The MINISTER having regard to the Treaty on the functioning of the European Union; Having regard to Directive 2001/37/EC of the European Parliament and of the Council of June 5, 2001 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products; Seen, in particular art. 9, paragraph 2 of the directive, which stipulates that the European Commission provides for the adaptation to scientific and technical progress of health warnings referred to in annex I to that directive; Having regard to the Legislative Decree June 24, 2003, n. 184, implementing Directive 2001/37/EC on the manufacture, presentation and sale of tobacco products, and in particular art. 6, paragraph 2-point b; Having regard to Directive 2012/9/EU of the European Commission of March 7, 2012 amending Annex I to Directive 2001/37/EC of the European Parliament and of the Council on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products; Visto l'art. 13, paragraph 1, of law February 4, 2005, n. 11-laying down the rules for technical upgrading of attachments-according to which it is planned to implement Community rules not applicable, amending Executive mode independently and technical characteristics of directives already transposed into national law, in matters of art. 117, second paragraph, of the Constitution, by Decree of the Minister responsible for the subject, which gives timely notice to the Presidency of the Council of Ministers-Department for Community policies; Having regard to the Decree of the Ministry of health of October 25, 2012 2012/9/EU implementing directive, published in the Official Gazette No. 274, November 23, 2012, and in particular art. 2, paragraph 1, which provides a chance for cigarettes which do not comply with the provisions of that Decree still be entered for consumption until March 28, 2014 and marketed until March 28, 2016, and on paragraph 2, which also provides for tobacco products other than cigarettes which do not comply with the provisions of the aforementioned Decree, the chance to be released for consumption until March 28, 2014 and marketed until March 28, 2016; Having regard to Directive 2014/39/EU of the European Commission of March 12, 2014 extending the terms introduced by Directive 2012/9/EU, both as regards compliance with measures introduced by it that as regards the transitional period; Given that the European Commission's Directive 39 2014//EU, pursuant to art. 2, shall enter into force on April 2, 2014; Considered it necessary to modify, consistent to that Directive 39 2014//EU, the Decree of the Minister of health of October 25, 2012 in the same terms introduced;
