The Saeima has adopted and the President promulgated the following laws: the International Hydrographic Organization to the Protocol of amendment to the Convention, article 1. The International Hydrographic Organization of 3 May 1967, the Convention of 14 April 2005, amendments to the Protocol (hereinafter referred to as the Protocol) with this law is adopted and approved. 2. article. Fulfilment of the obligations provided for in the Protocol are coordinated by the Ministry of transportation. 3. article. This Protocol shall enter into force on the 20th for the period specified in article and in order, and the Ministry of Foreign Affairs shall notify the newspaper "journal". 4. article. The law shall enter into force on the day following its promulgation. With the law put the Protocol in English, and its translation into Latvian language. President Vaira Vīķe-Freiberga in Riga 2007 April 4, PROTOCOL OF AMENDMENTS TO the CONVENTION ON the INTERNATIONAL HYDROGRAPHIC ORGANIZATION (April 14, 2005) article 1 1. The Heading of the preamble is amended to read as follows: "the States parties to this Convention". The following paragraph is added as the new with second, third and fourth paragraphs of the preamble: "CONSIDERING that the International Hydrographic Organization is a competent international organization, as referred to in the United Nations Convention on the Law of the sea, which line on a worldwide basis for the setting of standards for the production of hydrographic data and the provision of hydrographic services and the capacity building of national facilitat which hydrographic services;" CONSIDERING that the vision of the International Hydrographic Organization is to be the body of the worldwide hydrographic authoritativ which actively engage all of coastal and interested States to advance maritime safety and efficiency and which supports the protection and sustainable use of the marine environment; "CONSIDERING that the mission of the International Hydrographic Organization is to create a global environment in which States provide adequat and timely hydrographic data, products and services and the wides to ensur their possible use; and "article 2 article II of the Convention is amended to read as follows:" the Organization shall have a consultative and technical nature. It shall be the object of theOrganization: (a) To promote the use of hydrography for the safety of navigation and all other marine purpose and to raise global awareness of the importanc of hydrography; (b) To improve global coverage, the availability and quality of hydrographic data, information, products and services and their access to such data facilitat, information, products and services; (c) To improve global hydrographic capability, capacity, training, science and techniques; (d) To establish and enhance the development of international standard for hydrographic data, information, products, services and techniques and to achieve the greatest possible uniformity in the use of these standards; (e) To give timely guidance on authoritativ and all hydrographic matters to States and international organizations; (f) the coordination of hydrographic activities facilitat among the Member States; and (g) To enhance cooperation on hydro graphic activities among States on a regional basis. " Article 3 article III of the Convention is amended to read as follows: "the Member States of the Organization with the States parties to this Convention." Article 4 Article IV of the Convention is amended to read as follows: "the Organization shall: (a) The compris Assembly; (b) the Council; (c) the Finance Committee; (d) the Secretariat; and (e) Any subsidiary organ. " Article 5 article V of the Convention is amended to read as follows: (a) "the Assembly is the principal organ and shall have all the powers of the Organization unless otherwise regulated by the Convention or by the delegated by the Assembly the other organ. (b) the Assembly shall be composed of all Member States. (c) the Assembly shall meet in ordinary session every three years. Extraordinary sessions of the Assembly may be held at the request of a Member State or of the Council or of the Secretary-General, subject to the approval of the majority of the Member States. (d) A majority of the Member States shall constitut a quor forum for the meetings of the Assembly. (e) the functions of the Assembly shall be to: (i) to elect its Chair and Vice-Chair; (ii) it will Determin own rules of procedure and those of the Council, the Finance Committee and any subsidiary organ of the Organization; (iii) In accordanc with the General regulations, elect the Secretary-General and the Director and determin the terms and conditions of their service; (iv) Establish subsidiary organs; (v) decide the overall policy, strategy and work program of the Organization; (vi) Consider reports put it on it by the Council; (vi) Consider the observations and recommendations put to it by any Member State, the Council or the Secretary-General; (VIII) decide on any proposals put to it by any Member State, the Council or the Secretary-General; (ix) Review the expenditure, approve the accounts and the financial arrangements of determin of the Organization; (x) Approve the three-year budget of the Organization; (xi) decide