The MINISTER of ECONOMIC DEVELOPMENT Saw the art. 87 of the Constitution; Visto l'art. 288 of the Treaty on the functioning of the European Union; Having regard to Directive 2009/72/EC of the European Parliament and of the Council of July 13, 2009 concerning common rules for the internal market in electricity and repealing Directive 2003/54/EC and directive 2009/73/EC of the European Parliament and of the Council of July 13, 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC , and the national framework of transposition; Having regard to act August 7, 1990 n. 241, laying down new rules on administrative procedure and the right of access to administrative documents; Having regard to the Legislative Decree May 23, 2000, n. 164, implementing Directive No. 98/30/EC on common rules for the internal market in natural gas, according to art. 41 of the Act May 17, 1999, n. 144; Having regard to the Legislative Decree March 16, 1999 n. 79, implementing Directive 96/92/EC on common rules for the internal market in electricity; Having regard to law no 239 August 23, 2004 establishing a reorganisation of the energy sector; Visto l'art. 52-quinquies of Decree of the President of the Republic June 8, 2001, n. 327, containing only text of laws and regulations relating to expropriation for public utility; 1 St October 2007, saw the Decree-Law No. 159 concerning urgent financial and economic matters, social development and equity converted with amendments by law November 29, 2007, # 222, in particular art. 46, authorisation procedures for the construction and operation of liquefied natural gas regasification terminals; Having regard to act July 23, 2009, # 99, setting out the arrangements for the development and internationalisation of enterprises, as well as in the field of energy; Having regard to the Legislative Decree 1 St June 2011, n. 93, implementing directives 2009/72/EC, 2009/73/EC and 2008/92/EC concerning common rules for the internal market in electricity, natural gas and for a Community procedure to improve the transparency of the prices charged to industrial end gas and electricity and repealing directives 2003/54/EC and 2003/55/EC; Having regard to the Decree-Law September 12, 2014, n. 133, passed into law, with amendments, art. 1, comma 1, law no November 11, 2014, # 164; Having regard to Council Regulation (Ec) No 347/2013 of the European Parliament and of the Council of April 17, 2013 on guidelines for trans-European energy infrastructure, which among other things establishes a comprehensive legal and policy framework to optimize the development of energy networks at European level by 2020 and beyond; See in particular art. 9, paragraph 1 of the Regulation (EU) No 347/2013, which provides that each Member State or the competent authority to publish a Handbook of procedures for granting process permissions applicable to projects of common interest; Views of the Decree of the President of the Council of Ministers of December 5, 2013 # 158, embodying the organisational regulations of the Ministry of economic development; Deemed it necessary to approve the manual of procedures for granting process permissions applicable to projects of common interest (Regulation (EU) No. 347/2013 of the European Parliament and of the Council of April 17, 2013 on guidelines for trans-European energy infrastructure;
Decrees: Art. 1 1. It approved the document "Manual of procedures for granting process permissions applicable to projects of common interest (Regulation (EU) No. 347/2013 of the European Parliament and of the Council of April 17, 2013 on guidelines for trans-European energy infrastructure). " The text of the manual annexed to this Decree forms an integral part of it. 2. this Decree is published in the official journal of the Italian Republic and the website of the Ministry of economic development and shall enter into force on the day following that of its publication in the Official Gazette of the Italian Republic.
