connection with their performance of duties related to their certificates and for the attention suspension and cancellation of such certificates, for such cause and for the prevention of fraud. 2 Each Party shall the penalties or disciplinary measure prescrib for cases in which the provision of its national legislation giving effect to this Convention are not complied with in respect of a vessel entitled to fly its flag or of fishing vessel personnel duly certificated by that Party. 3 In particular, such penalties or disciplinary measure shall be of the prescribed and enforced in cases in which: 1 an owner, owner's agent or a person not holding the skipper has engaged a certificate as required by this Convention; 2 a skipper has allowed any function or service in any capacity required by these regulations to be performed by a person holding an appropriate certificate to be performed by a person not holding an appropriate certificate or dispensation; (a) the person has obtained or. 3 by fraud or forged documents an engagement to perform any function or serve in any capacity required by these regulations to be performed or filled by a person holding a certificate or dispensation. 4 A Party within whose jurisdiction there is based an owner or owner's agent or any person who is believed on clear grounds to have been responsible for, or to have knowledge of, any non-compliance with apparen the Convention specified in paragraph 3, shall extend all possible co-operation to any Party which advise it of its intention to initiat the proceedings under its jurisdiction. Article 8 1, while saltwater Fishing vessel Control in the port of another Party, is subject to the control by officers duly authorized by that Party to verify that all persons serving on board who are required to be certificated by this Convention with so certificated or hold appropriate UN dispensation. 2 In the event of failure to correct any deficiency referred to in paragraph 3 of regulation I/4 in so far as it post a danger to persons, property or the environment, the Party carrying out the control shall take steps to ensur that the vessel will not sail unless and until these requirements are met to the exten the that the danger has been removed. The facts concerning the action taken shall be reported promptly to the Secretary-General and to the Administration. 3 When exercising control: 1 all possible efforts shall be made to avoid being unduly detained or delayed a vessel. If a vessel is unduly detained or delayed, it shall be entitled to compensation for any loss or damage resulting therefrom; and 2 the discretion allowed in the case of the personnel of foreign fishing vessel shall not be for less than that afforded to the personnel of the vessel flying the flag of the port State. 4 this article shall be applied as may be not the cessary ensur that no more favourabl treatment is given to a vessel entitled to fly the flag of a non-Party than is given to a vessel entitled to fly the flag of a Party. Article 9 Promotion of technical co-operation 1 the parties to the Convention shall promote, in consultation with and with the assistance of the Organization, support for those States which request technical assistance for the training of 1: administrative and technical personnel;. 2 establishment of institutions for training of fishing vessel personnel;. 3 supply of equipment and facilities for training institutions; 4 development of adequat training programmes , including practical training on seagoing fishing vessel; and facilitation of 5 others measure and arrangements to enhance the qualifications of fishing vessel personnel, preferably on a national, sub-regional or regional basis, the further the aim and purpose of the Convention, taking into account the special needs of developing countries in this regard. 2 On it for the Organization shall be pursu the aforesaid efforts, as appropriate, in consultation or association with other international organization, particularly the International Labour Organization and the Food and Agriculture Organization of the United Nations. Article 10 Amendments 1 the Convention may be amended by either of the procedures specified in this article. 2 Amendments after considerations within the Organization: 1. Any amendment proposed by a Party shall be submitted to the Secretary-General, who shall then circulate it to all members of the Organization, to all the parties and to the Director-General of the International Labour Office and of the Food and Agriculture Organization of the United Nations respectively, at least six months prior to its considerations. 2. Any amendment proposed and circulated as above shall be referred to the Maritime Safety Committee of the Organization for considerations. 3 parties whethers or not members of the Organization shall be entitled to participat in the proceedings of the Maritime Safety Committee for the adoption of amendments and considerations. Amendments shall be adopted by the 4 by a two-thirds majority of the Parties present and voting in the Maritime Safety Committee, expanded as provided for in paragraph 2.3 (hereinafter referred to as "the expanded Maritime Safety Committee"), on condition that at least one-third of the Parties shall be present at the time of voting. the Amendments adopted in accordanc. 5 with paragraph 2.4 shall be communicated by the Secretary-General to all the parties. 6 An amendment to an article shall be deemed to have been accepted on the date on which it is accepted by two thirds of the parties. 7. An amendment to the annex or appendix to an annex shall be deemed to the it have been accepted: 7.1 at the end of two years from the date of adoption; or. 7.2 at the end of a different period, which shall not be less than one year, if so determined at the time of its adoption by a two-thirds majority of the Parties present and voting in the Maritime Safety Committee expanded. If, within the specified period, more than one third of the Parties notify the Secretary General that they object to the amendment, it shall be deemed not to have been accepted. 8 An amendment to an article shall enter into force, with respect to those parties which have accepted it, six months after the date on which it is deemed to have been accepted, and with respect to each Party which accept it after that date, six months after the date of that Party's acceptance. 9. An amendment to the annex and the appendix to the United Nations annex shall enter into force with respect to all parties, except to those which have objected to the amendment under paragraph 2.7 and which have not withdrawn such objection, six months after the date on which it is deemed to have been accepted. However, before the date set for the entry into force, any Party may give notice to the Secretary-General that it will exempt itself from giving effect to that amendment for a period not longer than one year from the date of its entry into force, or for such longer period as may be determined by a two-thirds majority of the Parties present and voting in the Maritime Safety Committee expanded at the time of the adoption of the amendment. 3 amendment by a Conference: 1. Upon the request of a Party concurred with by at least one third of the parties, the Organization shall, in association or conven consultation with the Director-General of the International Labour Office and of the Food and Agriculture Organization of the United Nations respectively, (a) Conference of the parties to consider amendments to the present Convention. 2 Every amendment adopted by such a Conference by a two-thirds majority of the Parties present and voting shall be communicated by the Secretary-General to all the parties for acceptance. 3. Unless the Conference decide otherwise, the amendment shall be deemed the to have been accepted and shall enter into force in accordanc with the procedures specified in paragraphs 2.6 and 2.7, 2.8 and 2.9 respectively provided or that the reference in those paragraphs to the expanded Maritime Safety Committee shall be taken to mean the reference to the Conference. 4 Any declaration of acceptance of the amendment, or an objection or any notice given under paragraph 2.9 shall be submitted in writing to the Secretary-General, who shall inform all parties of any such submission and the date of its receipt. 5 the Secretary-General shall notify all the parties of any amendments which will enter into force, together with the date on which each such amendment to enter into force. Article 11. signature, ratification, acceptance, approval and accession 1 the Convention shall remain open for signature at the headquarters of the Organization from 1 January 1996 until 30 September 1996 and shall thereafter remain open for accession. States may become parties to the Convention by: 1. signature without reservation as to ratification, acceptance or approval; or 2 signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or accession 3. 2 Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General. Article 12 Entry into force 1 the Convention shall enter into force 12 months after the date on which not less than 15 States have either signed it without reservation as to ratification, acceptance or approval, or have deposited that the instrument of ratification of the requisit, acceptance, approval or accession in accordanc with article 11.2 For States which have deposited an instrument of ratification acceptance, approval or accession, in respect of the Convention after the requirements for entry into force thereof have been met but prior to the date of entry into force, the ratification, acceptance, approval or accession shall take effect on the date of entry into force of the Convention or three months after the date of deposit of the instrument, whichever is the later date. 3 For States which have deposited an instrument of ratification, acceptance, approval or accession after the date on which the Convention entered into force, the Convention shall become effective three months after the date of deposit of the instrument. 4 After the date on which an amendment to the Convention is deemed to have been accepted under article 10, any instrument of ratification, acceptance, approval or accession deposited shall apply to the Convention as amended. Article 13 Denunciation 1 the Convention may be denounced by any Party at any time after the expiry of five years from the date on which the Convention enter into force for that Party. 2 Denunciation shall be effected by notification in writing to the Secretary-General. 3 A denunciation shall take effect 12 months after receipt of the denunciation by the Secretary-General or after the expiry of any longer period which may be indicated in the notification. Article 14 of the Convention shall be the Depositary 1 deposited with the Secretary-General of the Organization (hereinafter referred to as "the depositary"). the depositary shall: 2.1 the Governments informed of all States which have signed the Convention or acceded by the of: 1.1 theret. each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;. 1.2 the date of entry into force of the Convention. the deposit of any 1.3 instrument of denunciation of the Convention , together with the date on which it was received and the date on which the denunciation takes effect; and 2 transmit certified true cop out of the Convention to the Governments of all States which have signed the present Convention or acceded theret. 3 As soon as the Convention enter into force, a certified true copy thereof shall be transmitted by the depositary to the Secretary-General of the United Nations for registration and publication, in accordanc with article 102 of the Charter of the United Nations. Article 15 of the Convention Language is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic. ANNEX CHAPTER I GENERAL PROVISION of Regulation 1. Definition For the purpose of this annex the following definition will apply. 1 Regulations means regulations led in the annex to the Convention. 2 Approved means approved by the Party in accordanc with the regulations. 3 the person having Skipper means command of a fishing vessel. 4 Officer means a member of the crew, other than the skipper designated as such by national law, or regulations or, in the absence of such designation, by collective agreement or custom. 5 Officer in charge of a navigational watch "means an officer qualified in accordanc with regulation II/2 or III/4 of this Convention. 6 Engineer officer means an officer qualified in accordanc with regulations II/5 of this Convention. 7 Chief engineer officer means the senior engineer officer responsible for the mechanical propulsion and the operation and maintenance of mechanical and electrical installation of the vessel. 8 Second engineer officer means the engineer officer next in rank to the chief engineer officer upon whom the responsibility and for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installation of the vessel will fall in the event of the incapacity of the chief engineer officer. 9 radio operator means a person holding an appropriate certificate issued or recognised by the UN Administration under the provision of the radio regulations. 10 radio regulations means the radio regulations annexed to or regarded as being annexed, it, the most recent International Telecommunication Convention which may be in force at any time. 11 1978 STCW Convention means the International Convention on standards of Training, Certification and Watchkeeping, 1978, as for Seafarer amended. 12 1993 Torremolinos Protocol means the Torremolinos Protocol of 1993 relating to the Torremolinos International Convention for the Safety of Fishing Vessel, 1977.13 power Propulsion means the total maximum continuous rated output power in kilowatt of all the vessel's main propulsion machinery which appear on the vessel's certificate of registry or other official document. 14 Limited waters means those waters in the vicinity of a Party as defined by it Administration within which a degree of safety is considered to exist which enable the standard of qualification and certification for skipper and officer of fishing vessel to be set at a lower level than for service outside the defined limit. In determining the exten of limited waters the Administration shall take into considerations the guidelines developed by the UROrganization.* 15 Unlimited waters means the waters beyond the limited water. 16 Length (L) shall be taken as 96% of the total length on a waterlin at 85% of the least moulded depth measured from the keel line, or as the length from the foresid of the stem to the axis of the rudders stock on that, if that be waterlin greater. In vessel designed with rake of keel the waterlin on which this length is measured shall be parallel to the designed waterlin. 17 Moulded depth is the vertical distance measured from the keel line to the top of the working deck beam at side. * Reference is made to Appendix 1 of resolution a. 539 (13)-Certification of skipper and officers in charge of a navigational watch on a fishing vessel of 24 metres in length and over, adopted by the Organization. 2. Application the Administration Regulations of a Party, if it consider it or to apply unreasonabl impracticabl the full requirements of regulations II/3, II/II/4 and 5 and the requirement of the use of the English language it personnel serving on board a fishing vessel of less than 45 metres in length operating exclusively from its port and fishing within its limited waters on may of these regulations in which determin should not apply, wholly or in part, to such personnel, without derogation from the principles of safety in the Convention. In such a case, the Administration concerned shall report to the Secretary-General on the details of the measure it has taken with respect to the training and certification of such personnel. Regulation 3. Certificates and certificates for endorsement 1 fishing vessel personnel shall only be issued if the requirements for service age, medical fitness, training, qualification and examination by me in accordanc with these regulations. 