on operational services; (xi) decide on any other matters within the scope of the Organization; and (XIII) To, where appropriate and without it the cessary, responsibilities Council. " Article 6 article VI of the Convention is amended to read as follows: (a) the "one-fourth of, but not less than thirty, Member States shall take the seats in the Council, the first two-thirds of whom shall take their seats on a regional basis and the remaining one-third on the basis of hydrographic interests, which shall be defined in the General regulations. (b) the principles for the composition of the Council shall be put down in the General Regulation. (c) the members of the Council shall hold office until the end of the next ordinary session of the Assembly. (d) two-thirds of the members of the Council shall constitut a quor. (e) the Council shall meet at least once a year. (f) Member States not being members of the Council may participat in Council meetings but shall not be entitled to vote. (g) the functions of the Council shall be to: (i) to elect its Chair and Vice-Chair, each of whom shall hold office until the end of the next ordinary session of the Assembly; (ii) exercise such responsibilities as may be delegated to it by the Assembly; (iii) Co-ordinat, during the inter-Assembly period, the activities of the Organization within the framework of the strategy, work programme and financial arrangements, as decided by the Assembly; (iv) report to the Assembly at each ordinary session on the work of the Organization; (v) prepare, with the support of the Secretary-General, proposals concerning the overall strategy and the work programme to be adopted by the Assembly; (vi) Consider the financial statements and budget estimate prepared by the Secretary of the-General and submit them for approval to the Assembly with comments and recommendations regarding programmatic allocation of the budget estimate; (VII) Review proposals submitted to it by the subsidiary organ and refer them To the Assembly: • for all matters requiring decision by the Assembly; • Back to the subsidiary organ if considered not cessary; or • To the Member States for adoption, through correspondenc; (VIII) Proposes to the Assembly the establishment of subsidiary organs; and (ix) Review draft agreements between the Organization and other organizations, and submit them to the Assembly for approval. " Article 7 article VII of the Convention is amended to read as follows: (a) the Finance Committee shall be open to all Member States. Each Member State shall have one vote. (b) the Finance Committee shall normally be convened in conjunction with each ordinary session of the Assembly and may meetings as appropriate additional conven. (c) the functions of the Finance Committee shall be to review the financial statements, the budget estimate and reports on administrative matters prepared by the Secretary-General and to present its observations and recommendations thereon to the Assembly. (d) the Finance Committee shall elect its Chair and Vice-Chair ". Article 8 article VIII of the Convention is amended to read as follows: (a) "the Secretariat shall compris a Secretary-General, the Director and such other personnel as the Organization may require. (b) the Secretary-General shall maintain all such records as may be not cessary for the efficient discharge of the work of the Organization and shall prepare, collect, and circulate any documentation that may be required. (c) the Secretary-General shall be the chief administrative officer of the Organization. (d) the Secretary-General shall: (i) prepare and submit to the Finance Committee and the Council for the financial statements for each year and budget estimate on a three-year basis, with the estimate for each year shown separately; and (ii) Keep Member States informed with respect to the activities of the Organization. (e) the Secretary-General shall perform such other tasks as may be assigned by the Convention, the Assembly or the Council. (f) In the performance of their duties, the Secretary-General, the Director and the personnel shall not seek or receive instructions from any Member or from any authority external Status to the Organization. They shall refrain from any action that may be incompatibl with their positions as international officials. Each Member State on its part of the undertak respect the exclusively international character of the responsibilities of the Secretary-General, the Director and the personnel and not seek to influence them in the discharge of their responsibilities. " Article 9 Article IX of the Convention is amended to read as follows: "where a decision cannot be reached by consensus, the following provision shall apply to: (a) Except as otherwise provided in this Convention, each Member State shall have one vote. (b) For the election of the Secretary-General and the Director, each Member State shall have a number of votes determined by a scale established in relations to the tonnage of their fleet. (c) Except as otherwise provided in this Convention, shall be taken by Albert a simple majority of Member States present and voting, and if the votes are tied, the Chair shall decide. (d) the Decision taken on matters related to the policy or the finances of the Organization, including