The Saeima has adopted and the President promulgated the following laws: the law of civil procedure to make the civil procedure law of the Republic of Latvia (Saeima and the Cabinet of Ministers rapporteur, 1998, no. 23, no. 15; 2001; 2002; 2003, no. 24, 15; 2004, nr. 6, 10, 14, 20; 2005, nr. 7, 14; 2006, nr. 1, 13, 20, 24, 3. No; 2007, nr. 24; 2008, 13 no, 2, 6, 2009., no. 14; Latvian journal, 2009, no. 205; 2010, 166, 183, 206. no; 16. in 2011, no.) the following amendments: 1. Supplement article 28, second subparagraph, after the words "maintenance of" with the words "child or parent."
2. Article 43 first paragraph: Add to paragraph 3 with the words "child or parent, as well as the requirements for the establishment of paternity, if the claim is brought together with a claim for recovery of maintenance for the child";
Add to part with a 3.1 point as follows: "31) applicants for the foreign ruling on the maintenance of a child or parent recognition or recognition and enforcement;"
Add to paragraph 8, after the word "maintenance reduction" with the words "child or parent."
3. Replace article 88 in the first part of the word "law" with the words "in the law, the Republic of Latvia in binding international agreements or legislation of the European Union".
4. Supplement article 128 of the fourth part as follows: "(4) the central authority of Latvia in case of maintenance or the maintenance of the child and the establishment of paternity, in application of the Council of 18 December 2008, Regulation (EC) No 4/2009 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations (hereinafter referred to as the Council Regulation No. 4/2009), travel or transfers the application to the Court annex VII forms as an application, pursuant to article 57 of the regulation in specific properties. "
5. Make 205. the first paragraph of article 6 (1) of the following: "1) for maintenance of the child or parent."
6. Supplement article 540 with points 13 and 14 by the following: ' 13) or foreign court ruling issued by the competent authority in accordance with the statement of the Council Regulation No. 4/2009 article 20 paragraph 1 b.
14) issued by the competent authority of the foreign public statement in accordance with the provisions of Council Regulation (EC) No 4/2009 article 48. "
7. in article: 541.1 supplemented with article 4.3 part as follows: "(43) of Council Regulation (EC) No 4/2009 article 20 paragraph 1 b of the statement of award referred to in the statement by the Court at the request of the parties, the judgment or decision will become final, but in the case of a judgment or decision is enforceable immediately — immediately after the judgment or decision.";
in the fifth subparagraph, replace the words "and part" and 4.1 with numbers and words "in part" 4.1 and 4.3.
8. Replace article 551 in the third paragraph, the words "maintenance of the maintenance of children" with the words "maintenance of a child or parent."
9. Supplement article 567 of the second paragraph of paragraph 3 with the words "child or parent."
10. Add to 569. the first paragraph of article 6, paragraph 1, the words "child or parent."
11. To complement the 623. the first paragraph of article 6, paragraph 1, the words "child or parent."
12. Add to article 2.1 of the 638 part as follows: "(21) Latvian Central Authority in case of foreign court rulings on maintenance of recognition or declaration of enforceability pursuant to Council Regulation (EC) No 4/2009, submit or transmit to the Council Regulation No. 4/2009 VI form, which is considered to be an application pursuant to this Regulation No. 4/2009 article 57 properties defined in."
13. To supplement the article with 641 2.1 part as follows: "(21) Council Regulation Nr. 4/2009 in the cases provided for by the parties whose place of residence or location is not in Latvia, the first paragraph of this article, the complaint may be submitted to the next 45 days from the date of issue of a copy of the decision."
14. To supplement the article with 2.1 part 642 in the following wording: "(21) pursuant to Council Regulation No. 4/2009, adjacent to the complaint Council Regulation No. 4/2009 the time limits laid down in article 34."
15. in article 644: replace the second paragraph, the words and figures "and Council Regulation No 2201/2003" with the words and figures "of Council Regulation No 2201/2003 and Council Regulation No. 4/2009 ';
replace the third paragraph, the words and figures "and European Parliament and Council Regulation No 1896/2006" with the words and figures "European Parliament and Council Regulation No 1896/2006 and Council Regulation No. 4/2009".
16. Replace the first subparagraph of article 644.2 introductory part, the words and figures "or European Parliament and Council Regulation No 1896/2006, article 23" with the words and figures "European Parliament and Council Regulation No 1896/2006 Article 23 or Regulation No 4/2009 article 21, paragraph 3".
17. in article: 644.3 supplement article 4.1 part as follows: "(41), district (City) Court in whose area the foreign judgment enforceable, subject to the Council Regulation No. 4/2009 article 20 paragraph 1 b, the statement referred to the receipt of the application by the debtor, on the basis of that regulation, article 21, paragraph 2, of the enforcement of a judgment may be refused. ';
in the fifth subparagraph, replace the words "and in the fourth paragraph, the words" and the number "and" fourth part 4.1.
18. Replace the second paragraph of article 644.4 in paragraph 2, the words and figures "or European Parliament and Council Regulation No 861/2007, article 20 of the certificate referred to in paragraph 2, the transcript" with the words and figures "European Parliament and Council Regulation No 861/2007, article 20, paragraph 2 of the licence or of Council Regulation (EC) No 4/2009 article 20 paragraph 1 b in referred to extract".
19. To supplement the transitional provisions in paragraph 44, point 1, the words "child or parent."
The law shall enter into force on 18 June 2011.
The Saeima adopted the law on 9 June 2011.