2 A certificate issued by a Party in compliance with paragraph 1 shall be endorsed by that Party attesting the issue of that certificate in the form as prescribed in appendix 1 or appendix 2.3 Certificate of endorsement shall be issued and in the official language or languages of the issuing country. If the language used is not English, the text shall include a translation into that language. 4 In respect of radio operators, the parties may: 1 include the additional knowledge required by regulations II/6 in the examination for the issue of a certificate complying with the radio regulations; or. 2 issue a separate certificate indicating that the holder has the additional knowledge required by regulations II/6.5 the Administration which has a recognized certificate issued by or under the authority of another Party in compliance with regulation 7 shall issue an endorsement attesting the recognition of that certificate in the form prescribed in appendix 3.6 the endorsement shall expires as soon as the certificate endorsed expires or is withdrawn , suspended or cancelled by the Party which issued it and, in any case, not more than five years after the date of issue. 7 Any appropriate certificate issued under the provision of the 1978 STCW Convention, for the holder to serve as Chief Engineer Officer, an Engineer Officer or Radio Operator, shall be deemed to be a òàæó certificate for the purpose of paragraph 1 with regard to fishing vessel. 8 subject to the variation of the permitted under 1, 2 and 3 of appendic, Administration may use a format different from the format given in those provided that such form of appendic contain, as a minimum, the required information and that the particular with the inserted in Roman characters and Arabic figures. 4. Control procedure 1 of Regulation Control exercised by a duly authorized officer under article 8 shall be limited to the following: 1 verification that all fishing vessel personnel serving on board who are required to be certificated by this Convention with so certificated or hold the required dispensation. Such certificates shall be accepted unless there are clear grounds for believing that (a) a certificate has been fraudulently obtained or the holder of that a certificate is not the person to whom that certificate was originally issued; and 2 assessment of the ability of the fishing vessel personnel to maintain watchkeeping standards as required by the Convention if there are clear grounds for believing that such standards are not being maintained, because the following have occurred:. 2.1 the vessel has been involved in a collision, grounding or stranding; or. 2.2 there has been a discharge of substances from the vessel when under way, at anchor or at berth which is illegal under international convention; or. 2.3 the vessel has been an erratic or manoeuvred in unsafe manner, whereby the adopted routeing measure by the Organization, or safe navigation practices and procedures have not been followed,; 2.4 the vessel or. is otherwise being operated in such a manner as to pose a danger to persons, property or the environment. 2 In the event that deficienc with found under paragraph 1, the officer carrying out the control shall forthwith inform, in writing, the skipper of the vessel and the Administration, so that appropriate action may be taken. Such notification shall specify the details of the basis and the ground deficienc found on which the Party's determin that these pose a danger to deficienc persons, property or the environment. 3 to may be deemed it Deficienc which pose a danger to persons, property or the environment include the following: 1. failure of a person required to hold a certificate, is, to have an appropriate certificate or dispensation; 2 failure of navigational or engineering watch arrangements to conform to the requirements specified for the vessel by the Administration;. 3 absence in a watch of a person qualified to operate equipment essential to the safe navigation , safety radiocommunications or the prevention of pollution; or inability to provide 4 person rested for the first watch at the commencemen of a voyage and for subsequent relieving, watches. Regulation 5. Communications of information 1 the Secretary-General shall, on request, provide Parties with any information communicated to him under article 4 2 A Party which file to communicate information required by article 4 within twenty-four months after the date of entry into force of the Convention for a Party shall not be entitled to claim the privilege of this Convention until such time as the information has been received by the Secretary-General. Regulation 6. Administration of certification arrangements 1 Each Party to establish and maintain a undertak means of ensuring that the Pro-gramm incorporating such instruction and practical training as is not to achieve the cessary competency standards with a regularly monitored their effectiveness by ensur it. 2 Each Party, to the exten undertak a practicabl, it maintains a register or register of all certificates and specified in regulation 3 of the endorsement and the II/6 II/1 which are issued, have expired or have been revalidated,, reported lost, suspended or cancelled, and of dispensation is issued, and provide information on the status of such certificate, endorsement and dispensation when so requested by another Party. 7. Recognition of certificates regulations 1 Each Administration shall ensur, in order to recognize, by endorsement in accordanc with regulation 3, a certificate issued by or under the authority of another Party, that the requirements for standards of competence, as well as the issue and endorsement of certificates by that Party, with a fully complied with. 2 certificates issued by or under the authority of a non-Party shall not be recognized. 3 Notwithstanding the requirement of paragraph 1 of this regulation and paragraph 5 of regulation 3, an Administration may, if the require, allow circumstanc a person to serve for a period not exceeding three months on board a vessel entitled to fly its flag while holding an appropriate and valid certificate issued by another Party without it being endorsed as required by paragraph 5 of regulation 3 provided that documented proof is made available that application for an endorsement has been submitted to the Administration. 8. Transitional provision of the regulations 1 A certificate of competency or of service in a capacity for which this Convention requires a certificate and before entry into force, which of the Convention for a Party is issued in accordanc with the law of that Party or the radio regulations shall be recognized as valid, for service after entry into force of the Convention for that Party. 2 After the entry into force of the Convention for a Party, it may continue to issue certificates of competency in accordanc with its previous practices for a period not exceeding five years. Such certificates shall be recognized as valid for the purpose of the Convention. During this transitional period such certificates shall be issued only to a person who had commenced their sea service before entry into force of the Convention for that Party within the specific ship Department to which those certificates relate. The Party shall ensur that all other candidate shall be examined for certification and certificated in accordanc with the Convention. 3 A Party may, within two years after entry into force of the Convention for that Party, issue a certificate of service to the fishing vessel personnel who hold an appropriate certificate ither not under the Convention nor a certificate of competency issued under its law before entry into force of the Convention for that Party but who have served in the 1: capacity for which they seek a certificate of service for not less than three years at sea within the last seven years preceding the entry into force of the Convention for that Party. 2 produced evidence that they have performed that service satisfactorily; and satisfied the Party 3 as their medical fitness, including eyesigh and hearing, taking into account their age at the time of application. For the purpose of the Convention, a certificate of service issued under this paragraph shall be regarded as the equivalent of a certificate issued under the Convention. Regulation 9.1 of the exceptional Dispensation In circumstanc cessity, not an Administration, if in its opinion this will not cause danger to persons, property or the environment, issue a dispensation permitting a Maya person to serve in a specified fishing vessel for a specified period not exceeding six months in a capacity, other than that of the radio operator, except as provided by the relevant radio regulations , for which the person does not hold the appropriate certificate, provided that the person to whom the dispensation is issued shall be adequately qualified to fill the vacant post in a safe manner, to the satisfaction of the Administration. 2 Any dispensation granted for a post shall be granted only to a person properly certificated to fill the post immediately below it where certification. of the post below is not required by the Convention, a dispensation may be issued to a person whose competence and experience are, in the opinion of the Administration, clearly equivalent to the requirements for the post to be filled , provided that, if such a person holds a certificate from the appropriate person shall be the required to pass a test accepted by the Administration as demonstrating that such a dispensation may safely be issued. In addition, the Administration shall ensur that the post in question is filled by the holder of an appropriate certificate as soon as possible. 3 Each Party shall as soon as possible after 1 January each year send a report to the Secretary-General giving information of the total number of dispensation in respect of each capacity for which a certificate is required, including P2P returns. Regulation 10. Equivalent 1 the Convention shall not prevent a Party from retaining or adopting other educational and training arrangements, including those involving seagoing service and shipboard organization especially adapted to technical developments and to special types of vessel, provided that the level of seagoing service, knowledge and efficiency as regards navigational and technical handling of the vessel to ensur a degree of safety at sea and has a preventive effect as regards pollution at least equivalent to the requirements of the Convention. 2 the subject of such details shall be included in the report under article 4. CHAPTER II CERTIFICATION OF SKIPPER, officers, ENGINEER OFFICER AND radio OPERATOR Regulation 1. Mandatory minimum requirements for certification of skipper on fishing vessel of 24 metres in length and over operating in unlimited water 1 Every skipper on a fishing vessel of 24 metres in length and over operating in the unlimited waters shall hold an appropriate certificate. 2 Every candidate for certification shall: 1. satisfy the Party as to medical fitness, particularly regarding eyesigh and hearing; 2 meet the requirements for certification as an officer in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in unlimited water, and have approved seagoing service of not less than 12 months as an officer in charge of a navigational watch or the skipper on fishing vessel of not less than 12 meters in length. However, the Party may allow the substitution of a period not exceeding six months of approved seagoing service as an officer in charge of a navigational watch on a seagoing ship covered by the 1978 STCW Convention; and 3 have passed an appropriate examination or examination for assessment of competence to the satisfaction of the Party. Such examination or an examination shall include the material set out in the appendix to this regulation. A candidate for examination who holds a valid certificate of competency issued in accordanc with the provision of the 1978 STCW Convention need not be re-examined in those subjects listed in the appendix which were passed at a higher or equivalent level for issue of the Convention certificate. Appendix to regulation 1. Minimum knowledge required for certification of skipper on fishing vessel of 24 metres in length and over operating in unlimited water 1 the syllabi are given below is compiled for examination of a candidate for certification as a skipper on a fishing vessel of 24 metres in length and over operating in unlimited water. Demonstrates thorough knowledge of Watchkeeping 3 3.1 of the content, application and intent of the International regulations for Preventing Collision at sea, 1972, especially annex III and IV are concerned with safe navigation. 3.2 Demonstrates knowledge of Basic principles to be Observed in Keeping a Navigational Watch as prescribed in chapter IV. 4 Radar navigation 4.1 Demonstrates, using a radar simulator or, when not available, manoeuvring board, knowledge of the fundamentals of radar and ability in the operation and use of radar, and in the interpretation and analysis of information obtained from the equipment , including the following: 1 factors regimes by performance and accuracy;. 2 setting up and maintaining displays; detection of misrepresentation of information, 3, false echoes, sea return; 4; 5 range and identification of critical bearings. echoes; 6 course and speed of other ships;. 7 time and distance of approach of the crossing closes, meeting or overtaking ships; 8 detecting course and speed changes of other ships;. 9 effect of changes in own vessel's course or speed or both; and 10 applications of the International regulations for Preventing Collision at sea, 1972. Reference is made to resolution 2 of the 1995 STCW-F Conference. 5 Magnetic and gyro-compass of terrestrial and a celestial 5.1 Ability, using means, to determin and apply the error of the magnetic and gyro-compass. Meteorology and oceanography 6 6.1 knowledge of support tools and their applications. 6.2 Ability to apply support information available. 6.3 knowledge of characteristics of various weather systems, including, at the discretion of the Party, tropical revolving storm and avoidance of storm center and the dangerous quadrants. 6.4 the knowledge of weather conditions, such as fog, liabl to endanger the vessel. 6.5 the Ability to use appropriate navigational publications on tides and current. 6.6 the Ability to calculate the times and heights of high and low water and estimate the direction and rate of tidal streams. 7 Fishing vessel manoeuvring and handling 7.1 handling of a fishing vessel Manoeuvring and in all conditions, including the following: 1 berthing unberthing and anchor works, under various conditions of wind and tide; in a shallow water manoeuvring; 2.3 management and handling of fishing vessel in heavy weather, including appropriate speed, particularly in following and quartering seas, assisting a ship or aircraft in distress mean of unmanageabl, keeping an Office out of a sea vessel through and lessening drift; 4 the vessel manoeuvring during fishing operations, with special regards to factors which could adversely affec the vessel's safety during such operations; 5 precaution in manoeuvring for launching rescue boats or survival craft in bad weather; 6 methods of taking on board the survivor from rescue boats or survival craft;. 