amendments to the General and Financial Regulations, shall be taken by a two-thirds majority of Member States present and voting. (e) With respect to subparagraph (c) and (d) of this article and subparagraph (b) of article XXI, below, the phrase "Member States present and voting" means Members present and casting the United States affirmativ or negative vote. Member States shall abstain from voting on that be considered as not voting. (f) In the case of (a) the submission to Member States in accordanc with article VI (g) (VII), the decision shall be taken by a majority of the Member States who cast a vote, with the minimum number of votes being of affirmativ at least one-third of all Member States. " Article 10 article X of the Convention is amended to read as follows: "In the relations it matters within its scope, the Organization may cooperate with international organizations whose interests and activities are related to the purpose of the Organization." Article 11 article XI of the Convention is amended to read as follows: "the functioning of the Organization shall be set forth in detail in the General and Financial Regulations, which are annexed to this Convention but do not form an integral part thereof. In the event of any inconsistency between this Convention and the General or Financial Regulations, this Convention shall prevails. " Article 12 article XIII of the Convention is amended to read as follows: "the Organization shall have legal personality. In the territory of each of its Member States it shall enjoy, subject to agreement with the Member State concerned, such privilege and may not be a sharp immunit cessary for the exercise of its functions and the fulfilmen of its object. " Article 13 (a) (a) In article XIV of the Convention, the phrase "Member Governments" is replaced by the phrase "Member States" throughout. (b) In article XIV (b) of the Convention, the "Finance Committee" is replaced by "Assembly" throughout.   Article 14 Article XV of the Convention is amended to read as follows: "Any Member State which is two years in arrear in its contributions shall be denied all voting rights and benefits conferred on Member States by the Convention and the regulations until such time as the outstanding contributions have been paid." Article 15 article XVI of the Convention is amended to read as follows: (a) "the Government of His Serene Highnes is the Prince of Monaco shall serve as Depositary. (b) the original of the Convention shall be held by the Depositary, which shall transmit certified cop to of this Convention to all States that have signed it or acceded theret. (c) the Depositary shall: (i) Inform the Secretary-General and all Member States of the applications for accession received by it from States referred to in article XX (b); and (ii) Notify the Secretary-General and all States which have signed this Convention or acceded by the of: • Each theret new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof; • The date of entry into force of this Convention or any amendment theret; and • the deposit of any instrument of denunciation of the Convention, together with the date on which it was received and the date on which the denunciation takes effect. As soon as any amendment of this Convention will enter into force, it shall be published by the Depositary and registered with the Secretariat of the United Nations in accordanc with article 102 of the Charter of the United Nations. " Article 16 In article XVII of the Convention, the phrase "the Directing Committee" is replaced by the phrase "the Secretary-General of the Organization".  Article 17 article XX of the Convention is amended to read as follows: (a) "the Convention shall be open for the accession by any State that is a member of the United Nations. The Convention shall enter into force for such a State on the date on which it has deposited its instrument of accession with the Depositary, which shall notify the Secretary-General and all Member States. (b) A State that is not a member of the United Nations may only accede to this Convention by applying to the Depositary, and by having its application approved by two-thirds of the Member States. The Convention shall enter into force for such a State on the date on which it has deposited its instrument of accession with the Depositary, which shall notify the Secretary-General and all Member States. " Article 18 article XXI of the Convention is amended to read as follows: (a) ' Any Member State proposes amendments to the Maya this Convention. Proposal of amendments shall be transmitted by it to the Secretary-General not less than six months prior to the next session of the Assembly. (b) the Proposal shall be considered by the amendments of by the Assembly and decided upon by a majority of two-thirds of the Member States present and voting. When a proposed amendment has been approved by the Assembly, the Secretary-General of the Organization shall request the Depositary to submit it to all Member States. (c) the amendment shall enter into force for all Member States three months after notification of consent to be bound by two-thirds of the Member States have been received by the Depositary. " Article 19 article XXII of the Convention is amended to read as follows: "Upon expiration