The Home Secretary having regard to act December 23, 1980, # 930, and, in particular, article. 2, which gives the central technical services of the national fire brigade the powers inherent in the elaboration and updating of national legislation on prevention and interventions, and art. 3, concerning the airports not listed in table A annexed to the law; Visto l'art. 4 December 2, 1991 law, n. 384 laying «amendments to December 23, 1980, n. 930, establishing rules for fire fighting services at airports»; Visto l'art. 51, point e) of legislative decree October 13, 2005, # 217; Having regard to the Legislative Decree March 8, 2006, n. 139, establishing a "reorganization of the provisions concerning the functions and tasks of the national fire brigade in accordance with art. 11 July 29, 2003, law No. 229 ' and, in particular, article. 26 concerning the port and airport rescue, and art. 27 on revenue from fee-based services, and art. 35, repealing art. 1 December 23, 1980, Act No. 930 on the Division into classes of airports for the purposes of the fire service; Having regard to the Legislative Decree May 9, 2005, n. 96 laying down "Revision of the aviation part of the navigation code, in accordance with art. 2 November 9, 2004, law No. 265», as amended and in particular art. 640 navigation code which gives the national civil aviation authority (E.N.A.C.) the transposition of regulations issued by the International civil aviation organization (I.C.A.O.); Having regard to the Legislative Decree March 26, 2010, n. 59, recante "implementation of Directive 2006/123/EC on services in the internal market '; Visto l'art. 4-bis, paragraph 3, of Decree-Law No 79 June 20, 2012, introducing "urgent measures to guarantee the security of citizens, to ensure the functionality of the national fire brigade and other internal management structures, as well as on National Fund for civil service», converted, with amendments, by law no 131 August 7, 2012; Visto l'art. 1, comma 1, letter v), of the Decree of the President of the Republic May 14, 2007, # 85 and subsequent provisions of art. 12, paragraph 20, of Decree-Law No July 6, 2012. 95, converted, with amendments, by law, August 7, 2012 # 135; Having regard to the Decree of the Minister of the Interior April 2, 1981 laying down ' qualification to carry out fire service at airports not listed in table A annexed to law December 23, 1980, # 930, and minimal equipment available to the fire service in relation to the classification of the airport» published in the Gazzetta ufficiale della Repubblica italiana n. 95 of April 6, 1981; Having regard to the order of the Minister of infrastructure and transport 1 St February 2006 laying down the rules for implementing the law April 2, 1968, # 518 on the liberalisation of the use of the landing areas» published in the Gazzetta ufficiale della Repubblica italiana n. 106 of May 9, 2006; Having regard to the Decree of the Minister of the Interior October 26, 2007, # 238, bearing "a regulation establishing rules for fire safety in heliports and helidecks»; Having regard to the Decree of the Minister of the Interior June 30, 2011, bearing ' provisions to be observed when refuelling aircraft» published in the Gazzetta ufficiale della Repubblica italiana n. 169 of July 22, 2011; Having regard to the Decree of the Minister of the Interior September 23, 2011, bearing minimum personnel allocations, "establishment of means, equipment and extinguishing substances for fire fighting and rescue activities, general aviation airports and airfields" published in the Gazzetta ufficiale della Repubblica italiana no 234 of October 7, 2011; Having regard to the existing regulation issued by E.N.A.C. for the construction and operation of airports; Having regard to the existing regulation issued by E.N.A.C. for the construction and operation of heliports; Having regard to the existing regulation issued by the E.N.A.C. on the general discipline of the fire protection for general aviation airports and airfields; Taking into account the regulations issued by the. C.A.O.; Having regard to the Legislative Decree n. 206 November 9, 2007, transposing Directive 2005/36/EC of the European Parliament and of the Council of September 7, 2005 on the recognition of professional qualifications; Having regard to Council Regulation (EC) No 216/2008 of the European Parliament and of the Council of February 20, 2008 as amended, laying down common rules in the field of civil aviation and establishing a European Aviation Safety Agency, and repealing Council Directive 91/670/EEC, Regulation (EC) no 1592/2002 and Directive 2004/36/EC '; Having regard to Council Regulation (EC) no 139/February 12, 2014 2014 the Commission establishing a ' technical requirements and administrative procedures relating to airports in accordance with Regulation (EC) No 216/2008 of the European Parliament and of the Council '; Considered to have to harmonise the legislation of the Ministry of the Interior with the regulations issued by the competent authority for the construction and operation of airports, heliports and for construction and operation of the general discipline of the fire protection for general aviation airports and airfields; Deemed it necessary to update and simplify the procedures referred to in this Decree of the Minister of Interior April 2, 1981, because of the changed legal framework for the sector, technological innovations and the development of aviation; Deemed it necessary to standardize the terminology of this Decree to European Union regulations mentioned above;
Decrees: Art. 1 Definitions 1. For the purposes of these provisions, is defined as: a) fire and Rescue Service: provision of fire and rescue services and equipment provided at airports open to commercial traffic and in the heliports, hereinafter referred to as service;
b) garrison first responders fire fighting and rescue: fire protection facilities and personnel provided for general aviation airports and airfields and fire support in the helideck;
c) Airport: rescuer competent personnel from the national fire brigade to conduct its business in airports open to commercial traffic and heliports;
d) Airport an airport enabled by rescuer rescuer instructor: the national fire brigade to carry out the training of airport rescuers at airports open to commercial traffic and heliports;
e) fire officer: staff with specific requirements provided for in this Decree, which carries out its activities at airports by General Aviation, in airfields and heliports;
fire and rescue equipment f): vehicles, equipment, personal protective equipment, extinguishers and all equipment provided for rescue and fire fighting;
g) certificate of service: Government Decree attesting conformity of the service organization, personnel and equipment to the applicable legislation, hereinafter referred to as the certificate.