7 where applicable the practical measure to be taken, when navigating in ice, iceberg or condition of ice accretion on board the vessel; the use of 8, and manoeuvring in traffic separation schemes; 9 the importanc of navigating at reduced speed to avoid damage caused by own vessel's bow or stern wave; transferring fish at sea 10 the factory ship or other vessel; and refuelling at sea 11. 8 Fishing vessel construction and stability 8.1 General knowledge of the principal structural members of a vessel and the proper names of the various parts. 8.2 the knowledge of the theories and factor in the three regimes and stability and to preserve the measure not cessary safe three and stability. Knowledge of the provision concerning 11.5 fire-fighting equipment. 12 Emergency procedures 12.1 Precaution when beaching a vessel. 12.2 the Action to be taken prior to, and after, grounding. 12.3 the Action to be taken when the gears become the fast to the ground or other reversible. 12.4 (a) grounded vessel, Floating with and without assistance. Action to be taken following a 7.8 collision. 7.8 Temporary plugging of the leak. Ability to understand and use the IMO Standard Marine Communication phrases. 18 Medical AIDS knowledge of first aid procedures. Practical applications of medical guides and advice by radio. 19 Search and rescue Adequat knowledge of search and rescue procedures based on the Merchant Ship Search and Rescue Manual (MERSAR). 20 Prevention of pollution of the marine environment knowledge of the precaution to be observed to prevent pollution of the marine environment. It demonstrates proficiency in the Method 21 the Party shall prescrib method for the demonstration of proficiency in the relevant requirements of this appendix. Regulation 3. Mandatory minimum requirements for certification of skipper on fishing vessel of 24 metres in length and over operating in limited waters 1 Every skipper on a fishing vessel of 24 metres in length and over operating in limited waters shall, unless a they hold certificates issued in compliance with regulation 1, hold an appropriate certificate issued in compliance with at least the provision of this regulation. 2 Every candidate for certification shall: 1. satisfy the Party as to medical fitness, particularly regarding eyesigh and hearing; 2 meet the requirements for certification as an officer in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in limited or unlimited waters, and have approved seagoing service of not less than 12 months as an officer in charge of a navigational watch or the skipper on fishing vessel of less than 12 notes meters in length. However, a Party may allow the substitution of a period not exceeding six months of approved seagoing service as officer in charge of a navigational watch on ships of merchant;. 3 have passed an appropriate examination or examination for the assessment of competency to the satisfaction of the Party. Such examination or an examination shall include the material set out in the appendix to this regulation. 3 the Party, bearing in mind the effect on the safety of all ships which may be operating structures and in the same limited waters, should consider the limited waters it has defined in accordanc with the definition given in the regulation I/1 and determin any additional material that should be included in the examination or examination. 4 A candidate for examination who holds a valid certificate of competency issued in accordanc with the provision of the 1978 STCW Convention need not be re-examined in those subjects listed in the appendix which were passed at a higher or equivalent level for issue of the Convention certificate. Mandatory minimum regulation requirements for certification of officers in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in limited waters 1 Every officer in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in limited waters shall hold a certificate issued either in compliance with regulation 2 or hold an appropriate certificate issued in compliance with at least the provision of this regulation. 2 Every candidate for certification shall: 1. be not less than 18 years of age; 2 the Party as satisfy their medical fitness, particularly regarding eyesigh and hearing; 3 have approved seagoing service of not less than two years in the deck department on a fishing vessel of not less than 12 metres in length. However, the Administration may allow the substitution of the seagoing service by (a) a period of special training not exceeding one year, provided that the period of the special training programme shall be at least equivalent in value to the period of the required seagoing service it substitute or by a period of seagoing service evidenced by an approved approved record book covered by the 1978 STCW Convention; 4 have passed an appropriate examination or examination for assessment of competency it the satisfaction of the Party. Such examination or an examination shall include the material set out in the appendix to this regulation. A candidate for examination who holds a valid certificate of competency issued in accordanc with the provision of the 1978 STCW Convention need not be re-examined in those subjects listed in the appendix which were passed at a higher or equivalent level for issue of the Convention certificate; and 5 meet the applicable requirements of regulation 6, as appropriate for performing designated radio duties in accordanc with the radio regulations. Appendix to regulation 4. Minimum knowledge required for certification of officers in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in limited water 1 the syllabi are given below is compiled for examination of a candidate for certification as officer in charge of a navigational watch on a fishing vessel of 24 metres in length and over operating in limited water. 2 Terrestrial and coastal navigation 2.1 Ability to determin the vessel's position by the use of: 1. the landmark; 2 AIDS to navigation, including lighthouse, beacon and buoy; and 3 dead reckonings, taking into account wind, tides, current and speed by propeller revolution per minute, and by the window. 2.2 Thorough knowledge of and ability to use navigational charts and publications such as sailing directions, tide tables, notices to the mariner and radio navigational warning. 3 Radar navigation 3.1 the Party shall decide or not to incorporat whethers the syllabi of below the radar in the general requirements for certification of officers in charge of a navigational watch. If the Party decided not to include the syllabi are in the general requirements, it shall ensur that the syllabi of the is taken into account for the purpose of certification of officers in charge of a navigational watch serving on a vessel fitted with radar equipment and plying within the limited water. 3.2 Demonstrates, using a radar simulator or, when not available, manoeuvring board, knowledge of the fundamentals of radar and ability in the operation and use of radar, and in the interpretation and analysis of information obtained from the equipment including the following: 1 factors regimes by performance and accuracy;. 2 setting up and maintaining displays; detection of misrepresentation of information, 3, false echoes , sea return; 4; 5 range and identification of critical bearings. echoes; 6 course and speed of other ships;. 7 time and distance of approach of the crossing closes, meeting or overtaking ships; 8 detecting course and speed changes of other ships;. 9 effect of changes in own vessel's course or speed or both; and 10 applications of the International regulations for Preventing Collision at sea, 1972. Vessel stability 12.1-12 Demonstrates ability to use stability data, stability and three tables and pre-calculated operating condition. 13 Catch handling 13.1 knowledge of safe handling and stowage of the catch and the effect of these factors on the safety of the vessel. 14 Fishing vessel construction 14.1 General knowledge of the principal structural members of a vessel. 15 Medical AIDS 15.1. Knowledge of first-aid procedures. Practical applications of medical guides and advice by radio. 16 Search and rescue knowledge of search and 16.1 rescue procedures. 17 Prevention of pollution of the marine environment 17.1 Knowledge of the precaution to be observed to prevent pollution of the marine environment. It demonstrates proficiency in the Method 18 18.1 the Party shall prescrib method for the demonstration of proficiency in the relevant requirements of this appendix. Regulation 5. Mandatory minimum requirements for certification of chief engineer officers and second engineer officers of fishing vessel powered by propulsion machinery of 750 kW propulsion change power or more 1 Every chief engineer officer and second engineer officer on a seagoing fishing vessel serving powered by main propulsion machinery of 750 kW propulsion power or more shall hold an appropriate certificate. 2 Every candidate for certification shall: 1. be not less than 18 years of age; 2 the Party as satisfy their medical fitness including hearing and eyesigh;. 3 for certification as second engineer officer, have not less than 12 months approved seagoing service in the engine-room; However, this period may be reduced to not less than 6 months if the Party requires special training which it consider to be equivalent to the approved seagoing service it replace; 4 for certification as chief engineer officer, have not less than 24 months approved seagoing service of which not less than 12 months shall be served while qualified to serve as second engineer officer;. 5 have participated in an approved practical fire-fighting course; and 6 have passed an appropriate examination for the assessment of competency to the satisfaction of the Party. Such examination shall include the material set out in the appendix to this regulation, except the that the Party may vary the requirements for examination and seagoing service for officers of fishing vessel engaged in voyages in limited waters bearing in mind the power of the propulsion machinery and the effect on the safety of all fishing vessel in which may be operating in the same waters. 3 Training to achieve the theoretical knowledge and practical cessary not experience shall take into account relevant international regulations and recommendations. 4 the level of knowledge required under the different paragraphs of the appendix may be varied according to whethers the certificate is being issued at chief engineer officer or second engineer officer level. Appendix to regulation 5. Minimum knowledge required for certification of chief engineer officers and second engineer officers of fishing vessel powered by propulsion machinery of 750 kW propulsion change power and more 1 the syllabi are given below is compiled for examination of a candidate for certification as chief engineer officer or second engineer officer of a fishing vessel is powered by propulsion machinery of 750 kW propulsion change power or more. Any such limitations shall be stated in the certificate. 3 Every candidate shall posses a sufficient theoretical knowledge to understand the elementary the basic principles involved in the following subjects: 1. combustion processes; 2 heat transmission;. 3 mechanics and hydromechanic, as appropriate: 4.4.1 marine diesel engines;. 4.2 marine steam propulsion plant;. 4.3 marine gas turbines; steering gear systems; 5.6 properties of fuel and lubricant properties of 7; materials; fire-extinguishing agents 8; 9 marine electrical equipment; 10 automation , instrumentation and control systems; 11 fishing vessel construction and stability, including damage control; 12 auxiliary systems; and 1984 on systems. 4 Every candidate shall posses a practical knowledge of adequat in at least the following subjects: 1 operation and maintenance of, as appropriate: marine diesel engine 1.1., 1.2. Marine steam propulsion plant;. 1.3 marine gas turbines; 2 operation and maintenance of auxiliary machinery systems, including steering gear systems; 3 operations, testing and maintenance of electrical and control equipment; 4 maintenance of catch handling equipment and deck machinery;. 5 detection of machinery malfunction location of faults and action to prevent damage; 6 organization of safe maintenance and repair procedures;. 7 methods of, and AIDS for fire prevention, detection, and extinction; 8 regulations to be observed regarding operational or accidental pollution of the marine environment and methods and AIDS to prevent such pollution; 9 first aid related to injuries which might be expected in machinery spaces and use of first-aid equipment; function and use 10 of life-saving appliances; 11 methods of damage control with specific reference to action to be taken in the event of flooding of seawater into the engine-room; and 12 safe working practices. 5 Every candidate shall posses a knowledge of international law as embodied in international agreements and the convention as they affec the specific obligations and responsibilities of the engine Department, particularly those concerning safety and the protection of the marine environment. The exten of knowledge of national maritime legislation is left to the discretion of the Party, but shall include arrangements for implementing international agreements and the convention. 6 Every candidate shall posses a knowledge of personnel management, organization and training aboard the fishing vessel. Regulation 6. minimum requirements for Mandatory certification of personnels in charge of or performing duties on board the fishing vessel the radiocommunications in the Explanatory note relating to the Mandatory provision to radio watchkeeping are set forth in the radio regulations and the 1993 Torremolinos Protocol. Provision for radio maintenance are set forth in the 1993 Torremolinos Protocol and the guidelines adopted by the UROrganization.* * reference is made to the Recommendations on the radio maintenance guidelines for the global maritime distress and safety system related to sea area A3 and A4 adopted by the Organization by resolution a. 702 (17). Application 1 Except as provided in paragraph 2, the provision of this regulation shall apply to personnel in charge of, or performing duties on a vessel, the radiocommunications required by international agreement or a national law to carry radio equipment using the frequenc and techniques of the Global maritime distress and Safety System (GMDSS). 2 Personnel on the vessel for which carriage of radio equipment is not compulsory under international agreements or national law are not required to meet the provision of this regulation, but is not required by the vertheles to comply with the radio regulations. The Administration shall ensur that the appropriate certificates meeting the requirements of the radio regulations are issued or recognised in respect of such personnel. Minimum requirements for certification of GMDSS radio personnel 1 Every person in charge of, or performing duties on a vessel, the radiocommunications shall hold an appropriate certificate or certificates issued or recognised by the Administration under the provision of the radio regulations. 2 the minimum knowledge, understanding and proficiency required for certification under this regulation shall be sufficient for personnel to carry out the radio their duties safely and efficiently the radio. 3 Every candidate for certification shall: 1. be not less than 18 years of age; 2 the Party as satisfy their medical fitness, particularly regarding eyesigh and hearing; and 3 meet the requirements of the appendix to this regulation. 