of a period of five years after its entry into force, this Convention may be denounced by any Contracting Party by giving at least one year's notice, in a notification addressed to the Depositary. The denunciation shall take effect on January 1 next following upon the expiration of the notice and shall involv the abandonmen by the State concerned of all rights and benefits of membership in the Organization. " Article 20 amendments adopted by the XIIIth and XVth Conference during the, which have not entered into force according to article XX (3) of the Convention, shall not hereafter enter into force. In ACCORDANC WITH article XX (3) of the IHO Convention, the amendments here above mentioned from article 1 to article 20 shall enter into force for all Contracting Parties three months after notification of approval by two-thirds of the Member States have been received by the Depositary.

The International Hydrographic ORGANIZATION Protocol of amendment to the Convention on 14 April 2005 article 1 preamble 1 the title is amended as follows: "This Convention", the following point 2 is added to the second, third and fourth preambular paragraph: "taking into account that, in accordance with the United Nations Convention on the law of the sea, the International Hydrographic Organization is the competent international organisation, which is based on the world experience, coordinate the hydrographic data production standards and hydrographic conditions of the services and promoting the national hydrographic services; Considering that the International Hydrographic Organization aims to be the most authoritative in the world Hydrographic Organization that actively engage all interested countries of coastal and maritime safety and efficiency, and to support the protection of the marine environment and safe use; Considering that the International Hydrographic Organization's mission is to create a global environment in which Member States shall ensure that appropriate and timely hidrogrāfisko data, products and services and ensures the widest application; and "article 2 article II of the Convention is amended as follows:" the organisation has consultative and technical nature. The Organization's aim is to: (a) to promote the use of hydrography for maritime safety and for all other shipping purposes and to promote global awareness of hydrographic importance; (b) improve global hydrographic data, information, products and services for security, availability and quality and to promote the availability of this data, information, products and services; (c) to improve the world hydrographic features, productivity, training, skill and technique; (d) create and raise the hydrographic data, information, products, services and technical development of international standards and achieve the greatest possible uniformity in these standards; (e) to provide Member States and international organisations authoritative and timely recommendations on hydrographic matters; (f) promote the coordination of hydrographic between Member States; and (g) to improve hydrographic coordination of measures between Member States at regional level. " Article 3 article III of the Convention is amended as follows: "members of the Organization are parties to the Convention". Article 4 of the Convention, article IV is amended as follows: "the Organization shall comprise: (a) the Assembly; (b) the Council; (c) the Financial Committee; (d) secretariat; and (e) any additional institution. " Article 5 article V of the Convention is amended as follows: (a) "the Assembly is the main institution that belongs to all in the Organization, the Convention provides otherwise or the Assembly has not delegated to other bodies. (b) the Assembly shall consist of all the Member States. (c) the Assembly is convened in regular session once every three years. Extraordinary session of the Assembly can be convened at the request of a member or the Council, or the Secretary-General, subject to the approval of the majority of Member States. (d) the majority of the Member States shall draw up a quorum at meetings of the Assembly. (e) the Assembly shall: (i) to elect its the Chairman and the Vice-Chairman; (ii) to determine its own procedure, the Council, the Finance Committee and any additional rules of the institutions of the Organization; (iii) in accordance with the General rules to elect the Secretary-General and directors and to determine their terms and conditions of service; (iv) create additional institutions; (v) agree on the organisation's overall policy, strategy and programme of work; (vi) to examine the reports submitted to it by the Council; (VII) to consider comments and recommendations submitted to it by the Member States, the Council or the Secretary-General; (VIII) to decide on the proposals submitted to it by the Member States, the Council or the Secretary-General; (ix) review expenditures, approve the accounts and to determine the Organization's financial conditions; (x) to confirm the Organization's three-year budget; (xi) decide on operational services; (xi) decide on any other matters within the Organization; and (XIII) If it is appropriate and necessary, delegate the responsibilities of the Council. " 6. Article VI of the Convention article amended by