The DIRECTOR-GENERAL for road transport and intermodal ' having regard to Regulation (EU) No 181/2011 of the European Parliament and of the Council of February 16, 2011, concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004; Having regard to the Legislative Decree November 4, 2014, n. 169 laying: "rules on penalties for violations of the provisions of Regulation (EU) No 181/2011 of the European Parliament and of the Council of February 16, 2011, amending Regulation (EC) no 2006/2004, concerning the rights of passengers in bus and coach transport "; Having regard to the order of the Minister of infrastructure and transport on March 5, 2015, # 84, art. 3, paragraph 7, of the aforementioned legislative decree 169/14; See in particular art. 12 Regulation (EU) No. 181/11, which provides that Member States shall designate bus stations where it provided assistance to persons with disabilities or reduced mobility; Having regard in particular to the following articles of Legislative Decree No 169/2014: art. 1, paragraph 3, under which Regulation No. 181/2011 applies, except as provided in art. 18, paragraphs 1 and 2, to regular services whose distance is equal to or greater than 250 km, national or international, between Italy and the EU Member States or EEA or the Swiss Confederation; the art. 2, paragraph 1, letter n), which defines the bus station as the manned station where, following a precise, regular stops for boarding or disembarking passengers, equipped with facilities including the check-in counter, waiting room or ticket office; the art. 3, paragraph 7, which States that the regions and autonomous provinces of Trento and Bolzano indicate bus stations providing assistance to persons with disabilities or reduced mobility, with respect to the designation, as provided for in art. 12 of the EU regulation 181/11, by the Ministry of infrastructure and transport; Views include the following provisions of the aforementioned Decree of the Minister of infrastructure and transport # 84/2015: art. 2, paragraph 1, which stipulates that the regions and autonomous provinces should communicate to the Directorate-General for road transport and intermodal ' bus stations which they identified; the art. 2, paragraph 2, whereby, within thirty days of the notification referred to in the preceding period, by Decree of the Director of the Directorate-General for road transport and intermodal ' are designated, in accordance with art. 3, paragraph 7, of the Legislative Decree November 4, 2014, # 169, bus stations in which it provided assistance to persons with disabilities or reduced mobility; See also art. 2, paragraph 5, of the Ministerial Decree of March 5, 2015, # 84, under which bus stations with at least one of the structures under art. 1, comma 1, altough they are not provided at least 55 stops for the ascent or descent of the passengers, they have right to ask to be shown between stations that provide assistance to persons with disabilities or reduced mobility; Having regard to the communication under art. 2, paragraph 1, of the Ministerial Decree 84/2015, sent to the Directorate-General for road transport and intermodal ' from the region of Calabria, infrastructure Department-public works-mobility, transport sector-regional transport Plan-intangible networks, transport technical management Service (Prot. 95422/SIAR of 25.03.15), with which it is identified bus station called "TERMINAL" in Crotone, via g. Di vittorio # 25; Given that, according to the information contained in the communication of the region Calabria prot. # 95422/SIAR 25.03.2015, designation of the station's "TERMINAL" is congruent the criteria in conjunction with articles 1, paragraph 1, and 2, paragraph 5 of Ministerial Decree No 84/2015; Deemed it necessary to proceed, on grounds of urgency deriving from the infringement procedure no leaning on 2013/2260 Italy pursuant to art. 258 of the Treaty on the functioning of the European Union to delay the application of the Regulation (EU) 181/2011, description of that station "TERMINAL ROMANO" pending the identification of further stations by the regions and autonomous provinces;
Designate pursuant to art. 3, paragraph 7, of the Legislative Decree November 4, 2014, # 169, bus station called "TERMINAL", located in Crotone at via G. Di Vittorio, # 25. In the aforementioned station "TERMINAL ROMANO", according to art. 13, paragraph 1, of the Regulation (EU) 181/2011, carriers and the station's managing body, within their respective competencies, lend themselves for free assistance at least to the extent specified in part a) of annex I to Regulation 181/2011 to people with disabilities or reduced mobility.
