that despite the infection has not been extended to other farms, also by virtue of the measures immediately adopted by the Ministry of health, the high pathogenicity influenza viruses of avian origin may cause epidemics of considerable gravity with significant consequences for poultry production and possible risks to human health; View the Grant Decision SANTE/VP/2015/en/January 30, 2015 2.700815 of bearing the approval of national programmes and its financing for the year 2015 and, in particular, the funding provided for in article 3, paragraph 1, point b); Having regard to the provisions of paragraph 2, subparagraph b) of art. 26 Regulation (EU) 1169/2011 in respect of the mandatory indication of the country of origin or place of provenance for meat codes of the combined nomenclature (CN) are listed in annex XI to that regulation, including "fresh, chilled or frozen meat, of poultry of heading 0105»; Was therefore considered no longer necessary to confirm the provisions referred to in articles 3, 4 and 5 of that Ordinance August 26, 2005, and subsequent modifications, concerning the health measures pertaining the origin labelling therein; Deemed necessary also, pending the adoption at Community level of a special animal health regulation of discipline of biosecurity measures, to confirm biosecurity measures and other veterinary measures, changes introduced in August 26, 2005 Ordinance as amended, in order to reduce the risk of transmission of the influenza virus, also in view of the persistent circulation of influenza viruses of subtypes H5 and H7 low pathogenicity in poultry farms in the rural sector and industrial production chain, from 2007 to today, which affected the regions with high avian vocation; Acquired the opinion of the National Center of reference for avian influenza at the Istituto Zooprofilattico sperimentale delle Venezie; Having regard to the Ministerial Decree of July 24, 2014, delegating of responsibilities of the Minister of health for certain acts under the responsibility of the Administration to State Secretary Dr. Vito De Filippo, published in the Official Gazette August 27, 2014, # 198;
Order: Art. 1 1. The Ordinance of the Minister of health August 26, 2005, and subsequent amendments, are made to the following amendments: 3, 4 and 5) the articles shall be repealed;
b) art. 5-bis: 1) in paragraph 1, the words "in the program of surveillance of poultry and wild birds for avian influenza approved by Commission implementing decision of November 29, 2013, no 2013/722/EC approving the annual and multiannual programmes of eradication, control and monitoring of certain animal diseases and zoonoses presented by the Member States for the year 2014 and subsequent years as well as of the Union's financial contribution to these programmes ' shall be replaced by the following: "in the program of surveillance of poultry and wild birds for avian influenza, approved by Grant Decision SANTE/VP/2015/en/IT 2.700815 of January 30, 2015, bearing the approval of national programmes and its financing for the year 2015 and, in particular, the contribution provided for in article 3, paragraph 1, point b);
c) in Annex A, chapter "structural requirements of farms»: 1) in paragraph 2, point a), after the word" furniture)» are added as follows: "and placed signs prohibiting access to outsiders; the company must have an area, clearly identified, for the parking of vehicles of both the staff at the company's visitors.
