The HEAD of the Civil Protection Department Viewed the art. February 24, 1992, 5 of the Law # 225; Having regard to Decree-Law of May 15, 2012, # 59, converted, with amendments, by law no July 15, 2012. 100 laying: "urgent provisions for the reorganization of civil protection"; Visto l'art. 10 of the Decree-Law of August 14, 2013, n. 93, converted, with amendments, by law No 119 October 15, 2013; Having regard to decision No 1313/2013/EU of the European Parliament and of the Council by which it was established the civil protection mechanism; Having regard to the note Neb/Pol/EU/ECHO/258 of April 25, 2015 Nepal Embassy to the European Union with which the Government of the Federal Democratic Republic of Nepal has requested the assistance of the Directorate-General for humanitarian aid and civil protection (DGECHO) of the European Commission; Given that, the Office for the coordination of Humanitarian Affairs of the United Nations (OCHA) triggered the international coordination system; Considered that the Italian Republic, in the context of the relations of international cooperation and assistance activities, participates in the mechanism to people affected by disasters of particular gravity; Having regard to the resolution of the Council of Ministers of April 28, 2015 with which it was declared, for 180 days, a State of emergency as a result of the earthquake of April 25, 2015 covering the territory of the Federal Democratic Republic of Nepal; Having regard to the order of the Head of the Civil Protection Department # 244 of April 28, 2015 containing "urgent provisions to ensure relief and civil protection assistance to the people of the Federal Democratic Republic of Nepal as a result of the earthquake that occurred on the day April 25, 2015". Having regard to the order of the Head of the Civil Protection Department # 246 of May 4, 2015 containing "urgent civil protection provisions to ensure the aid and assistance to the people of the Federal Democratic Republic of Nepal as a result of the earthquake that occurred on the day April 25, 2015". Given that the plight of the local populations and the international structures involved in relief activities and assistance are such as to require the continued use of part of the equipment deployed in the territory of the Federal Democratic Republic of Nepal on the implementation of the provisions of art. 1, paragraph 2, of that Ordinance # 244/2015; Considered, therefore, to proceed with donation to local communities of part of the equipment in question, after reconstitution of its operational capacity by the respective subjects own National civil protection service components; Recognized the need to provide for the adoption of extraordinary financial measures aimed at compensating for the exceptional effort to staff of the Department of civil protection and of the other components of the National Service of civil protection, "both on-site in the national territory, for assisting the people affected by the earthquake; Heard the Ministry of Foreign Affairs;
Features: Art. 1 Donation of equipment and goods for rescue and assistance to the people of the Federal Democratic Republic of Nepal as a result of the earthquake that occurred on day 25 September 2015 1. For the purposes mentioned in the introduction is authorized the donation for victims of the Federal Democratic Republic of Nepal by equipment and property belonging to the advanced medical post form sent pursuant to art. 1, paragraph 2, of the Ordinance of the Chief of the Civil Protection Department # 244/2015, necessary for the continuation of the activity of assistance and aid, even in derogation from art. 14 of the Decree of the President of the Republic September 4, 2002, # 254. 2. For the same purposes provided for in paragraph 1, authorized the donation for victims of the Federal Democratic Republic of Nepal, twelve tents sent on site in accordance with art. 1, paragraph 2, of the Ordinance of the Chief of the Civil Protection Department # 244/2015, necessary for the continuation of the activity of assistance and aid, even in derogation from art. 14 of the Decree of the President of the Republic September 4, 2002, # 254. 3.
