The MINISTER of ECONOMIC DEVELOPMENT having regard to the Decree of the President of the Council of Ministers December 5, 2013, # 158, embodying the organisational regulations of the Ministry of economic development, for the responsibilities of supervision of cooperative; Having regard to Decree-Law No 95 July 6, 2012, converted into law August 7, 2012, # 135; Having regard to the findings of the ministerial review of January 23, 2013 and subsequent missed inspection assessment as a result of formal notice in respect of the cooperative to regularise their position, ended on June 21, 2013 containing the proposed replacement of the liquidators for the cooperative "Bay Sinuessa-limited liability cooperative housing society"; View the investigation conducted by the competent supervisory authority, from which emerged the extremes for the adoption of the measure of compulsory administrative liquidation art. 2545-l DC; Considered what emerges from the updated Chamber, made ex officio at the competent commercial register, in relation to corporate officers, at the registered office and the fulfilment of obligations relating to deposits; Considering that in November 7, 2013 date it was communicated, in accordance with art. 7 of Law 241/90, the initiation of the procedure of forced liquidation to the legal representative of the cooperative, the Court of first instance and the competent Chamber of Commerce for the area; As the legal representative of the company, on December 6, 2013 has formalized its renunciation of any counterclaims to produce and that there is no impediment to the adoption of the measure of compulsory administrative liquidation; Having regard to the proposal by which the Directorate-General for the supervision of, the cooperative system and the outcome of the investigation conducted commissarial managers, proposes the adoption of the submission of the cooperative in question to the forced liquidation procedure; Visto l'art. 2545-l c.c. and deemed it necessary to have the forced liquidation of that company; Visto l'art. 198 Royal Decree March 16, 1942, # 267;
