March 31, 1998, 107 of Legislative Decree No. 112; Having regard to the Decree-Law September 7, 2001, n. 343, converted, with amendments, by law November 9, 2001, # 401; Having regard to Decree-Law of May 15, 2012, # 59, converted, with amendments, by law, July 12, 2012 # 100; See in particular art. 3, paragraph 2, the last period of the aforementioned Decree-Law No 59/2012 where it is determined that for the continuation of the interventions by the commissarial administrations still operating under law February 24, 1992, n. 225, art. 5, paragraph 4-ter and 4-c of the Law # 225/1992; Visto l'art. August 14, 2013, 10 of Decree-Law n. 93, converted, with amendments, by law No 119 October 15, 2013; See in particular art. 3, paragraph 2, the last period of the aforementioned Decree-Law No 59/2012 where it is determined that for the continuation of the interventions by the commissarial administrations still operating under law February 24, 1992, n. 225, art. 5, paragraph 4-ter and 4-c of the Law # 225/1992; Having regard to the Decree of the President of the Council of Ministers of January 16, 2009 with which it was declared a State of emergency for the disposal of municipal waste in the province of Palermo, extended by Decree of the President of the Council of Ministers of January 13, 2010; Having regard to the Decree of the President of the Council of Ministers of July 9, 2010 with which it was declared a State of emergency for the disposal of municipal waste in the territory of the region of Sicily; Having regard to the orders of the President of the Council of Ministers # 3737 of February 5, 2009 and subsequent modifications and integrations and # 3887 of July 9, 2010; Visto l'art. 2 of Decree-Law No 43 April 26, 2013, converted, with amendments, by law June 24, 2013, # 71, whereby it was ordered that continue to produce effects, until December 31, 2013, the provisions of order of the President of the Council of Ministers # 3887 of July 9, 2010, limited to interventions that are required to: a) complete the implementation and approval of c.d. sixth hot landfill Badade in the municipality of Palermo; b) achieve and authorise, pending the full functionality of the abovementioned sixth tank, special forms of waste management; c) securing the entire dump, ensuring the proper management of leachate in it product and completing the plant system by mechanical and biological treatment of urban waste, in order to reach the landfilling of treated waste only; d) improve and increase the collection of waste in the municipality of Palermo; e) implement and complete the plant system regional municipal waste management plan referred to in the Decree of the Ministry of environment and protection of land and sea July 11, 2012, released to press in the Official Journal No. 179 of August 2, 2012, in order to assure proper integrated waste cycle management; Having regard to the order of the Head of the Civil Protection Department # 148 of February 18, 2014, civil protection standards to promote and regulate the takeover of the Sicilian region in initiatives aimed at overcoming the situation of criticality due in the field of domestic waste in the same region; Recognized the need to ensure the completion, no uninterruptible power solutions, interventions aimed at overcoming critical context under review, even in a context of necessary prevention against possible danger to the public and private safety; Considered therefore necessary, adopt a civil protection order pursuant to art. 3, paragraph 2, last sentence, of Decree-Law No 59/2012 July 12, 2012, converted, with amendments, by law, no 100, which allow the prosecution, ordinary, of initiatives aimed at overcoming the situation of criticality; View the footnote 101 of January 27, 2015 with which the person liable under art. 1, paragraph 2, of the Ordinance of the Chief of the Civil Protection Department # 148/2014 above, in transmitting the report on the implementation of interventions and activities prepared in accordance with paragraph 5 of art. 1 above, requested the maintenance of special accounting # 5446, for a period of at least sixteen months from the date of expiry thereof, scheduled for February 24, 2015; Gained the agreement of the Sicilian region; In consultation with the Ministry of economy and finance;
Features: Art. 1 1. To allow the completion of operations to be carried out in the context of criticality due in the field of domestic waste in the region, the special accounting # 5446 referred in the introduction, already addressed to the Director General of water and waste Department of the regional energy and public utilities of the Sicilian region, pursuant to art. 1, paragraph 5, of the order of the head of the Civil Protection Department # 148 of February 18, 2014, is open until August 31, 2016. 2. the Director-General of water and waste Department of the regional energy and public utilities of the Sicilian region will send to the Ministry of the environment and protection of land and sea and the Civil Protection Department a detailed report on the progress of activities carried out for the implementation of assistance under this Ordinance with its economic framework. 3. Stand still the reporting requirements in accordance with art. 5, comma 5-bis of law February 24, 1992, n. 225, and subsequent amendments and additions. This Ordinance will be published in the official journal of the Italian Republic.
