The DIRECTOR GENERAL for the promotion of quality food products and horse racing Saw the Council Regulation (EC) No 1234/2007, as amended by Regulation (EC) no 491/2009 of the Council establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products, in which it was submitted to Council Regulation (EC) no 479/2008 of the Council on the common organisation of the market in wine (Wine CMO); Having regard to Council Regulation (EC) no 1308/2013 of the European Parliament and of the Council of December 17, 2013 establishing a common organisation of the markets in agricultural products and repealing Regulations (EEC) no 922/72, (EEC) No 234/79, (EC) no 1037/2001 and (EC) no Council 1234/2007; Having regard to Council Regulation (EC) no 607/09 of the Commission concerning application of Regulation (EC) no 479/2008 as regards protected designations of origin and protected geographical indications, traditional terms, labelling and presentation of certain wine sector products; Having regard to the Legislative Decree of April 8, 2010, # 61 concerning protection of geographical indications and designations of origin of wines, in art. 15 July 7, 2009, law # 88; Having regard to the application of the aforementioned legislative decree decrees April 8, 2010, # 61, and in particular of the Ministerial Decree of November 7, 2012, bearing the national procedure for the submission and examination of applications for protection of PDO and PGI wines and to review the specifications in accordance with Regulation (EC) No 1234/2007 and of Legislative Decree No 61/2010; Having regard to the ministerial order of November 29, 1993 under which it was granted denominazione di origine controllata dei vini «Asti», and it was approved the corresponding product specification, as well as the decrees by which changes have been made to the mentioned specification; Having regard to the ministerial order of November 30, 2011 on the approval of the specifications of production of PDO and PGI wines consolidated with the changes introduced to bring the same to prediction of the elements referred to in art. 118-c, paragraph 2, of Regulation (EC) No 1234/2007 and the approval of its technical files for the purpose of submitting to the E.U. Commission in accordance with art. 118-s, paragraphs 2 and 3 of Regulation (EC) No 1234/2007, including the consolidated specification and its technical file of the PDO ' Asti '; Having regard to the ministerial order of September 9, 2014, published in the Gazzetta Ufficiale della Repubblica italiana n. 216 of September 17, 2014 and on the website of the Ministry section Dop and Igp products, with which it was last amended the specification of that PDO; Having regard to the request submitted through the Piedmont region, in accordance with the procedure referred to in art. 6 of the Ministerial Decree of November 7, 2012, and after publication in the official bulletin of the same region of the notice lodged question, upon application by the Consorzio tutela vini dell'asti, aimed at getting the amendment of a specification of production of wines with a designation of origin ' Asti '; Considered that this change request does not involve any change to the single document summary of article. 118-c, paragraph 1, point d) of Regulation (EC) no 1234/2007 and, therefore, to examine the same request applies the simplified procedure referred to in the Ministerial Decree of November 7, 2012, art. 10, paragraph 8, in accordance with the provisions of art. 118-q, paragraph 3, point a), of Regulation (EC) No 1234/2007; Having regard to the favourable opinion of the Piedmont region on the mentioned application; Having regard to the opinion delivered by the Committee on PDO and PGI wines cited national question at its meeting of February 4, 2015; Deemed it necessary to proceed with the amendment of a specification of production of wines with a designation of origin controlled and guaranteed «Asti» according to the said proposal; Deemed also to have to publish on the website of the Ministry changing the specification in question, making the resulting change to the consolidated production of wine PDO Asti» as approved by Ministerial Decree November 30, 2011, most recently amended by the Ministerial Decree of September 9, 2014, and having to communicate the change in question to the EU Commission such updated technical documentation submitted to the E.U. Commission in accordance with art. 118-s, paragraphs 2 and 3 of Regulation (EC) no 1234/2007, via the information system provided by the E.U. Commission, pursuant to art. 70-a, paragraph 1, letter a) of Regulation (EC) no 607/2009;
Decrees: 1. The production of wines with a designation of origin controlled and guaranteed «Asti» consolidated with the changes introduced to bring the same to prediction of the elements referred to in art. 118-c, paragraph 2, of Regulation (EC) No 1234/2007, as approved by the Ministerial Decree of November 30, 2011 and last amended by the Ministerial Decree of September 9, 2014 invoked in premise, it is edited with the text given in the annex. 2. The amendments referred to in paragraph 1 shall enter into force from the date of publication of this Decree in the Official Gazette of the Italian Republic. However the change in art. 7, paragraph 5-bis, on the labelling and presentation of the different types of sparkling wines, it is applicable from 1 St August 2015, subject to the disposal of stocks of packaged product within that period with labels in conformity with the provisions of the existing specification. 3. the amendment to the specification of the PDO "consolidated Asti», as per paragraph 1, will be posted on the website of the Ministry-PDO and PGI Products Section-PDO and PGI wines--and communicated to the Commission the EU, for the purposes of updating the technical dossier already submitted to the EU Commission itself, pursuant to art. 118-s, paragraphs 2 and 3 of Regulation (EC) no 1234/2007, in accordance with the procedures mentioned in the introduction. This Decree will be published in the official journal of the Italian Republic.