4 Every candidate for certification shall be required to pass an examination or examination to the satisfaction of the Party. 5 For endorsement of all types of certificates issued under the provision of the radio regulations as meeting the requirements of the Convention, the required knowledge, understanding and proficiency is given in the appendix to this regulation. In determining the appropriate level of knowledge and training of the Party shall also take into account the relevant recommendations of the UROrganization.* * reference is made to the recommendations on training for radio personnel (GMDSS) adopted by the Organization by resolution a. 703 (17). Appendix to regulation 6. Minimum additional knowledge and training requirements for GMDSS radio personnel 1 In addition to satisfying the requirements for the issue of a certificate in compliance with the radio regulations, every candidate for certification shall have knowledge of: 1 provision of radio services in emergencies; 2 search and rescue the radiocommunications, including procedures in the Merchant Ship Search and Rescue Manual (MERSAR). 3 the means to prevent the transmission of false distress alerts and the procedure of their mitigat the effects of false distress alerts; ship reporting systems; 4.5 radio medical services;. 6 us of the International Code of signals and the Standard Marine Communication phrases; and preventive measure of 7 for the safety of the vessel and personnel in connection with hazard related to radio equipment, including electrical and non-ionizing radiation hazard. 7. Mandatory minimum requirements regulations to ensur the continued proficiency and updating of knowledge for skipper, officers and engineers officer 1 Every skipper or officer holding a certificate who is serving at sea or intends to return to sea after a period of, in order of their IR ashor continue to qualify for seagoing service, be required at regular intervals not exceeding five years to satisfy the Administration as to: 1 medical fitness, particularly regarding eyesigh and hearing; and 2 as skipper or seagoing service officer of at least one year during the preceding five years; or ability to perform 3 fishing vessel operational duties relating to the duties appropriate to the grade of certificate held which are considered to be at least equivalent to the seagoing service required in paragraph 1.2, or by passing an approved test: 3.1; successfully completing an approved or. 3.2 course or course appropriate, for skipper and officers who are serving on the fishing vessel, especially for re-entrant to seagoing service on these vessel; or having completed approved seagoing service 3.3 as an officer for a period of not less than three months on a fishing vessel in a supernumerary capacity immediately prior to taking up that the position for which the certificate is valid. 2 the refresher and updating courses required by this regulation shall be approved by the Administration and includes the text of recent changes in international regulations concerning the safety of life at sea and the protection of the marine environment. 3 the Administration shall ensur that the texts of recent changes in international regulations concerning the safety of life at sea and the protection of the marine environment are made available to ships under its jurisdiction. Regulation 8. Mandatory minimum requirements to ensur the continued proficiency and updating of knowledge for GMDSS radio personnel 1 Every GMDSS radio personnel holding a certificate issued or recognised by the certificate or the Party shall, in order to continue to qualify for seagoing service, be required to satisfy the Party as to the following: 1. medical fitness, particularly regarding eyesigh and hearing , at regular intervals not exceeding five years; and 2 professional competence: approved seagoing service 2.1 by involving the radiocommunications duties of at least one year in total during the preceding five years; 2.2 by virtue of or. having performed functions relating to the duties appropriate to the grade of certificate held which are considered to be at least equivalent to the seagoing service required in paragraph 1.2.1; 2.3 by passing an approved or. test or successfully completing an approved training course or courses at sea or in which shall include ashor those elements which are of direct relevance to the safety of life at sea, and which with applicable for the certificate that the person is holding, in accordanc with the requirements of the 1993 Torreniolino Protocol. 2 When new fashion, equipment or practices with it become mandatory aboard a vessel entitled to fly the flag of a Party, that Party may require GMDSS radio personnel to pass an approved test or successfully complete an appropriate training course or courses, at sea or with particular reference ashor, their safety duties. 3 the Administration shall ensur that the texts of recent changes in international regulations relating to radiocommunications and relevant to the safety of life at sea with the available to ships entitled to fly its flag. CHAPTER III BASIC SAFETY TRAINING FOR ALL FISHING VESSEL PERSONNEL Regulations 1. Basic safety training for all fishing vessel personnel 1 Fishing vessel personnel shall, before being assigned to any shipboard duties, receive basic training approved by the Administration in the following areas: 1 personal survival techniques including donning of lifejacket and, as appropriate, the immersion suits; 2 fire prevention and fire fighting emergency procedures; 3; 4; 5 elementary first AIDS prevention of marine pollution; and prevention of shipboard accidents. 6. 2 In implementing the provision of paragraph 1, the Administration shall, if so the whethers and determin the what, these provision to exten shall apply to personnel of small fishing vessel or fishing vessel personnel already employed on. CHAPTER IV WATCHKEEPING Regulations 1. Basic principles to be observed in keeping a navigational watch on board fishing vessel 1 Administration shall direct the attention of the owner and operator of the fishing vessel, skipper and watchkeeping personnel to the following principles, which shall be observed to ensur that a safe navigational watch is maintained at all times. 2 the skipper of every fishing vessel shall ensur that watchkeeping arrangements with the adequat for maintaining a safe navigational watch. Under the skipper's general direction, the officer of the watch are responsible for navigating the fishing vessel safely during their periods of duty, when they will be particularly concerned with «avoiding collision and stranding. 3 the basic principles, including but not limited to the following, shall be taken into account on all fishing vessel. However, a Party may exclude very small fishing vessel operating in limited water from fully observing the basic principles. 4 En route to or from the fishing ground 4.1 Arrangements of the navigational watch 4.1.1 the composition of the watch shall at all times be adequat and appropriate to the conditions prevailing and circumstanc, and shall take into account the need for maintaining a proper look-out. 4.1.2 When deciding the composition of the watch the following factors, inter alia, shall be taken into account: 1 at the wheelhous of the time shall be left unattended; 2 weather conditions, visibility and whethers there is daylight or darkness; navigational hazard in proximity of 3 which may not make it for the officer in charge cessary of the watch to carry out additional navigational duties; 4 use and operational condition of navigational aids such as radar or electronic position-indicating devices and of any other equipment regimes by the safe navigation of the vessel. 5 the whethers vessel is fitted with automatic steering; and 6 any unusual demands on the navigational watch that may «arise as a result of special operational circumstanc. 4.2 the fitness for duty the watch system shall be such that the efficiency of watchkeeping personnel is not impaired by fatigu ... The intended voyage shall, as far as practicabl, be planned in advance taking into considerations all pertinen information, and any course put down shall be checked before the voyage commenc. 4.3.2 During the watch the course steered, position and speed shall be checked at sufficiently frequent intervals, using any available navigational aids, ensur cessary not that the vessel follows the planned course. 4.3.3 the officer in charge of the watch shall have full knowledge of the location and operation of all safety and navigational equipment on board the vessel, and shall be aware and take account of the operating limitations of such equipment. 4.3.4 the officer in charge of a navigational watch shall not be assigned or undertak any duties which would interfer with the safe navigation of the vessel. 4.4 4.4.1 Navigational equipment the officer in charge of the watch shall make the most effective use of all navigational equipment at their disposal. 4.4.2 When using radar, the officer in charge of the watch shall bear in mind the cessity to comply at all times with the provision on the use of radar led in the applicable regulations for preventing collision at sea. 4.4.3 In case of need the officer of the watch shall not hesitate to use the helm, engines, sound and light signalling apparatus. 4.5 Navigational duties and responsibilities 4.5.1 the officer in charge of the watch shall: 1. keep watch in the wheelhous; 2 in from of the wheelhous circumstanc leave office until properly relieved;. 3 continue to be responsible for the safe navigation of the vessel despite the presence of the skipper in the wheelhous is specifically informed that until the skipper has assumed that responsibility and this is mutually understood; 4 notify the skipper when in any doubt as to what action to take in the interest of safety; and 5 not hand over the watch to a relieving officer if there is reason to believe that the latter is not capable of carrying out the watchkeeping duties effectively, in which case the skipper shall be notified. 4.5.2 On taking over the watch, the relieving officer shall confirm and be satisfied as to the vessel's estimated or true position and confirm its intended track, course and speed, and shall note any dangers to navigation expected to be encountered during the watch. 4.5.3 Whenever practicabl a proper record shall be the skipper of the movement and activities during the watch relating to the navigation of the vessel. 4.6 Look-out 4.6.1 A proper look-out shall be maintained in compliance with rule 5 of the International regulations for Preventing Collision at sea, 1972. It shall serve the purpose of: l maintaining a continuous state of vigilanc by sight and hearing as well as by all other available means, with regards to any significant change in the operating environment; 2 fully appraising the situation and the risk of collision stranding and others the dangers, navigation; and detecting ships or 3 aircraft in distress, shipwrecked persons, wreck and Debra. 4.6.2 In determining that the composition of the navigational watch is adequat to ensur that a proper look-out can continuously be maintained, the skipper shall take the into account all relevant factors, including those described under paragraph 4.1 of this regulation, as well as the following factors: 1 visibility, status of weather and sea; traffic density, and 2 other activities occurring in the area in which the vessel is navigating;. 3 the attentions when navigating in or not without cessary to traffic separation scheme routeing and others of the measure; the additional workload 4 caused by the nature of the vessel's functions , immediate operating requirements and anticipated manoeuvr;. 5 and propeller control rudders and vessel manoeuvring characteristics;. 6 the fitness for duty of any crew members on call who may be assigned as members of the watch;. 7 knowledge of and confidence in the professional competence of the vessel's officers and crew; 8 the experience of the officer of the navigational watch and the familiarity of that officer with the vessel's equipment procedure, and manoeuvring capability; 9 activities taking place on board the vessel at any particular time, and the availability of assistance to be summoned immediately to the wheelhous when the cessary; 10 not operational status of instrumentation in the wheelhous and controls, including alarm systems;. 11 the size of the vessel and the field of vision from the conning position available; 12 the configuration of the wheelhous» , to the exten to such configuration might inhibit a member of the watch from detecting by sight or hearing any external developments; and any relevant standard 13, procedures and guidelines relating to watchkeeping arrangements and fitness for duty which have been adopted by the Organization. 4.7 Protection of the marine environment the skipper and the officer in charge of the watch shall be aware of the serious effects of operational or accidental pollution of the marine environment, and shall take all possible precaution to prevent such pollution, particularly within the framework of relevant international and port regulations. 4.8 Weather conditions the officer in charge of the watch shall take the relevant measure and notify the skipper when adverse changes in weather could be affec the safety of the vessel, including conditions leading to ice accretion. 5 Navigation with pilot embarked the presence of a pilot on board does not relieve the skipper or officer in charge of the watch from their duties and obligations for the safety of the vessel. The skipper and the pilot shall exchange information regarding navigation procedures, local conditions and the vessel's characteristics. The skipper and the officer in charge of the watch shall co-operate closely with the the pilot and maintain an accurate check of the vessel's position and movement. 6 Vessel engaged in fishing or searching for fish 6.1 In addition to the principles enumerated in paragraph 4, the following factors shall be considered and properly acted upon by the officer in charge of the watch: 1 others engaged in fishing vessel and gear, their own vessel's manoeuvring characteristics, particularly its stopping distance and the diameter of the turning circle at sailing speed and with the fishing gear overboard; 2 safety of the crew on deck;. 3 adverse effects on the safety of the vessel and its crew through the reduction of stability and freeboard caused by exceptional forces resulting from fishing operations, handling and stowage, and catch the unusual sea and weather condition; 4 the proximity of offshore structures, with special regards to the safety zone; and you and others underwater wreck 5 removes the which could be hazardous for fishing gear. 6.2 When stowing the catch, shall be given the attention to the essential requirements for an adequat an adequat freeboard, stability and integrity at all times watertigh during the voyage to the landing port, taking into considerations of fuel consumption and the risk of stores, adverse weather conditions, especially in winter, and the risk of ice accretion on or above the deck in exposed areas where ice accretion is likely to occure. 7 Anchor watch the skipper shall ensur, with a view to the safety of the vessel and the crew, that a proper watch is maintained at all times from the wheelhous or deck on fishing vessel at anchor. 8 radio watchkeeping the skipper shall ensur that an adequat radio watch is maintained while the vessel is at sea, on appropriate, taking into account frequenc the requirements of the radio regulations.

