The MINISTER of economy and finance in consultation with the Minister for infrastructure and transport having regard to law no 228 December 24, 2012 recante "Disposizioni per la formazione del bilancio annuale e pluriennale dello Stato (Legge stability 2013)"; See, in particular, article. 1, section 301, which has amended art. 16-bis of Decree-Law No 95 July 6, 2012, converted, with amendments, by law no August 7, 2012. 135, containing "urgent provisions for review of public spending with the invariance of services to citizens as well as measures to strengthen the commercial capital of the banking sector"; See paragraph 1 of the said art. 16-bis which provides that as from the year 2013 it established the National Fund for the financial assistance of the State, local public transport charges, even ordinary statute regions rail, powered by a sharing the revenue from excise duties on diesel and petrol; See the next paragraph 3 stipulating that by Decree of the President of the Council of Ministers, on a proposal of the Minister of infrastructure and transport, in consultation with the Minister of economy and finance, to be issued by agreement within the Joint Conference under art. August 28, 1997, 8 of Legislative Decree No. 281, as amended, by January 31, 2013, defines the criteria and methods by which to share and transfer to the ordinary regions from the Fund pursuant to subsection 1; Having regard to the Decree of the President of the Council of Ministers March 11, 2013, published in the official journal June 26, 2013, # 148, which provides, in particular, art. 2 the allocation of the resources of the National Fund for the financial assistance of the State, local public transport charges, even ordinary statute regions rail for 90 percent on the basis of the percentages given in table 1 annexed to the Decree of the President of the Council of Ministers; See the next paragraph 5 of art. 16-bis of Decree-Law No 95 July 6, 2012, which predicts that by Decree of the Minister of infrastructure and transport, in consultation with the Minister of economy and finance, to be issued after consulting the Joint Conference, no later than 30 June of each year, shall be allocated from the Fund pursuant to subsection 1, after completion of the checks carried out on the effects produced by rescheduling services plan prepared by the ordinary regions; See the next paragraph 6, which provides that, pending the enactment of the decree referred to in paragraph 5, by order of the Minister of economy and finance, in consultation with the Minister for infrastructure and transport, after consulting the Joint Conference, it's broken down by anticipation among the ordinary regions, 60 per cent of the appropriation of the Fund referred to in paragraph 1. The resources allocated are subject integration, balance or clearing with subsequent years following the results of the checks referred to in paragraph 3 (e)), made through monitoring tools. Its disbursement ordinary statute regions are you prepared on a monthly basis; Having regard to the Decree of the President of the Council of Ministers July 26, 2013, published in the Official Gazette August 21, 2013, # 195, which provides that the extent of sharing the revenue from excise duty on petrol, leaded gasoline and diesel, used to transport fuels, for the ordinary regions from the year 2015 is 19.4 per cent and that such measures should be applied to the annual forecast of that revenue; Considered that the allocation for the year 2015 of the Fund referred to in paragraph 1 under the chapter 1315 of the estimate of the Ministry of infrastructure and transport, based on the provisions of the Decree of the President of the Council of Ministers is currently July 26, 2013, equal to euro 4,925,252,600.00; Considering that, pursuant to art. 4 of Decree of the President of the Council of Ministers March 11, 2013, the Joint Conference, at its meeting of August 5, 2014, has sanctioned the arrangement on the table adjusting the percentages of allotment listed in table 1 of the same Decree of the President of the Council of Ministers; Considered that art. 5 of the Decree of the President of the Council of Ministers March 11, 2013 provides that the 0.025 percent of the appropriation of the Fund pursuant to subsection 1 to a total of euro 1,231,313.15 is intended for creation of the database and public information system necessary for the operation of the Observatory under art. 1, section 300 of the Act December 24, 2007, # 244; Deemed necessary quickly to the disbursement of the Fund's allocation of 60 percent anticipation pursuant to subsection 1 for the year 2015, with the terms referred to in that paragraph 6, by applying the percentages of allotment established by joint conference at its meeting of August 5, 2014; Acquired the opinion of the Joint Conference at its meeting of February 26, 2015;

Disbursement of anticipation for the year 2015 1. In implementation of the Decree of the President of the Council of Ministers March 11, 2013, under art. 16-bis, paragraph 3, of Decree-Law No 95 July 6, 2012, pending the enactment of the Decree of the Ministry of infrastructure and transport, in consultation with the Minister of economy and finance, after consulting the Joint Conference, to adopt, in accordance with art. 16-bis, paragraph 5, of the said Decree-Law July 6, 2012, n. 95, by 30 June of each year, by the year 2015 is granted to ordinary regions an anticipation of 60 percent of the National Fund for the financial assistance of the State, the charges of local public transport, rail, also referred to in paragraph 1 of that article. 16-bis, for a total amount of euro 2,954,412,772.11. 2. the Ministry of infrastructure and transport will provide delivery of anticipation pursuant to subsection 1 in an ordinary statute regions according to the amounts set out in table 1, which is an integral part of this decision.
