The DIRECTOR GENERAL for the promotion of quality food products and horse racing Saw the Council Regulation (EC) No 1234/2007, as amended by Regulation (EC) no 491/2009 of the Council establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products, in which it was submitted to Council Regulation (EC) no 479/2008 of the Council on the common organisation of the market in wine (Wine CMO); Having regard to Council Regulation (EC) no 1308/2013 of the European Parliament and of the Council of December 17, 2013 establishing a common organisation of the markets in agricultural products and repealing Regulations (EEC) no 922/72, (EEC) No 234/79, (EC) no 1037/2001 and (EC) no Council 1234/2007; See in particular part II, title II, chapter I, section 2, of the Regulation (EU) No. 1308/2013 laying down the rules governing designations of origin, geographical indications and traditional terms in the wine sector; Having regard to Council Regulation (EC) no 607/09 of the Commission concerning application of Regulation (EC) no 479/2008 as regards protected designations of origin and protected geographical indications, traditional terms, labelling and presentation of certain wine sector products; Having regard to the Legislative Decree of April 8, 2010, # 61 concerning protection of geographical indications and designations of origin of wines, in art. 15 July 7, 2009, law # 88; Having regard to the application of the aforementioned legislative decree decrees April 8, 2010, # 61, and in particular of the Ministerial Decree of November 7, 2012, bearing the national procedure for the submission and examination of applications for protection of PDO and PGI wines and to review the specifications in accordance with Regulation (EC) No 1234/2007 and of Legislative Decree No 61/2010; Having regard to the Ministerial Decree of June 27, 2011, published in the Official Gazette No. 161 of July 13, 2011, on the recognition of DOC wines "Spoleto" and the approval of the corresponding product specification; Having regard to the ministerial order of November 30, 2011, published on the website of the Ministry-PDO and PGI Products Section-PDO and PGI wines-Official Gazette n. 295 of December 20, 2011, on approval of the specifications of production of PDO and PGI wines consolidated with the changes introduced to bring the same to prediction of the elements referred to in art. 118 quater, paragraph 2, of Regulation (EC) No 1234/2007 and approval of technical dossiers for submission to the EU Commission pursuant to art. 118 s, paragraphs 2 and 3 of Regulation (EC) No 1234/2007, including consolidated and its technical file specification of the PDO "Spoleto"; Having regard to the judgment # 7595/2012 of TAR Lazio section IIB, with which he was received an appeal lodged by the persons concerned against the forecast under art. 3 of the recalled product specification of the DOC "Spoleto" in relation to the delimitation of the production area, and it was arranged for the annulment of the provision of article. 3 in so far as it excludes from the production area some territories of the municipality of Montefalco; Having regard to the note of the Umbria region # 170699 of December 29, 2014 with which, according to the device of the judgment, it was presented a detailed description of the new delimitation of the production area as referred to in art. 3 production rules of the DOC "Spoleto", taking account of enlargement in the same production area in the whole territory of the municipality of Montefalco, in order to enable this Ministry to formalize said adjustment; Felt, running of the judgment of the TAR of Lazio, of having to make the subsequent update to the art. 3 the specification for production of wine DOC "Spoleto" and associated technical documentation, both within the framework of the information system provided by the European Commission under art. 70-a, paragraph 1, letter a) of Regulation (EC) no 607/2009, both in the website of the Ministry-PDO and PGI Products Section-PDO and PGI wines;
Decrees: Art. 1 1. In compliance with the judgment # 07595/2012 of TAR Lazio section IIB, the product specification of the protected designation of origin of wines "Spoleto", as well as consolidated with the Ministerial Decree of November 30, 2011 and most recently updated with the Ministerial Decree of March 7, 2014 recalled in the introduction, it changes the art. 3. as is clear from the text that is shown in the annex to this Decree.