Name of duly authorized official RESOLUTION 1 Training of radio operator for the global maritime distress and safety system (GMDSS) the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, and in particular regulations II/6-Mandatory minimum requirements for certification of personnels in charge of, or performing duties on board, the radiocommunications fishing vessel in By RECOGNIZING the importanc of efficient radio watchkeeping and radio maintenance for the safety of life and property at sea and the protection of the marine environment, BEARING IN MIND the requirements of the global maritime distress and safety system (GMDSS) prescribed by the radio regulations and the Torremolinos Protocol of 1993 relating to the Torremolinos International Convention for the Safety of Fishing Vessel in , 1977 (the 1993 Torremolinos Protocol), NOTING that for merchant ships the GMDSS will be implemented by 1 February 1999, NOTING also that, if the Torremolinos Protocol enter into force on 1 February 1999, or before every fishing vessel to which chapter IX of the Protocol applies will, in accordanc with regulation 1 of that chapter, have to comply with all applicable requirements , and this for the GMDSS will be fully implemented, NOTING FURTHER that regulation 15, chapter IX of the 1993 Torremolinos Protocol requires that every vessel to which the Protocol applies shall carry personnel qualified for distress and safety radiocommunications purpose to the satisfaction of the Administration, RECALLING that resolution 8 of the International Conference on Safety of Fishing Vessel, 1993:-Parties urged to the 1993 Torremolinos Protocol implementations that it the GMDSS requirements in respect of existing fishing vessel not later than 1 February 1999, without awaiting the entry into force of the 1993 Torremolinos Protocol; and-invited the International Maritime Organization, in consultation or association with others United Nations specialized agencies and intergovernmental organizations concerned, as appropriate, to the undertak cessary not steps to implementations that the GMDSS requirements in respect of existing fishing vessel as recommended above, FURTHER NOTING that the GMDSS will also provide the means for conducting distress and safety communications for most other fishing vessel to which the 1993 Torremolinos Protocol does not apply , and the need for persons on board such vessel is also to be trained and certificated in accordanc with the radio regulations and the 1995 STCW-F Convention, RECOGNIZING also that this does not cessitat the training and certification of a number of existing considerabl skipper, officer in charge of a navigational watch and others of the radiocommunications personnel to undertak GMDSS radio operator on board a fishing vessel of a function prior to 1 February 1999 , BEING OF the OPINION that, if such training and certification is delayed, there might be a shortage of GMDSS radio operator world-wide when the GMDSS is fully implemented, the Governments are URG it STRONGLY take the measure of it: 1 implementations that the provision of the 1995 STCW-F Convention concerning the training and certification of fishing vessel radio personnel, without awaiting the Convention's entry into force; 2 ensur that fishing vessel personnel responsible for the operation of GMDSS radio equipment with a properly trained and certificated , as appropriate;. 3 (a) to ensur that sufficient number of persons taking responsibility for distress and safety communications on their fishing vessel with a trained and certificated as GMDSS radio operator prior to 1 February 1999; and 4 bring this matter to the attention of the fishing vessel owner and fishing vessel personnel and of all others who may need to use, or whose vessel may need to use, GMDSS services for transmitting or receiving distress and safety communications.
RESOLUTION 2 Radar simulator training at the Conference, RECOGNIZING the vital importanc of adequat-radar training with regards to the safety of life and property at sea and the protection of the environment, CONSIDERING that some methods of instruction in the use of radar do not achieve the desired level of proficiency of skipper and officer in charge of a navigational watch , NOTING that the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel, 1995, requires such officers it posses an adequat level of proficiency in fishing vessel operations under all conditions of service, RESOLVE to recommend 1 that the radar simulator training be given to all skipper and officers in charge of a navigational watch; 2. Invites the International Maritime Organization to communicate this resolution to all Governments for the invited to the Conference; 3. CALL upon all Governments concerned to take a due account of this resolution as a matter of urgency.
RESOLUTION 3 of the guidelines and recommendations for fishing vessel personnel the Conference, RECOGNIZING the importanc of safe and efficient operational practices and procedures to the safety of life at sea and the protection of the marine environment in general, and to the safety of fishing vessel in particular, NOTING that the Seafarer Training, Certification and Watchkeeping ' (STCW) code adopted by the 1995 Conference of parties to the International Convention on standards of Training Certification and Watchkeeping for Seafarer, in 1978, contains recommended guidance for seafarer, including:-the use of a simulator, of radio operator-training-proficiency in survival craft, and rescue boats, emergency, occupational safety, medical-care and safety functions,-, and-prevention of watchkeeping fatigu, NOTING also the document for guidance on Training and Certification, no to tunnel rivers ' s which Apple it personnel on fishing vessel of 12 metres in length and above , Invites the Maritime Safety Committee of the International Maritime Organization to: 1 review the above recommended guidance, and to prepare guidelines and recommendations specifically addressed to personnel on fishing vessel; 2 review the requirements and recommendations on the prevention of, and the fatigu prepare guidelines for the prevention of fishing vessel personnel of fatigu; and 3 review, in co-operation with the International Labour Organization and the Food and Agriculture Organization of the United Nations, the document for guidance, and to prepare guidelines and recommendations for the training and certification of personnel on board fishing vessel of 12 metres in length and over but less than 24 metres.
RESOLUTION 4 Training of deck-hand on board a fishing vessel of 24 metres in length and over the Conference, BEING AWARE of the possible danger to the deck-hand on board the fishing vessel, RECOGNIZING the urgency of importanc and establishing requirements for deck-hand on board the fishing vessel, RECOGNIZING FURTHER that the arrangements for suitabl ' pre-sea "training are not widely available for the training of deck-hand on board the fishing vessel in 1. Adopts the Recommendations on training of deck-hands working on board a fishing vessel of 24 metres in length and over, the text of which is set out in the annex to the present resolution; 2. the Governments concerned are URG is to give effect to the contents of the said Recommendations as soon as practicabl, preferably by establishing a "pre-sea training course" for fishing vessel personnel or, if impractical to do so, by other means, i.e. any other. on-board instructions; 3. Invites the International Maritime Organization: 1 it keep this under review and recommendations to bring any future amendments to it the attentions of theret all Governments is concerned; and 2 to communicate. this resolution to all Governments for the invited to the Conference. ANNEX Recommendations on training of deck-hands working on a fishing vessel of 24 metres in length and over 1 Deck-hand means a member of the vessel's crew other than the skipper or an officer. 2 In addition to the basic training requirement in chapter III of the Convention, the deck-hand should: be familiar with 1 marine terms commonly used in the orders and the fishing vessel; and 2 be familiar with the dangers associated with fishing operations such as shooting the fishing gear into the water, hauling the fishing gear and landing the catch on board. 3 Deck-hands should have: an understanding of dangers 1 caused by the vessel's motion and acceleration; 2 an understanding of dangers caused by slippery surface on board;. 3 an understanding of good one-board conduct, particularly to minimize fire hazard; and 4 knowledge of the use of personal protection equipment. 4 Deck-hand should be familiar with the construction, application and purpose of each piece of deck equipment associated with a particular type of fishing gear. Such deck equipment includes, but should not be limited to: 1 trawl gallow; gantr; 2.3; 4 bollard power blocks;. 5 blocks; 6 pursing winch and boom; 7; 8 tdrum not derrick and side rollers; and 9 line and trap haulers. 5 As far as the stability and the associated seaworthines of vessel is concerned, the deck-hand should have: 1 a general understanding of the integrity of watertigh and weathertigh common types of fishing vessel; .2 the an understanding of the operation of closing devices for doors and other opening is relevant to the watertigh and weathertigh integrity of the fishing vessel; 3 knowledge of stowage of the catch , fishing gear; and 4 knowledge of the function of freeing ports. 6 Deck-hands should also have: 1 knowledge of the handling and maintenance of deck appliances and equipment such as winch, derrick, boom, Stoppers, chains, wire ropes and ropes; 2 knowledge of making splices and eye splices in the wire ropes and ropes;. 3 general knowledge of the operations and the handling of moorings of moorings ropes, including Springs, bow, stern and breast ropes; and 4 knowledge of helm orders, commands for moorings, anchoring and towing.
RESOLUTION 5 Training of fishing vessel personnel in personal survival techniques the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, NOTING that chapter III (Basic safety training for all fishing vessel personnel), inter alia, a provision requiring Administration contains to approve a basic training in personal survival techniques, NOTING also the provision of led in the FAO/ILO/IMO document for guidance on Training and Certification's no to tunnel rivers , NOTING FURTHER that regulation VIII/4 of the 1993 Torremolinos Protocol contains a provision requiring training in emergency procedures, adopts the guidance led in the annex to the present resolution, invites all Governments to be guided by the contents of the annex to the present resolution when approving basic safety training in personal survival techniques. ANNEX guidance for the training of fishing vessel personnel in personal survival techniques 1 All prospective personnel on a fishing vessel should be instructed in the following: 1 type of emergencies which may occure, such as collision, fire and foundering;. 2 types of life-saving appliances normally carried on fishing vessel; 3 need to adher to the principles of survival; the value of 4 training and drill; 5 need to be ready for any emergency and to be constantly aware of : 5.1 the information in the muster list, in particular: 1 their specific duties in any emergency; 2 their own survival craft station; and 3 the signals calling all crew to their survival craft or fire station in the location of their own; 5.2 and 5.3 spare lifejacket; location of fire alarm control; mean 5.4 of escape the consequences of panic; 5.5; 6 action to be taken when called the survival craft stations, including: putting on the 6.1 suitabl clothing; lifejacke; donning a 6.2. and as appropriate, the immersion suit;. 6.3 additional protection such as collecting blanket, time permitting; 7 action to be taken when required to a fishing vessel abandonment, such as: how to board survival craft 7.1. from fishing vessel and water; 7.2 how to jump and. into the sea from a height and reduce the risk of injury when entering the water. 7.3 action to be taken under the rescue operations by a helicopter; 8 action to be taken when in the water, such as: 8.1 how surviv in circumstanc of: 1 fire or oil on the water;. 2 cold condition; and the shark-infested waters 3.8.2 how to right a capsized liferaf; 9 actions to be taken when aboard a survival craft, such as: getting the survival craft 9.1 quickly clear of the fishing vessel and fishing gear. 9.2 protection against cold or extreme heat; 9.3 using a drugs or sea-anchor; keeping a look-out 9.4.;. recovering and caring for survivor 9.5. facilitating detection by others; 9.6.9.7 checking equipment available for use in the survival craft and using it correctly;. 9.8 remaining, so far as possible, in the vicinity of 10 change dangers; the survivor and the general principles of survival, including: precaution to be taken in 10.1 cold climate; 10.2 precaution to be taken. in a tropical climate, exposure to sun, 10.3. wind, rain and sea; of the importanc 10.4 suitabl wearing clothing; protective measure in 10.5. survival craft;. effects of immersion in water 10.6 and 10.7 of the importanc hypothermi;. of self-cleaning body fluid. protection against seasicknes; 10.8. proper use of fresh 10.9 water and food;. effects of drinking seawater; 10.10.10.11 means available for facilitating detection by others; and the importanc of 10.12. maintaining morale. 2 All the prospective personnel on fishing vessel should be given practical instruction in at least the following: (a) the lifejacke or wearing 1 immersion suit or both correctly;. 2 the water from entering a height wearing a lifejacke or immersion suit or both;. 3 swimming while wearing a lifejacke or immersion suit or both; 4 keeping you without a lifejacke aflo or immersion suit;. 5 boarding a fishing vessel and liferaft from water while wearing a lifejacke or immersion suit or both;. assisting others to 6 board survival craft;. 7 operation of survival craft equipment, including basic operations of portable radio equipment; and 8 drugs or a set of streaming-anchor.
