ECONOMIC DEVELOPMENT MINISTER Saw May 23, 2000, Legislative Decree n. 164, as amended and supplemented (hereinafter: Decree No. 164/00) and in particular: the art. 8, paragraph 7, which States that, by Decree of the Minister of industry, Commerce and crafts, now Minister of economic development, shall be established for the dispatching rules in emergency conditions and defined the obligations of national natural gas system security;

the art. 28, paragraph 2, which States that the Ministry of industry, Commerce and crafts, now the Ministry of economic development, provides safety, economy and long-term planning of the national gas system, and shall pursue these objectives through specific addresses with the purpose to safeguard the continuity and security of supply, the coordinated operation of the storage system, and to reduce the vulnerability of the national gas system;

the art. 28, paragraph 3, which States that, in the event of a crisis in the energy market or serious risk to the safety of the community, the integrity of the equipment and the use of natural gas, the Ministry of industry, Commerce and crafts, now the Ministry of economic development, it can take the necessary temporary safeguard measures. Having regard to the Legislative Decree 1 St June 2011, # 93, and in particular art. 1, subparagraph l, according to which the Minister of the economic development radiates acts of address and shall take appropriate measures to ensure security of supply for natural gas and electricity system, taking into account measures to cope with peak demand and to deal with shortfalls of one or more suppliers; Having regard to Council Regulation (EC) No 994/2010 of the European Parliament and of the Council of October 20, 2010 (hereinafter Regulation (EU) No 994/2010), concerning measures to safeguard security of natural gas supply; Having regard to the application lines issued by the Joint Research Centre praclices melhodological guidelines.for conducling EU «avsessments risk gas & Besl» of July 18, 2011 for the action plan budget and for the contingency plan pursuant to art. 8, paragraph 1, of Legislative Decree No 93/2011 cited above, in conformity with the provisions of articles 5 and 10 of the abovementioned regulation (EU) No 994/2010; Having regard to the Decree of the Minister of economic development of September 11, 2007 amending for the introduction of a methodology to reduce consumption of gas that provides for the collection of contributions from all final customers and the requirement of actual containment gas consumption by industrial customers identified; Given the results of the implementation of the measures envisaged by the Decree of September 11, 2007, subsequently supplemented by ministerial decrees December 14, 2007, October 30, 2008, December 17, 2009, December 28, 2010, December 29, 2011 and November 23, 2012 containing further provisions to reduce consumption of gas; Visto l'art. 38-bis of Decree-Law No June 22, 2012. 83, as converted by law no August 7, 2012. 134, establishing the identification of power plants required for emergency gas and its operating conditions and functioning; Having regard to the order of the Minister of industry, Commerce and handicraft of September 26, 2001 published in the official journal of the Italian Republic of October 9, 2001 # 235 with which it was inter alia established the emergency technical Committee and national natural gas system monitoring, hereinafter referred to as the Committee, in order to formulate proposals for the definition of possible emergency situations to identify emergency response instruments, to formulate proposals for a definition of the procedures and timing for the activation of these instruments, and to periodically monitor the functioning of the national system of natural gas in relation to emergency situations; Considering that, as a result of adverse weather conditions or unforeseen natural reductions of gas supply to you may encounter problems to cover natural gas; Given the need to define the role, the tasks and responsibilities of natural gas undertakings, operators and persons involved in the management of emergency situations of the natural gas system; Considered the outcomes of adverse events that occurred mainly in winter 2008/2009 2004/2005, 2005/2006, thermal cycles and 2011/2012 that have sometimes led to the use of strategic storage; Given the chance to adopt, with sequential mode to be determined according to the expected or foreseeable needs following system state analysis and its prospects, possible measures to cope with events that lead, even in prospect, a possible state of crisis of the system of natural gas; Thought of having to adopt measures to ensure, as a result of adverse events resulting from adverse weather conditions during each winter or unexpected reductions in supplies of natural gas to cover expected needs, minimizing the inconvenience resulting from the civilian customers as well as to non-household customers with consumption not exceeding 50,000 Smc/year; Hear that, at its meeting of September 21, 2012. the opinion of the Committee of emergency and monitoring of the aforementioned gas system; After hearing the natural gas companies and associations of industrial customers concerned at its meeting on November 12, 2012; After consulting the authority for electricity and gas that is expressed with note prot. 5418 of February 8, 2013; Carried out consultations with Member States concerned, through comparisons on their plans within the framework of the work of the Gas Coordination Group, set up by the European Commission under art. 12 Regulation (EU) No 994/2010, in accordance with art. 8, paragraph 2, of legislative decree June 2011, l # 93 and communicated the results to the European Commission under art. 4 of Regulation (EU) No 994/2010; Made consultation of January 24, 2013 associations of protection of households within the National Council of consumers and users in accordance with art. 4 of Regulation (EU) 994/2010;
Decrees: Art. 1 preventive action plan and contingency plan to address

adverse events for natural gas system 1. The preventive action plan, defined in accordance with art. 1 St June 2011, 8 of Legislative Decree n. 93, and in accordance with the provisions of art. 5 of Regulation (EC) No 994/2010, is approved in the text set out in annex I of this Decree. 2. It's also approved the contingency plan pursuant to art. 8 of the Legislative Decree 1 St June 2011, n. 93 and in accordance with the provisions of art. 10 of Regulation (EU) No 994/2010, hereinafter referred to as plan, to address the lack of coverage of demand of natural gas in the event of adverse events resulting from adverse weather conditions during each winter or unexpected reductions in supplies of natural gas, to annex 2, which is an integral part of this Decree. 3.
