The INTERMINISTERIAL COMMITTEE FOR ECONOMIC PLANNING July 8, 1986, having regard to law No. 349 laying ' institution of the Ministry of environment and rules on environmental damage '; Having regard to law no December 23, 1996. 662 laying rationalization measures in public expenditure and, in particular, article. 2, paragraph 203, b) and c) that define respectively the tools ' program ' and ' institutional agreement Agreement framework programme '; Having regard to act December 9, 1998, # 426 «New environmental measures», and in particular art. 1, paragraph 3, which provides, inter alia, the adoption by the Ministry of environment, with the agreement of the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano, after obtaining the opinion of the competent parliamentary committees, a national programme of remediation and reclamation of contaminated sites, which locates the interventions of national interest, the priorities , the beneficiaries, the funding criteria of individual interventions and methods of transferring its resources; Having regard to articles 60 and 61 of the Act December 27, 2002, n. 289 (legge finanziaria 2003) and subsequent amendments, which are set up, at the ministries of economy and finance and productive activities, funds for underused areas, coinciding with the territory of depressed areas of law # 208/1998 and the Fund established by art. 19, paragraph 5, of the Legislative Decree of April 3, 1993, # 96; Having regard to the Legislative Decree of April 3, 2006, n. 152 "environmental standards" and subsequent amendments and integrations; Having regard to the Decree-Law May 18, 2006, n. 181, converted, with amendments, by law July 17, 2006, n. 233 laying down provisions concerning the reorganization of the powers of the Presidency of the Council of Ministers and ministries, with whom it was established the Ministry of economic development; Visto l'art. May 31, 2011, 4 of Legislative Decree n. 88, with which it established the Fund for development and cohesion (FSC); Having regard to the Decree of the Ministry of environment and territory of September 18, 2001, n. 468 (Official Gazette No. 13/2002), regolamento recante: "national programme of reclamation and restoration» which identified, among others, as an additional intervention of national interest even for the site of Fidenza; Having regard to the Decree of the Ministry of environment and territory of October 16, 2002, published in Official Gazette no 286 of December 6, 2002, concerning the definition of the perimeter of priority site of Fidenza; Having regard to the order of the Minister of the environment and protection of land and sea of the November 28, 2006, n. 308 (Official Gazette No 24/2007) «Regulation on amendments to the Decree of the Ministry of environment and territory of September 18, 2001, n. 468 on the national programme for environmental remediation of contaminated sites; Having regard to the Decree of the President of the Council of Ministers of April 23, 2014 (Official Journal No 122 of May 28, 2014), with whom it was granted to the State Secretary for the Presidency of the Council of Ministers, the Secretary of the Council of Ministers, delegation to exercise the functions referred to in art. 7, paragraph 26 of the Decree-Law May 31, 2010, n. 78, converted with amendments by law July 30, 2010, n. 122, relating inter alia to the management of the Development Fund and the cohesion (FSC); Having regard to its resolution of December 11, 2012, n. 132 (Official Gazette No 73/2013) with which, in art. 7 of Decree-Law No July 6, 2012. 95, converted with amendments by law No 135, August 7, 2012 was approved the allocation of reductions of the budget of the Fund for development and cohesion (FSC), national programming, borne of assignments already laid out in favor of the Ministry of economic development with the deliberation of this Committee January 20, 2012, n. 6 (Official Gazette No 88/2012); Having regard to its resolution of June 30, 2014, n. 21 (Official Gazette No 220/2014) which have been rescheduled from the Fund for 2007-2013 development and cohesion on the basis of the results of the survey pursuant to resolution of this Committee of December 17, 2013, # 94 (Official Gazette No 75/2014); Having regard to the framework programme (APQ) concerning the environmental site reclamation and restoration of national economic recovery Fidenza and productive areas, April 8, 2008 entered into by the Ministry of environment and protection of land and sea, the Ministry of economic development, from the region of Emilia Romagna, the province of Parma and Fidenza; Considering that in art. 2, paragraph 2, of the APQ, in the breakfast table 1 lists the four interventions subject of environmental remediation of priority site of Fidenza, referred to as ' Completion of the reclamation of the former Cip and reclamation of hazardous areas carbochimica, former landfill Vallicella, and former incinerator San Nicomede», whose implementing body is the Ministry of environment and protection of land and sea; Considered that art. 2, paragraph 3, of the APQ requires a total cost of 14 million for the four operations mentioned above, while implementing funds, already allocated, for 10 million euros for each intervention according to the allocation specified in the above table 1; Considered that art. 2, paragraph 4, of the APQ provides for the intervention as ' Reclamation area ex carbochimica» a total cost of 9,500,961.64 euro, of which EUR 5,500,961.64 borne by the unique investment fund of the Ministry of the environment and protection of land and sea and the remaining 4 million charged to the invoked under-utilised areas Fund (formerly FAS, now FSC)-programming 2007-2013; Noted that art. 3, paragraph 2, of the APQ exposes in detail, in the breakfast table 2, the articulation of the funding already allocated by 10 million, broken down into 7 million charged to the Ministry of the environment and 3 million borne by the region of Emilia Romagna, in the province of Parma and Fidenza, in equal measure; Noted that art. 4, paragraph 4, of the APQ makes it clear that the funding of 4 million, which attributable to the Ministry for economic development, meets the definition of support for the implementation of measures to facilitate the economic sustainability of the infrastructure and the realization of them even indirectly related to reclamation activities but with autonomous public social and territorial features and prevalent; Having regard to the note # 22178 of September 25, 2014, by which the head of Cabinet of the Ministry of economic development, the Minister's order, has applied for allocation of quota of 4 million for the completion of infrastructure projects, for the competence of that Ministry, aimed at recovering the economic and productive of the former carbochimica, with burden of remaining availability of FSC decision 2007-2013 provided for 21/2014 mentioned; Given the proposal carried out under the existing regulation of this Committee (article 3 of resolution no April 30, 2012. 62) and in particular the need to need the allocation of the sum of 4 million euros in favor of the Emilia-Romagna region to avoid negative effects on debt, since the FSC resources of regional programming; Having regard to the present note. 4749-P, prepared jointly by the Department for the planning and coordination of economic policy by the Presidency of the Council of Ministers and the Ministry of economy and finance and mail on the basis of this session of the Committee; On a proposal from the competent Secretary of State meeting confirmed the Presidency of the Council of Ministers, with responsibility for territorial cohesion, which acquired the approval of Ministers, Deputy Ministers and Secretaries of State participants at today's meeting;
Resolution: 1. Are you prepared the assignment in favour of Emilia Romagna 4 million share, which share the responsibility of the Ministry of economic development, the residual resources of the Development Fund and the cohesion 2007-2013 pursuant to resolution of this Committee # 21/2014 recalled in the introduction, for the completion of infrastructure projects to the economic-productive reuse of the former carbochimica in line with the provisions of the framework programme agreement on the environmental site reclamation and restoration of national interest of Fidenza. 2. The allocation of this resolution apply regulatory measures and procedures within the framework of the Development Fund and the cohesion 2007-2013 programming.