RESOLUTION 6 Training and certification of personnel on board large fishing vessel in the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, NOTING that the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F) is promoting safety of life and property at sea and the protection of the marine environment by establishing international standards of training , certification and watchkeeping for personnel serving on board a fishing vessel, NOTING also that the size of the fishing vessel, with respect to their length or propulsion power, is increasing and that vessel of large size could, in terms of their construction and equipment, be compared with the merchant ship, RECOGNIZING the importanc of training of personnel of large vessel to further promote safety of life and property at sea and the protection of the marine environment 1. Invites the Maritime Safety Committee of the International Maritime Organization to develop guidance on standards of training, certification and watchkeeping for fishing vessel personnel serving on board large fishing vessel as soon as possible, taking into account the provision of the International Convention on standards of Training, Certification and Watchkeeping, 1978, as for Seafarer amended; 2. Invites all Governments to give special considerations to such guidance in setting standards of training, certification and watchkeeping of personnel on large fishing vessel.
RESOLUTION 7 requirements for officers in charge of an engineering watch and watchkeeping provision in the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, NOTING that the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F) does not contain any requirements for officers in charge of an engineering watch and watchkeeping provision in , Invites the Maritime Safety Committee of the International Maritime Organization to develop, as appropriate, for possible inclusion in the 1995 STCW-F Convention, requirements for officers in charge of an engineering watch and watchkeeping provision.
RESOLUTION 8 of the Promotion of the participation of women in the fishing industry, the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, NOTING the plans of the International Maritime Organization (IMO) for the integration of women in the maritime sector and expressing support for the Organization's aim to promote the training of women in the maritime sector To achieve equal access (MENU RNGTON LINE4), for men and women in their maritime training and to employment on board fishing vessel, invites all Governments to: 1 give special considerations to the equal access of men and women to the fishing industry; and 2 highlight the role of women in the fishing industry and to promote their greater participation in maritime training and at all levels in the fishing industry.
RESOLUTION 9 Human relationship in the Conference, HAVING ADOPTED the International Convention on standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F), 1995, RECOGNIZING that not only the safe operation of the fishing vessel and its equipment, but also that the good relationship between the human personnel on board would greatly enhance the safety of life at sea, NOTING that the 1978 STCW Convention , as amended, contains a provision relating to knowledge of personnel management, organization and training aboard for the certification of supervisory personnel, all Governments it invites: 1 recognize the importanc of personnel management, organization and training on board in the syllabi for officers on fishing vessel; 2 establish, or encourag the establishment of training programmes aimed at safeguarding, of good human relationships on board the fishing vessel. 3 take the measure of their adequat minimize any element of loneliness and isolation among the personnel on fishing vessel; and 4 ensur that personnel on fishing vessel with a sufficiently rested before commencing their duties.

the 1995 International Convention on fishing vessels, staff training and certification, and Watchkeeping standards of this Convention, the Member States shall, pursuant to the 1978 International Convention on standards of training, certification and Watchkeeping for seafarers and Watchkeeping (hereinafter referred to as "the 1978 STCW Convention '), desirous of a joint agreement on international carriage on board fishing vessels at the employed staff training, certification, and Watchkeeping standards increase the human life and property at sea and to promote the protection of the marine environment Given that this destination is best able to achieve, with the international conventions on fishing vessels, staff training and certification, and Watchkeeping standards (hereinafter referred to as "the Convention"), have agreed as follows: article 1 General obligations 1. Member States shall undertake to implement the provisions of the Convention and its annexes, which are an integral part of this Convention, the requirements. Any reference to the Convention constitutes at the same time means a reference to its annexes. 2. Member States shall undertake to enact all laws, decisions, orders and regulations and to take all other measures which would be needed for full and final Convention implementation to ensure fishing vessels appropriate qualifications of personnel and compliance with their obligations of human life and property safety at sea, as well as the protection of the marine environment. Article 2 definitions for the purposes of this Convention, unless expressly provided otherwise: 1. "Member State" means a State in which the Convention has entered into force; 2. "Administration" means the Member State whose flag the ship is entitled to fly, the Government; 3. "certificate" means a valid document that can also be a different name, and issued or approved in accordance with the provisions of this Convention and shall authorise the holder to work, as provided for in this document or as required by national regulations; 4. the "certified" means to be lawful the certificate holder; 5. "organization" means the International Maritime Organization (IMO); 6. "Secretary-General" means the Secretary-General of the organisation; 7. "fishing vessel" or "vessel" means a vessel that is commercially exploited fish or other living resources of the sea for fishing. 8. "fishing vessel" means a fishing vessel other than those who can only ship in inland waters or in waters within, or immediately adjacent to them in waters protected waters or proper, where port regulations apply. Article 3 application of the Convention relating to staff serving on flag of sea fishing vessels. Article 4 provision of information each Member State shall provide the Secretary-General the following information: 1. a report on all the measures taken to implement fully the provisions of the Convention, including under the Convention issued certificates; and other information as may be specified in the rules or I/5.5 other contracts and interpretation 1. All previous treaties, conventions and agreements between the Member States in respect of the fishing vessel, staff training, certification and Watchkeeping standards remain in force in full throughout their period of activity provided for in respect of: 1. the fishing vessel's staff members, of which this Convention does not apply; 2. fishing vessel and staff members, of which this Convention applies, but only to the matters governed by the Convention. 2. However, where such agreement, Convention or arrangement is contrary to the provisions of the Convention, Member States shall review their of these treaties, conventions and agreements, the obligations to prevent conflict between these commitments and obligations arising from the Convention. 3. for All matters not specifically provided for by the Convention, remains with the Member States legislative competence. Article 6 certification of fishing vessel personnel are certified according to the annex to this Convention. Article 7 of the national rules 1. Each Member State shall establish the agenda and procedures for the impartial investigation of any report of the certificate or approval issued by the owner of lack of competence, actions or omissions that can directly threaten life or property at sea, or pose a threat to the marine environment due to the duties set out in the certificate of the appropriate competence, and to prevent the above irregularities and forgery of certificates, order and procedures the following certificate suspension and cancellation. 2. each Member State shall determine the penalties or disciplinary measures in cases of non-compliance with requirements under the Convention to the existing national provisions in respect of its flag vessels or fishing vessel personnel, which are duly certified in that State. 3. Such penalties or disciplinary measures shall be determined and applied in particular in the following cases: 1. the owner, owner's agent or the master is accepted by a person not holding a certificate appropriate to the Convention; 2. the master is allowed to perform any duties or work in any capacity, in accordance with these rules must be made to the person with the appropriate certificate to meet the person who does not have the appropriate certificate or exemption; 3. the person who documents acquired by fraud or falsified, assumed an obligation or work in any capacity, which under these regulations may perform or take the person to whom a certificate or exemption. 4. a Member State which has jurisdiction over any owner, owner's agent or any person for whom there are clear grounds for believing that they are responsible, or they are aware of this article in the Convention, ensure liaison with any Member State, it shall notify its intention to initiate proceedings within its jurisdiction. Article 8 control 1. fishing vessels, while in another Member State, is subject to these legally authorised officials of the Member State, to verify that all persons working on board, in accordance with the requirements of the Convention must be duly certified, have the following certificates or exemptions. 2. If control in accordance with part 3 of annex I/4, these discrepancies are not resolved, and have found that they can pose a threat to persons, property or the environment, the Member State carrying out the control, ensure that such vessel does not leave the port until it is fully comply with requirements to prevent this threat. The actions are immediately reported to the Secretary-General and the administration. 3. the control: 1. is doing everything possible to ship would not be unduly delayed or put on hold. If the ship has been unduly delayed or detained, he is entitled to any compensation for damage; and 2. discretion that is given to a foreign fishing vessel personnel, shall not be less than what is given to the flag of the port State of vessel personnel. 4. This article shall apply as needed, not to other countries that are not Member States, flag vessels favourable conditions than the flag of a Member State. Article 9 of the promotion of technical cooperation in the Convention 1 in consultation and cooperation with the Organization, providing support to those countries requesting technical assistance: 1. Administrative and technical personnel training; 2. the fishing vessel personnel training in institution building; 3. the supply of training institutions facilities and equipment; 4. the development of appropriate training programmes, including practical training at sea for fishing vessels; and, 5 other fishing vessels, staff training and promotion measures, giving priority to support national, subregional or regional levels, to promote the goals and objectives of the Convention, taking into account the special needs of developing countries in this regard. 2. Organization, for its part, the proper manner promotes the above measures, if necessary, consultation or in conjunction with other international organizations, particularly the International Labour Organization and the food and Agriculture Organisation of the United Nations. Article 10 amended 1. Amendment to the Convention may be taken with one of the two procedures provided for in this article. 2. amendments after consideration within the Organization: 1. Any Member State proposed amendment submitted to the Secretary-General, who then circulated to all members of the Organization, all Member States, the International Labour Organization (ILO) Director-General of the Office and the United Nations food and Agriculture Organisation (FAO) at least 6 months before the examination; 2. Any of the above ways and distribute submitted amendment be referred to the Organization's maritime safety Committee; 3. Member States shall, regardless of whether they are members of the Organization, shall be entitled to participate in the consideration and adoption of the amendment to the maritime safety Committee; 4. amendments approved by the States of the two-thirds majority, participating and voting in the maritime safety Committee, which expanded as provided for in paragraph 3 of part 2, (hereinafter referred to as "enhanced maritime safety Committee), provided that the voting shall, not less than one-third of the Member States; 5. the Secretary-General, in accordance with point 4 of part 2 of the approved amendments transmitted to all Member States; 6. amendment of article counts taken on the date on which it is accepted by two thirds of the Member States; Annex 7 or Appendix number of adopted amendments: 7.1 after two years from the date of its adoption; 7.2. After different time or period, not shorter than one year if it is approved in time, determined by the maritime safety Committee extended to the Member States present and voting in the two-thirds majority. If the specified period of time, more than one third of the Member States shall notify the Secretary-General that they object to such an amendment, it is not considered to be accepted. 8. Member States which have adopted the article, the amendment shall enter into force six months after the date of adoption, but in each Member State that has adopted the amendment after that date, the amendment shall enter into force six months after the date of adoption in that Member State; 9. the Annex and Appendix to the amendments shall enter into force six months after the date of adoption by all the Member States except those which, in accordance with point 7 of part 2 of this amendment have argued and not withdrawn their objection within six months after the date of entry into force of the amendment. However, the Member State to the specified effective date may not be communicated to the Secretary General that it postponed the adoption of an amendment to this time period not exceeding one year from the date of its entry into force, or such longer period as may be determined by the approval of the amendment during the extended to the maritime safety Committee of the Member States present and voting in the two-thirds majority. 