March 31, 1998, 107 of Legislative Decree No. 112; Having regard to the Decree-Law September 7, 2001, n. 343, converted, with amendments, by law November 9, 2001, # 401; Having regard to Decree-Law of May 15, 2012, # 59, converted, with amendments, by law no July 12, 2012. 100 laying: "urgent provisions for the reorganization of civil protection»; Visto l'art. 10 of the Decree-Law of August 14, 2013, n. 93, converted, with amendments, by law No 119 October 15, 2013; Having regard to the resolution of the Council of Ministers of October 30, 2014 by which it was declared, for 180 days, a State of emergency as a result of the exceptional weather adversity that from 9 to October 13, 2014 struck the province of Genoa and of the municipalities of Borghetto di Vara, Ricco ' del Golfo di Spezia and Varese Ligure in Val di Vara La Spezia; Having regard to the resolution of the Board of Ministers of December 24, 2014, by which the State of emergency declared by resolution of the Council of Ministers of October 30, 2014, in consequence of the exceptional weather adversity that from 9 to October 13, 2014 struck the province of Genoa and of the municipalities of Borghetto di Vara, Ricco ' del Golfo di Spezia and Varese Ligure in Val di Vara La Spezia , has been extended to the territory of the municipalities of Maissana, Sesta Godano and pinion in the Vara Valley in the province of La Spezia, within the limits of the resources allocated therein; Having regard to the resolution of the Board of Ministers of December 24, 2014 by which it was declared, for 180 days, a State of emergency as a result of freak weather events that hit the territory of Liguria region from 3 to November 18, 2014; Having regard to the order of the Head of the Civil Protection Department # 203 of November 14, 2014 bearing: «First emergency civil protection as a result of the exceptional weather adversity that from 9 to October 13, 2014 struck the province of Genoa and of the municipalities of Borghetto di Vara, Ricco ' del Golfo di Spezia and Varese Ligure in Val di Vara La Spezia. '; Having regard to the order of the Head of the Civil Protection Department # 216 of December 30, 2014 recante: "First urgent action of civil protection as a result of freak weather events that hit the territory of Liguria region from 3 to November 18, 2014. '; Having regard to the request of the Director of the Environment Department in January 21, 2015 regione Liguria-Commissioner; Having regard to the note of February 4, 2015 with which the Director of the Department of environment of the region Liguria-special Commissioner, in transmitting the opinion delivered by the Director-General of ISPRA on January 9, 2015, asks to change the paragraph 2 of art. 11 Ordinances # 203 and # 216 of 2014; Seen the need to establish additional emergency measures aimed to conclude rapidly the first emergency phase in the territories flood victims, allowing the resumption of normal conditions of life of the people, as well as the safety of the Territories concerned by the event in question; Taking into account also that this Ordinance does not entail additional burdens on public finance, why not make use of the conditions to capture the concert of the Ministry of economy and finance provided by art. 5, paragraph 2-bis of law February 24, 1992, # 225, as amended; Gained the agreement of Liguria with a note of February 10, 2015;
Features: Art. 1 plant materials 1. Paragraph 2 of art. 11 orders of the head of the Civil Protection Department # 203 of November 14, 2014 and # 216 of December 30, 2014 that's replaced: «2. Plant materials referred to in paragraph 1, shall be assimilated to the materials of art. 185 paragraph 1 lit. f) of Legislative Decree No 152 April 3, 2006 and subsequent amendments notwithstanding art. 184 comma 2 lett. d) of the same Decree limited the scope of this Ordinance. These materials, as they don't waste notwithstanding the provisions of art. 182 paragraph 6-bis of Legislative Decree No 152 April 3, 2006 and subsequent amendments may be burned in daily quantities exceeding three loose cubic meters, after consulting the ARPAL, which is expressed on the typology of eligible waste fuel and destination materials themselves.