the following: (a) "one-quarter of the Member States, but not less than thirty, should be represented in the Council, of which two-thirds should be represented at regional level and the remaining third, hydrographic interest level as determined by the General rules. (b) the composition of the Council are set out in the General rules. (c) the members of the Council are taking their posts until the next regular session of the Assembly. (d) two thirds of the members of the Council shall draw up a quorum. (e) the Council shall meet at least once a year. (f) Member States which are not members of the Council, may participate in meetings of the Council, but they do not have voting rights. (g) the duties of the Council are: (i) to elect its Chairman and Vice-Chairman, each of whom takes his office until the next ordinary session of the Assembly. (ii) perform the duties entrusted to it by the Assembly; (iii) during the period of Starpasamblej to coordinate the activities of the Organization, of the strategy and action plan within the framework of the financial agreement, as decided by the Assembly; (iv) each during the regular session to inform the Assembly about the work of the Organization; (v) With the support of the Secretary-General to prepare proposals for the overall strategy and work programme, adopted by the Assembly; (vi) to examine the financial statements and budget projects, prepared by the Secretary-General and submit them for approval to the Assembly by adding comments and recommendations on the draft budget for the programmatic distribution; (VII) to consider proposals submitted by the additional bodies and send them to: • the Assembly, if the Assembly is necessary in this matter to the decision; • Back in addition to the institution, if it is considered necessary; or • the list to Member States for adoption (VIII) propose for addition to the institution of the Assembly; and (ix) to examine the draft agreement between the Organization and other organizations, and to submit it to the Assembly for adoption. " Article 7 article VII of the Convention is amended as follows: (a) the Finance Committee shall be open to all Member States. Each Member State shall have one vote. (b) the Finance Committee shall be convened in conjunction with each ordinary session of the Assembly, but may also hold additional meetings, if necessary. (c) the responsibilities of the Finance Committee to examine the Secretary-General prepare financial statements, budget and administrative matters and to submit their assessments and recommendations to the next Assembly. (d) the Finance Committee shall elect its own Chairman and Vice Chairman. " Article 8 of the Convention, article VIII is amended as follows: (a) "the secretariat includes the Secretary-General, directors and other staff necessary for the operation of the organization. (b) the Secretary-General should maintain such a database, which may be required for the effective work of the Organization, and must be prepared to collect and distribute any of the information requested. (c) the Secretary-General shall be the leading administrative officer of the organization. (d) the Secretary-General shall: (i) prepare and submit to the Finance Committee and the Council, annual financial reports and triennial budget projects, with a separate indication of each annual budget estimate; and (ii) to inform Member States on the activities of the organization. (e) the Secretary-General shall perform other duties as determined by the Convention, the Assembly or the Council. (f) the performance of their duties, the Secretary-General, the Director and the staff shall not be guided by Member States or any other outside organization existing authorities. They must refrain from any action incompatible with their position as international officials. Each Member State shall, for its part, committed to respecting, the Director and staff of the Secretary-General of the special international nature of responsibilities and does not affect their duties. " Article 9 Article IX of the Convention is amended as follows: "If you can not adopt decisions unanimously, the following conditions apply: (a) If the Convention does not provide otherwise, each Member State shall have one vote. (b) electing the Secretary General and the Director, each Member State has the number of votes laid down in accordance with the tonnage of the fleet. (c) If the Convention does not provide otherwise, decisions are taken by a simple majority, taking into account the Member States present and voting. Votes by a uniform process for and against the question, the Chairman shall take a final decision. (d) decisions concerning the Organization's policy and finance, including amendments to the General and financial regulations may be adopted by a two-thirds majority, taking into account the Member States present and voting. (e) in the case of this article, (c) and (d) and article XXI (b) paragraph the expression "Member States present and voting" shall mean the Member States present and voting in the affirmative or the negative. Member States that abstain from voting are considered as not voting. (f) in the case where Member States submitted in accordance with article VI (g), point (VII) the decision may be made by the Member States