3. amendments shall be convened by the Conference: 1. At the request of a Member State, with no less than one third of the Member States of the Organization, the consent of the relevant consultation or shared with the Office of the International Labour Organization and the United Nations food and Agriculture Organization Director-General shall convene a Conference of the Member States, the current amendment to the Convention; 2. Any amendment adopted by such a Conference by the Member States present and voting at a two-thirds majority, shall be communicated by the Secretary-General to all Member States for adoption; 3. Unless the Conference decides otherwise, the amendment shall be considered adopted and enter into force in accordance with part 2, 6 and 8, or part 2, 7 and 9 the procedures specified in paragraph 1, and that the references in those paragraphs to the maritime safety Committee extended the meaning of the reference to the Conference. 4. Any notification of acceptance of the amendment or amendments, or the opposition of a notification in accordance with point 9 of part 2, shall be submitted in writing to the Secretary-General who shall inform the Member States of any such submission and the date of receipt. 5. the Secretary-General shall inform all States of any amendment which enters into force, as well as on the date of entry into force of the amendment. Article 11 signature, ratification, acceptance, approval and accession 1. Convention is open for signature at the headquarters of the organization from 1 January 1996 to 30 September 1996, and then it stays open to the accession procedure. States may become parties in the following manner: 1. the signature without objections in respect of ratification, acceptance or approval; 2. signing for ratification, acceptance or approval, followed by ratification, acceptance or approval; 3. when joining. 2. Ratification, acceptance, approval or accession shall be effected by depositing the relevant documents to the Secretary-General. Article 12 entry into force 1 this Convention shall enter into force 12 months after the date on which not less than 15 countries either have signed it without objections in respect of ratification, acceptance or approval, or in accordance with article 11 shall have deposited the necessary instruments of ratification, acceptance, approval or accession. 2. Countries that have submitted the Convention to deposit the instruments of ratification, acceptance, approval or accession shall, after compliance with the requirements for entry into force but before the date of entry into force, the ratification, acceptance, approval or accession shall take effect on the date of entry into force of the Convention or three months after the date of the deposit, whichever date is the latest. 3. Countries that have deposited instruments of ratification, acceptance, approval or accession after the date of entry into force of the Convention, the Convention shall enter into force three months after the date of deposit of the document. 4. After the date on which the amendment to the Convention in accordance with article 10, it is considered to be accepted, any deposited the instrument of ratification, acceptance, approval or accession of the Convention with the amendment. Article 13 denunciation 1 any Member State after five years from the date of entry into force of the Convention, a Member State may at any time denounce the Convention. 2. The denunciation shall be made by sending a written notification to the Secretary-General. 3. The denunciation shall take effect 12 months after the date on which the Secretary General has received the notification of denunciation, or after a longer period of time as may be specified in the notice. 14. Article 1 of the Convention of the deposit shall be deposited with the Secretary-General of the Organisation (hereinafter referred to as "the depositary"). 2. The depositary shall: 1. inform the Governments that are signatories to the Convention or has acceded thereto of: 1.1. each new signature or deposit of instruments of ratification, acceptance, approval or accession together with the date thereof; 1.2. Date of entry into force of the Convention; 1.3. any denunciation of the Convention together with the date of the document in which it is received and the date on which the denunciation takes effect; and 2. send all Governments which have signed the present Convention or acceded thereto, and the Convention on the right of the certified copies. 3. as soon as the Convention enters into force, the depositary shall transmit to the Secretary-General of the United Nations a certified true and correct copy thereof to registered and published in accordance with the United Nations Charter article 102. Article 15 of the Convention shall be drawn up in the language in a single copy in the Arabic, Chinese, English, French, Russian and Spanish languages; each of these texts being equally authentic. The evidence we, undersigned, your Government duly authorized, have signed the URKonvenciju.* in LONDON, one thousand nine hundred and ninety-seventh in July. * Signatures annex chapter I omitted the General rules rule 1 definitions for the purposes of this annex the following definitions shall apply: 1. the "rules" means the rules laid down in the annex to the Convention; 2. "approved" means approved by a Member State in accordance with the rules; 3. "master" shall mean the person in command of the vessel; 4. "officer" means a crew member, other than the master, and who is designated as such by national law or regulations or, in the absence of such designation, by collective agreement or custom; 5. "the guard mate" means above the nonsense whose qualifications comply with the provisions of this Convention or for the II/2 II/4; 6. "engineer officer" means an officer whose qualifications comply with the provisions of this Convention II/5; 7. "a senior engineer officer" means the chief engineer officer responsible for the mechanical propulsion and the mechanical and electrical equipment operation and maintenance; 8. "second engineer officer" shall mean the engineer officer next in rank after the senior engineer officer responsible for motor engines and the mechanical and electrical equipment operation and maintenance in the event of the incapacity of the Chief Engineer Officer; 9. "radio operator" means a person who, in accordance with the rules of procedure of the administration of radio is issued or recognised qualified certificate; 10. "radio regulations" means the radio regulations that are, or are considered to be the latest in force at any time in the International Telecommunication Convention. 11. "the 1978 STCW Convention ' means the 1978 International Convention on standards of training, certification and Watchkeeping for seafarers. 12. "the 1993 Torremolinos Protocol ' means the 1977 Torremolinos International Convention for the safety of fishing vessels of the 1993 Protocol. 13. "engine capacity" means the total of the ship's main engine to constantly assess the maximum power in kW, specified in the ship's certificate of registry or other official document. 14. the "restricted area" means the waters in the vicinity of a Member State which they defined as such by the Administration, which limits the level of security is considered adequate to allow a lower requirement for the masters of fishing vessels and the certification of qualifications of the officers than the outside defined boundaries. In determining the boundaries of the district a limited Administration to take into consideration the organization developed URnorādījumi.* 15. "unlimited area" means the waters outside the restricted area. 16. "length (L)" means length, which is 96% of the full length over waterline at draught, which is 85% of the theoretical side height, measured from the keel line, or the length from the front edge of the priekšvadņ to the axis of the steering shaft along the waterline, if that is greater. "side-height" is the vertical distance measured from the keel line to the working deck beams to the top edge of the Board. The reference to resolution 539 (13) Annex 1-watch captains and officers to 24 metres in length and longer fishing vessels, adopted by the certification organisation 2. application of the provisions of the Member State, if the Administration considers that regulations II/3, II/II/4 and 5 application of requirements in full and the requirement to use the English language is not necessary or not appropriate personnel who work on the fishing vessel with a length of less than 45 metres in length and which only uses a port in a Member State and operating in the restricted area then it may determine which of these requirements completely or partially in the Castle does not apply in respect of such staff, but the security laid down in the Convention. In this case, the administration concerned shall report to the Secretary-General in detail as to what measures it has taken in relation to such staff training and certification. 3. rules and approval certificate 1. certificates for fishing vessel personnel may be issued only if, in accordance with these rules are executed in a specific job, age, health, training, qualification and examination requirements. 2. Certificates shall be issued by Member States in accordance with part 1, approved by the Member State, attesting the issue of this certificate in the form set out in the annex in Appendix 1 or 2. 3. Certificates and approvals issued by the issuing State in the official language or languages. If the language used is not English, the text shall include a translation into that language. 4. In respect of radio operators, Member States may: 1. in accordance with rule II/6 include examinations for issue of the certificate the additional knowledge requirements in accordance with the radio regulations; 2. issue a separate certificate indicating that the holder has the additional knowledge required by the rules of the II/6.5. in accordance with rule 7 of the Administration that is recognized by the authorities of another Member State, or a certificate issued by the authority in annex 3, in the form prescribed in Appendix shall be issued an approval attesting the recognition of this certificate. 6. the approval expires as soon as the end of the approved period of validity of the certificate, or it is cancelled, suspended or revoked, the Member State which issued it, and in any event no later than five years after the date of its issue. 7. any certificate issued in accordance with the 1978 STCW Convention, which the owner can work as a senior engineer, engineer or radio operator, considered the objectives of part 1 the appropriate certificate in respect of fishing vessels. 8. in accordance with Annex 1, Appendix 2 and 3 allowed in administration may use a different format than those given in the appendices, provided that the format includes as a minimum the information required and the data provided are written with Latin letters and Arabic numerals. 4. the rules of procedure (1). in accordance with article 8 of the duly authorized officials checking limited to the following: 1. check that all fishing vessel personnel, which employed under this Convention shall be certified, is certified, or does it require exemption. The following certificates are recognised, unless reliable evidence that a certificate was obtained fraudulently, or that the person to whom a certificate is not the same as that of the original certificate has been issued; and 2 evaluation of fishing vessel personnel ability to deliver under the Convention, watchkeeping standards, if safe grounds for believing that such standards are not permanently secured, as happened the following: 2.1 ship has been involved in the collision, on the banks of the ran; or 2.2. shipping time, standing on the anchor or at berth, the ship has occurred displaying the substance, which is not allowed under the international conventions; 2.3. the ship is guided or strange or hazardous manner due to the Organization have not been complied with by the vessels routing measures adopted or safe navigation practices and procedures; or 2.4. ship the other way are operated in a way that poses a danger to persons, property or the environment. 2. If deficiencies are discovered in the context of part 1, the officer carrying out the control shall immediately inform in writing the master and the Administration to be taken the appropriate measures. This message specifies in detail the deficiencies identified and justified, due to which the Member State considers that these shortcomings pose a threat to persons, property or the environment. 3. the weaknesses, which can be regarded as posing a threat to persons, property or the environment, include the following: 1. If persons in accordance with the requirements should be for such exemption certificate or not; 2. navigational watch or engine room watch arrangements to conform to the requirements set by the administration of the ship; 3. absence in a watch of a person qualified to work with safe navigation, safety radio communications or the prevention of pollution of the essential equipment; 4. it is not possible or to ensure atpūtušo people first vigil taking flight and subsequent changing of the guard. 5. rules for the exchange of information upon request 1. the Secretary-General shall provide the Member States with any information which he passed on in accordance with article 4. 2. A Member State which is twenty-four months after the date of entry into force of the Convention in that Member State does not provide the information required under article 4, is not entitled to claim benefits under this Convention until such time as the Secretary-General has not received this information. 6. rules for the administration of certification measures 1. each Member State shall undertake to establish and maintain measures to ensure that the programs, which contain the knowledge and practical training required to meet the standards of competence are monitored regularly to ensure their effectiveness. 2. each Member State shall undertake, where possible maintain a register or registers of all rules and 3. II/1 and II/6 rules specified for certificates and approvals issued, which has expired, which is reaffirmed, declared lost, voided or canceled, as well as about exemptions and provide details of such certificates, endorsements and dispensations, when requested by other Member States. 7. the rule of recognition of certificates 1. to recognise the certificate issued by another Member State or the institution responsible, each administration in accordance with the provisions of the certificate of 3 provides confirmation that that Member State has fully adhered to the competence, as well as certificates and approval standards. 2. A certificate issued by a State other than the Member State or the institution responsible, it is not recognized. 3. Notwithstanding the provisions of part 1, rule 5 and the 3 part, the Administration may, if circumstances require, allow a person to work during a period not exceeding three months on board a ship entitled to fly its flag, as long as you have the appropriate and valid certificate issued in another Member State, although it has not been approved pursuant to the provisions of part 5 3, ensuring that the documentary evidence is available that the Administration has submitted a request for approval. 