The HEAD of the CIVIL PROTECTION DEPARTMENT Viewed the art. February 24, 1992, 5 of the Law # 225; Having regard to the Decree-Law September 7, 2001, n. 343, converted, with amendments, by law November 9, 2001, # 401; Visto l'art. 4, paragraph 2, of Decree-Law May 31, 2005, n. 90, converted, with amendments, by law July 26, 2005, n. 152, which provides that interventions abroad of the Department of civil protection the provisions of art. February 24, 1992, 5 of the Law # 225; Having regard to Decree-Law of May 15, 2012, # 59, converted, with amendments, by law no July 15, 2012. 100 laying: "urgent provisions for the reorganization of civil protection"; Visto l'art. 10 of the Decree-Law of August 14, 2013, n. 93, converted, with amendments, by law No 119 October 15, 2013; Having regard to decision No 1313/2013/EU of the European Parliament and of the Council by which it was established the civil protection mechanism; Having regard to the note Neb/Pol/EU/ECHO/258 of April 25, 2015 Nepal Embassy to the European Union with which the Government of the Federal Democratic Republic of Nepal has requested the assistance of the Directorate-General for humanitarian aid and civil protection (DGECHO) of the European Commission; Given that, the Office for the coordination of Humanitarian Affairs of the United Nations (OCHA) triggered the international coordination system; Considered that the Italian Republic, in the context of the relations of international cooperation and assistance activities, participates in the mechanism to people affected by disasters of particular gravity; Having regard to the resolution of the Council of Ministers of April 28, 2015 with which it was declared, for 180 days, a State of emergency as a result of the earthquake of April 25, 2015 covering the territory of the Federal Democratic Republic of Nepal; Given that the predicted event caused a significant number and untold numbers of casualties, missing and displaced persons, the destruction of numerous villages as well, for the particular morphological conditions of the land, the isolation of many parts of the country; Considering also that the earthquake has caused a very serious socio-economic and health situation in Central and western Nepal State territory, as well as the lack of basic necessities to the affected population; Seen, therefore, the need to ensure the Italian State competition in the adoption of all civil protection initiatives through the creation of extraordinary and urgent interventions, where necessary, notwithstanding the legal system in force; Considered, therefore, the need to send human and material resources to tackle properly, and in terms of particular urgency, the calamitous situation that occurred in the affected area, including through the full and complete activation of structures and components of civil protection provided for in articles 6 and 11 of law February 24, 1992, # 225; Heard the Ministry of Foreign Affairs;
Features: Art. 1 urgent civil protection Initiatives 1. To ensure the Italian State contest, in a context of international solidarity, in the adoption of urgent civil protection initiatives aimed at tackling the grave situation created in the territory of the Federal Democratic Republic of Nepal as a result of the disaster in the introduction, the Civil Protection Department, making use of components and operating structures of the National Service of civil protection guarantees in connection with the European Commission (DGECHO), with the Office for the coordination of Humanitarian Affairs of the United Nations (OCHA) and the international organizations concerned, the intervention aims to rescue and assistance of the people of the Federal Democratic Republic of Nepal. 2. For the purposes of paragraph 1, the Civil Protection Department coordinates the dispatch of teams and Department officials and technical assessment, consisting of components and operating structures of the National Service of civil protection, as well as by volunteers from civil protection volunteer organizations listed in central list or territorial lists of regions and autonomous provinces , as well as the preparation of outreach and rescue facilities. These operational and evaluation teams will compete, including in support of the team sent by the European Commission under the civil protection mechanism, to the achievement of the first assistance according to the needs posed by appropriate coordinating structures of the European Union, by the Office for the coordination of Humanitarian Affairs of the United Nations (OCHA), and the competent authorities of the Republic concerned.