participating in the voting, mostly, if decided affirmatively to at least one third of the Member States. " Article 10 article X of the Convention is amended as follows: "in relation to matters of its competence the organization may cooperate with international organisations, whose interests and activities consistent with the Organization's objectives." Article 11 of the Convention article XI is amended as follows: "the activities of the Organization are set out in detail the General and financial regulations, which are annexed to this Convention, but does not constitute an integral part thereof. Any Convention and General and/or financial regulations in the case of conflict between the provisions of the Convention are applied. " Article 12 Article XIII of the Convention is amended as follows: "the Organization shall have legal personality. In the territory of each Member State, it has the advantage that the contract stipulated by that Member State, and such immunity may be necessary for the performance of its functions and objectives. " Article 13 (a) of article XIV of the Convention, (a) the text of the paragraph the words "members of the Government" are replaced by the words "Member States". (b) Article XIV of the Convention, the text of point (b) "Finance Committee" is replaced with "Assembly". Article 14 Article XV of the Convention is amended as follows: "any Member State that has not taken two years annual contribution, are denied voting rights and benefits granted by the Member States and the provisions of the Convention, to have made outstanding contributions." Article 15 article XVI of the Convention is amended as follows: (a) "His Highness Prince of Principality of Monaco is considered the Depositary Government. (b) the original of this Convention are stored at the depository, which sends out a copy of the approved in the Convention to all States which have signed or acceded to. (c) the depositary shall undertake to: (i) to inform the Secretary-General and all Member States on accession applications received from article XX (b) the States referred to in paragraph 1; and (ii) to inform the Secretary-General and all countries that have signed this Convention or acceded thereto of: • each new signature or deposit of the instrument of ratification, acceptance, approval or accession, as well as the date; • The Convention or any of its date of entry into force of the amendment; and • Any denunciation of the Convention, as well as the date on which it was received and the date on which the denunciation takes effect. As soon as it enters into force, any amendment to the Convention, the depositary shall be published and recorded in the United Nations Secretariat in accordance with the Charter of the United Nations, article 102. " Article 16 Article XVII of the Convention, the words "Steering Committee" is replaced by the words "the Secretary-General". Article 17 article XX of the Convention is amended as follows: (a) "the Convention is open to accession to any State that is a member of the United Nations. Such a State, the Convention shall enter into force on the date on which it has been presented by the Act of accession to the depositary, who will inform the Secretary-General and all Member States. (b) a country which is not a member of the United Nations may accede to this Convention only when it has applied unsuccessfully to the depositary, and two thirds of the Member States have supported the following submission. Such a State, the Convention shall enter into force on the date on which it presented the instrument of accession to the depositary, who will inform the Secretary-General and all Member States. " Article 18 article XXI of the Convention is amended as follows: (a) "any Member may propose an amendment to the Convention. Proposals for amendments should be submitted to the Secretary-General not later than six months before the next session of the Assembly. (b) examine the proposals for amendments and approved the Assembly by a two-thirds majority vote of Member States present and participating in the vote. If the proposed amendment is approved by the Assembly, the Secretary-General requests the depositary to submit it to all Member States. (c) all members shall enter into force three months after the notice is received by the depositary of the agreement of two-thirds of the Member States. " Article 19 article XXII of the Convention is amended as follows: "the end of the five-year period, from the time of its entry into force, this Convention may be denounced by any party, at least a year before submitting a notification addressed to the depositary. Denunciation shall enter into force on January 1, and it is included in all the participating countries and the suspension of benefits relating to the membership of the organization. " Article 20 amendments adopted by the XIII and XV during the Conference and which enter into force in accordance with article XXI of the Convention (c) shall not enter into force. In accordance with article XXI of the Convention sho (c) an amendment referred to in article 1, to the higher from article 20, shall enter into force for all Contracting Parties three months after the depositary has received notifications of approval from two-thirds of the Member States.
