The Minister of environment, land and sea protection having regard to law no 979 December 31, 1982 laying down rules for the defense of the sea; Having regard to act July 8, 1986, n. 349, establishing the Ministry of the environment; Having regard to the framework law on protected areas December 6, 1991, n. 394, as amended; Having regard to the agreement concluded on July 14, 2005 between the Government, the regions, the autonomous provinces and local authorities in accordance with art. 8, paragraph 6, of the law June 5, 2003, # 131, on concessions of assets of the maritime domain and sea areas within marine protected areas, published in the official journal n. 174 of July 28, 2005; Having regard to the Legislative Decree July 18, 2005, n. 171 on the new code of Yachting; Visto l'art. 3, paragraph 339, December 21, 2007, law n. 244, which changed the composition of the Board of reserve under art. 28 December 31, 1982, law n. 979, and art. 2, paragraph 16, of law December 9, 1998, # 426; Having regard to the Decree of the President of the President of the Council of Ministers July 10, 2014, n. 142 laying down the organisational regulations of the Ministry of environment and protection of land and sea, of the independent performance assessment and direct collaboration offices and, in particular, article. 6, paragraph 1, point a), which attributes to the Directorate-General for the protection of nature and the sea the functions relating to land, mountain and marine protected areas; Having regard to the order of the Minister of the environment and protection of land and sea marine protected area Update July 20, 2011 "Cinque Terre", which replaces the Ministerial Decree dated November 9, 2004 for the establishment of marine protected areas and marine protected area management confirmation to the National Park of the Cinque Terre, as provided for in article I, paragraph 8, of the Decree of the President of the Republic October 6, 1999 , establishing the National Park of the Cinque Terre; Having regard to the order of the Minister of the environment and protection of land and sea n. 189 of July 20, 2011, laying down the rules of activities permitted in the protected marine area "Cinque Terre"; Having regard to the proposal for an implementing regulation and organization of the marine protected area "Cinque Terre" transmitted with note prot. 3512-P/1 of May 7, 2013, Ente Parco nazionale delle Cinque Terre; Having regard to the note prot. 8331/PNM of April 29, 2014 by which the scheme of Regulation, integrated and amended on the basis of the results of the investigation technique developed jointly with the National Park of the Cinque Terre, it was broadcast at the same Park Authority for the opinion of the Committee; Having regard to the order of the Minister of the environment and protection of land and sea. # 70 of March 5, 2013, with which it was formed, the Commission reserves the protected marine park "Cinque Terre" in composition established by art. 3, paragraph 339, December 21, 2007, law # 244; Having regard to the opinion required, no obligation expressed by the Commission at its meeting of June 16, 2014 stock on the proposal for an implementing regulation and organization of the marine protected area "Cinque Terre"; Having regard to resolution No. 97 of December 22, 2014 the President dell'ente Parco nazionale delle Cinque Terre with which it approves and is transmitted with note prot. 293-P/1 integrated Regulation scheme and modified according to the instructions of the Ministry of environment and the Committee; Given the favourable opinion given by the Board of Auditors with the # 82 November 25, 2014 report, pursuant to paragraph 10 of article. 9 of law No 394 of 1991, as amended by art. 1 paragraph 4, del decreto del Presidente della Repubblica No. 13 of April 16, 2013; Visto l'art. the final paragraph of the law 28 December 31, 1992, # 979, as replaced by art. 2, paragraph 12, of Act July 8, 1986, # 349, under which the implementing regulation and organization and is approved by Decree of the Minister for the environment and protection of land and sea; Decided to proceed with the approval of the implementing regulation and organization of the marine protected area "Cinque Terre", formulated and adopted by the National Park of the Cinque Terre, in their capacity as managing body;
Decreed: it approved the implementing regulation and organisation of the marine protected area "Cinque Terre", annexed to this Decree to form an integral part.
