The Minister for infrastructure and transport having regard to Regulation (EU) No 181/2011 of the European Parliament and of the Council of February 16, 2011, amending Regulation (EC) No 2006/2004 concerning the rights of passengers in bus and coach transport and, in particular, article. 2, paragraph 1, which provides for the applicability to passengers travelling on scheduled services for certain categories of passengers whose place of embarkation or disembarkation is situated in the territory of a Member State and the scheduled distance is equal to or greater than 250 km.; Having regard to the Legislative Decree November 4, 2014, n. 169 laying: "rules on penalties for violations of the provisions of Regulation (EU) No 181/2011 of the European Parliament and of the Council of February 16, 2011, amending Regulation (EC) no 2006/2004, concerning the rights of passengers in bus and coach transport "; Having regard, in particular, article. 1, paragraph 3, of said Decree November 4, 2014, n. 169, under which, except as provided in art. 18, paragraphs 1 and 2, to regular services, whose scheduled distance is equal to or greater than 250 km, national or international, between Italy and the EU Member States or EEA or the Swiss Confederation, regulation and in case of breaches of the obligations hereunder, the corresponding sanctions referred to in that Decree; the art. 2) (n), which defines the bus station as the manned station where, following a precise, regular stops for boarding or disembarking passengers, equipped with facilities including the check-in counter, waiting room or ticket office; the art. 3, paragraph 7, which States that the regions and autonomous provinces of Trento and Bolzano, indicate the bus stations providing assistance to persons with disabilities or reduced mobility, with respect to the designation provided for in art. EU 181/2011 and 12 of the regulation in order to ensure uniform protection of the rights of persons with disabilities and reduced mobility, with non-regulatory decree of the Minister of infrastructure and transport, to be taken within sixty days after the entry into force of the same Decree. 169, after consulting the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano have identified the criteria and methods by which are designated such stations; Considered, therefore, the need to proceed with the enactment of the ministerial order provided for by art. 3, paragraph 7, of the Legislative Decree November 4, 2014, # 169; Having regard to article 1, paragraph 5, and 29 of the Decree of the President of the Republic July 24, 1996, # 503, "regulation laying down rules for the Elimination of architectural barriers in buildings, public spaces and services"; Considering that in March 20, 2014 date the European Commission has made it clear that it is possible that assistance in relation to some only of the forms of disabilities or mobility is guaranteed in part, talche is the absence of certain infrastructures or equipment does not prevent the designation of bus stations; After consulting the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano, at its meeting of February 19, 2015;
Decrees: Art. 1 1. In accordance with art. 3, paragraph 7, of the Legislative Decree November 4, 2014, # 169, are required to provide assistance to persons with disabilities or reduced mobility bus stations manned and equipped with at least one of the following facilities: a) check-in counter;
b) waiting room;
c) ticket office and in which they exist, which average daily in the calendar year preceding that of reference, no less than 55 stops for the ascent or descent of passengers in exercise programs of services where the route covered by from a terminus to the other is higher than 250 km. If the stations do not have infrastructure or equipment to ensure assistance in relation to all forms of disability or reduced mobility, that fact shall take place in the managerial Decree under art. 2, paragraph 2, and the management entities of the same stations provide information to passengers. 2. the criteria referred to in paragraph 1 may be updated by Decree of the Director of the Directorate-General for road transport and intermodal ', after consultation with the regions and autonomous provinces. 3. Are not considered, for the purposes of this Decree, the places, albeit manned and having passenger facilities, where it is engaged exclusively in the Park the buses used in chauffeur services.