8. transitional provisions 1. Certificate of competency or work, which the Convention requires a certificate to conception, and who before the entry into force of the Convention have been issued in the Member State in accordance with the legislation of that Member State or the rules of procedure of the radio, it is recognised as valid for work in this post even after the entry into force of the Convention, the Member State concerned. 2. After the entry into force of the Convention, the Member State concerned it may continue to issue certificates of competence in accordance with its past practice of not more than five years. The objectives of the Convention recognize such certificates as valid. This transitional period such certificates shall be issued only to persons who, before the entry into force of the Convention in that State have started their sea practices in a specific specialty, covered these certificates. The administration shall ensure that all other certification candidates are examined and certified according to the requirements of the Convention. 3. the Member State shall, within two years after the entry into force of this Convention, the Member State may issue work certificates for fishing vessel personnel, which is neither the Convention nor the corresponding certificate, before the entry into force of the Convention in that Member State in accordance with national legislation issued certificates of competency, but: 1. at least three years in the last seven years prior to the entry into force of the Convention have been working in that Member State, work in which they wish to obtain the certificate; 2. have provided evidence that this work is carried out in a satisfactory manner; 3. The Member State and complies with the requirements for health, including eyesight and hearing, having regard to their age at the time of the application for a certificate. The objectives of the Convention which issued certificates to work in accordance with this paragraph, shall be deemed equivalent to the certificates of the Convention. 9. exemption provisions 1. cases of extreme necessity, if the Administration in accordance with the opinion of it will not cause danger to persons, property or the environment, it may be the person to issue exemption permits that person to a fixed period not exceeding six months, allows you to work on a certain position of the fishing vessel that is not a radio operator posts, except if the radio regulations so allow, and that person is not the position qualification document, provided that a person who has been issued an exemption permit from security point of view, is suitably qualified to hold office in accordance with the requirements of the administration. 2. any exemption permit any position to be released only to the person to whom the certificate was issued legally in one rank below position. If the lower position of the Convention does not provide for an exemption certificate, the authorization may be issued to a person whose qualification and experience from the point of view of the Administration is fully equivalent to the position, provided that such person does not have the certificate, you must undergo a specific inspection of the Administration, to prove that such exemption permits can be safely provided. In addition, the Administration will ensure that these posts as quickly as possible and take duly certified person. 3. each Member State shall as soon as possible after January 1 of each year, shall send a report to the Secretary-General with information on the total year exemption permit issued by the appropriate number for each position for which a certificate is required, including reports on the cases when such exemptions are not issued. 10. a provision equivalent to 1. Convention does not prohibit a Member State to maintain or introduce other kinds of education and training methods, including those that include marine working practices and work organisation, particularly suited for the technical development and certain types of vessels, provided that the work practices, knowledge and level of qualification relative to ship navigation and technical management of the Convention ensure at least an equivalent degree of safety at sea and efficiency for the prevention of pollution. 2. Information on the use of such methods as soon as possible to include the report in accordance with article 4. Chapter II of masters, officers and radio operators, mechanics certification rule no 1 mandatory minimum requirements for certification of masters for work on the 24 metres long, and the longest non-restricted area of working fishing vessels 1. Every master serving on a 24 meters long and longer not in a restricted area of the fishing vessel, workers need the appropriate certificate. 2. for each certificate are: 1. the applicant must meet the requirements of the Member States with regard to the health situation, particularly in see and hear; 2. to meet the officers of the guard, who works for 24 yards and the longest fishing vessels not in a restricted area, certification requirements and is approved by not less than 12 months for the deck or the captain of the Guard maritime practice to not less than 12 metres in length fishing vessels. However, a Member State may be authorised to replace it with a period of not more than six months of approved Guard's maritime practices to the restricted area of the sea working vessels that comply with the STCW Convention 1978; and 3., in accordance with national requirements is required to pass the appropriate competence assessment exam or exam. Such examination or examinations are included in the materials provided in the annex to this regulation. Exam candidates, which is valid in accordance with the STCW Convention 1978 issued certificates of competency, not pāreksamin on those topics, listed in the annex where a higher or equivalent level exams have been completed certificate in accordance with the Convention. 1. the provisions in annex the minimum knowledge requirements for the certification of masters for work on the 24 metres long, and the longest non-restricted area of fishing vessels working in 1. the training program given below is compiled for examination of candidates for certification as master of a fishing vessel for the job to 24 metres in length and no longer restricted area working fishing vessels. Bearing in mind that the captain, always including fishing operations, are entirely responsible for the ship and its crew to safety, the exam questions on these topics have been drawn up so as to check whether the applicant, in accordance with the training program is properly mastered all available information about it affecting the ship and crew safety. 2. Navigation and positioning the 2.1. planning and navigation Flights under all circumstances: 1. the existing Ocean Road detection methods; 2. confined waters; 3. where necessary, the ice conditions; 4. limited visibility conditions; 5. where necessary, traffic separation schemes (TSS); and 6 areas that affect the tides or currents. 2.2. positioning of the ship: 1. with the heavenly spheres observācij; 2. land landmark observācij, including the ability to use the coast landmarks and navigational aids such as lighthouses, buoys and bearing signāluguņ together with appropriate cards, announcements, seafarer and other expenses to result in determining the exact location of the ship; 3. According to the Member State and the requirements using modern electronic navigation equipment of vessels on the fishing vessels, paying special attention to the knowledge of their operating principles, limitations, error, erroneous information of the reasons for the determination and adjust to the methods of determining the exact location of the ship. 3. Watchkeeping duties 3.1. show in-depth knowledge of the 1972 international regulations for prevention of collisions, application and content purposes, especially those of annexes II and IV in relation to safe navigation. 3.2. Display knowledge of the basic principles to be followed in the performance of the navigation watch, as set out in chapter IV. 4. Navigation with radar assistance 4.1. Play using radar Simulator, or, if such is not available, manoeuvring Tablet knowledge on radar transactions on the basic principles and the ability to operate and use radar and interpret and analyze the information obtained from the facility, including the following: 1. the factors that affect the performance and accuracy; 2. display setup and use; 3. incorrect information presented, false echo signal, echo signal from the surface of the sea, 4. distance and bearing; 5. identification of critical near the echo; 6. other ships course and speed; 7. the nearest satuvošan in time and distance to the ships that cross the road, coming off or taken; 8. another vessel speed and rate changes; 9. my vessel course or speed, or the consequences of both changes; 10. the 1972 international regulations for prevention of collisions. The ability to use appropriate nautical publications on tides and currents. 6.6. The ability to calculate tide times and the highest and lowest water level and tidal currents to determine the direction and speed. 7. the fishing vessel's manoeuvrability and driving 7.1. Fishing vessel construction and stability 8.1. General knowledge of the main components of the ship and correct various parts names. 8.2. knowledge of theories and factors affecting trim and stability and measures necessary to maintain safe trim and stability. 8.3. To demonstrate ability to use stability data stability and trim table and the previously calculated shipping condition parameters. 8.4. Where necessary, knowledge of the free surface and the icing. 8.5. knowledge of the consequences of water on board. 8.6. knowledge of the tightness and ūdensnecaurlaidīgum integrity. 9. the processing and handling of 9.1 and gear position, and reinforcement on board. 9.2. Loading and unloading operations, with particular emphasis on the heeling moment caused by fishing gear and catch. 10. in the case of fishing vessels 10.1. "fishing vessels in operation. 10.2. The ship's auxiliary machinery. 10.3. General knowledge of marine technical terms. 11. Fire prevention and fire-fighting equipment for fire-fighting training vessel 11.1 mj. 11.2. the categories of Fire and combustion process. 11.3. the fire-fighting system. 11.4. Participation in approved fire-fighting training courses. 11.5. knowledge of the requirements for fire-fighting equipment. 12. emergency procedures 12.1. Precautions when removing the ship ashore. 12.2. the action to be taken before and after the minimisation of grounding. 12.3. the action to be taken when fishing gear snagging or other obstructions. 12.4. Grounding the ship release with and without the help of others. 12.5. actions to be taken after the collision. 12.6. Leak a temporary aizdrīvēšan. 12.7. Crew protection and security measures in cases of emergency. 12.8. the limitation of damage and rescue ship after a fire or explosion. 12.9. the abandonment of the Ship. 12.10. the use of Steering the steering equipment, steering and temporary installation use and, where necessary, temporary steering installation methods. 12.11. Human rescue of shipwrecked vessel or ship wreck. 12.12. "man overboard". 12.13. other Board or pulling cables of the same vessel. 13. Medical Services 13.1. knowledge of first aid procedures. 13.2. knowledge of procedures for receiving medical advice by radio. 13.3. the In-depth knowledge of the following costs: 1. "the international medical guide for ships", or equivalent national level publications issued; and 2 for medical expenses in the "international code of signals". 14. maritime rights 14.1. knowledge of international law of the sea, contained in international treaties and conventions to which it affects the captain's specific duties and responsibilities, in particular those relating to security and the protection of the marine environment. Special attention should be paid to the following topics: 1. the certificates and other documents that in accordance with the international conventions is on board fishing vessels, as they can be obtained and their period of validity; 2. liability in accordance with the Torremolinos Protocol of 1993; 3. liability in accordance with the 1974 International Convention for the safety of life at sea chapter V; 4. liability in accordance with the 1973 International Convention for the prevention of pollution from ships, as amended by the 1978 Protocol, annex I, and annex V; 5. Each candidate has knowledge of international regulations, which include the international treaties and conventions to which it affects the engine room team specific duties and responsibilities, particularly with regard to security and the protection of the marine environment. Minimum requirements for GMDSS radio personnel certification 1. each person who is responsible to the Board or discharging the duties of radio, is the appropriate certificate or certificates issued or recognized by the Administration in accordance with the provisions of the rules of procedure of the radio. 2. minimum of knowledge, awareness and expertise that are required for certification in accordance with this provision, it is sufficient to radio staff to safely and efficiently perform the duties of their radio communications. 3. every candidate for certification is: 1. not younger than 18 years of age; 2. the relevant Member State requirements for health, especially eyesight and hearing; 3. A Member State according to health status, particularly regarding eyesight and hearing, which tested at regular intervals not exceeding five years; and 2 professional competence: 2.1 in the previous five years a total of at least one year of approved sea practices associated with radio duties; or 2.2. based on the functions related to the category of certificate appropriate to the duties, which are considered at least as equivalent to 2.1 of part 1 in the required marine practices; 2.3. the approved test or successfully complete an approved training course or courses at sea or on shore, which includes those elements which have a direct relevance to the safety of life at sea and that, in accordance with the 1993 Torremolinos Protocol applies to the personal property of the existing certificate. 2. when a Member State flag vessels become mandatory in new techniques, equipment or practices, Member States may make the GMDSS radio personnel undergo an approved test or successfully complete an appropriate training course or courses at sea or ashore, paying special attention to security duties. 3. the administration shall ensure that the latest text of the changes of international rules concerning radio communications and due to the safety of life at sea would be available on its flag vessels. The entire chapter III fishing vessel personnel training in security matters 1. all fishing vessels, training of staff in security matters 1.
