The Minister for infrastructure and transport having regard to Regulation (EC) no 1008/2008 of the European Parliament and of the Council of September 24, 2008 on common rules for the operation of air services in the community and in particular art. 16 and the art. 17; Having regard to the Treaty on the functioning of the European Union, and in particular articles 106, 107 and 108, paragraph 2; Having regard to the Commission communication on the application of EU State aid rules to compensation granted for the provision of services of general economic interest (OJ EU C 2012/8/02), the European Union framework for State aid in the form of public service compensation (OJEU C 2012/8/03); Visto l'art. 36 of the Act May 17, 1999, n. 144 which granted to the Minister of transport and navigation (now Minister of infrastructure and transport), the competence to dispose by Decree, the imposition of public service obligations on the slips in the same covered in accordance with the provisions of Regulation (EEC) No 2408/92, repealed and replaced by Regulation (EC) no 1008/2008; Visto l'art. 4, paragraph 206, December 24, 2003, law No. 350, that changing the art. 82, paragraph 1, of law December 27, 2002, n. 289, it extended the provisions of art. 36 of the Act May 17, 1999, n. 144, even at the airport of Reggio Calabria; Visto l'art. 4, paragraphs 206 and 207 of the Act December 24, 2003, n. 350, which included the commitment of expenditure to finance the territorial continuity of 12 airports including the airport of Reggio Calabria; Having regard to the minutes of the meeting of July 13, 2005 held at the offices of direct cooperation of the then Deputy Minister of infrastructure and transport on. Mario Tassone, whereby the commitment of expenditure above that was shared between the airports concerned, deciding to reserve the airport of Reggio Calabria the sum of 4 million; Having regard to the Ministerial Decree No 427 of December 13, 2011 with whom it was granted to the airline Alitalia-CAI S.p.A. is entitled to exercise scheduled air service on the route to Reggio Calabria-Turin and vice versa exclusively and for a term of two years on the basis of a maximum of €583,077.00 financial compensation for each of the two years of operation under the obligations imposed under Ministerial Decree No. 108 of March 23, 2011; Having regard to the note of the region Calabria n. 0179589 of May 29, 2014 which asks the Minister for infrastructure and transport the delegation to hold the Conference services for the identification of public service obligation in respect of scheduled air services between the airport of Reggio Calabria and the main national airports; View the delegation conferred with footnote 23145 of June 13, 2014 by the Minister of infrastructure and transport to the Vice President of Calabria-Dr. jazzy Sam-pursuant to art. 36, paragraph 3, of the law May 17, 1999, n. 144, to convene and chair the Conference services in order to identify the content of the imposition of a public service obligation airline connections with the airport of Reggio Calabria in accordance with and within the limits of the provisions of Regulation (EC) no 1008/2008; See Decree 114 of November 12, 2014 by which the President of the regional government conference services index to locate the content of public service obligations to be imposed on flights to and from the airport of Reggio Calabria; Having regard to the note of the region Calabria n. 358876/SIAR of November 13, 2014 that convenes the Conference of services mentioned above for the day November 20, 2014, with possible further work on November 21, 2014; Having regard to the findings of the abovementioned Services Conference, which was held in Rome at the headquarters of the region Calabria day November 20, 2014 and at the headquarters of the Ministry of infrastructure and transport-Directorate General for airports and air travel the day November 21, 2014 and which defined the parameters on which to articulate the imposition of a public service obligation flights from Reggio Calabria to Pisa and Bologna; Given the need to ensure the territorial continuity of the populations who insist in the catchment area of the airport of the Strait through adequate, regular and continuous scheduled flights between the airport of Reggio Calabria and the airports of Pisa and Bologna;
Decrees: Art. 1 Limited to the purposes pursued by this Decree, the scheduled air service on routes Reggio Calabria-Reggio Calabria-Bologna Pisa and vice versa, and vice versa, constitutes a service of general economic interest.
