The MINISTER of ECONOMIC DEVELOPMENT having regard to Directive 2009/73/EC of the European Parliament and of the Council of July 13, 2009 concerning common rules for the market in natural gas and repealing Directive 2003/55/EC; Having regard to the Legislative Decree May 23, 2000, n. 164, hereinafter "Decree 164/00", and in particular paragraphs 1 and 2 of article. 8 that provide respectively that: the natural gas transportation and dispatching activity and activity of public interest;
companies that carry out transportation and dispatching activities are required to connect to its network users who request where the system of which they have to have adequate capacity, and as long as the works necessary for the connection of the user are technically and economically feasible based on criteria established by resolution of the authority for electricity and gas; Having regard to the Legislative Decree 164/00 and in particular art. 9 that, in paragraph 1 requires, inter alia, that the national network of pipelines, including ancillary services related, it is detected, after consulting the Joint Conference and the authority for electricity and gas, by Decree of the Ministry of industry, Commerce and crafts, which will also update every year or at the request of an undertaking which engages in the business of transport; Having regard to law no 239 August 23, 2004 establishing a "reorganisation of the energy sector, as well as delegates to the Government to restructure the existing provisions on energy", and in particular art. 1, paragraph 2, point b), under which the activities of the natural gas transportation and dispatching in network, as well as the management of energy supply infrastructures related to energy transportation and dispatching activities, are in the public interest and are subject to public service obligations deriving from Community legislation, by legislation and by appropriate agreements with the competent authorities; Having regard to the Legislative Decree 1 St June 2011, n. 93 containing "2009/72/EC directives, 2009/73/EC and 2008/92/EC concerning common rules for the internal market in electricity, natural gas and for a Community procedure to improve the transparency of the prices charged to industrial end gas and electricity and repealing directives 2003/54/EC and 2003/55/EC" hereinafter "Decree No 93/2011"; Visto l'art. 10 of Legislative Decree No. 93/2011 and in particular paragraph 6, point f), which provides that each natural gas transmission system operator manages the safety, reliability, efficiency and economy and, to this end, shall, on an annual basis, a program of the natural gas transmission network maintenance including interconnections with foreign networks and that the program is approved by Decree of the Minister of economic development After consulting the authority for electricity, gas and water system, below AEEGSI, and it is binding unless motivated technical impediments and that the content of that program are communicated to the regions; Having regard to the letter of 13 October 17, 2014, 2014/rg/OPER/Protocol and its annexes with which the company Snam Rete Gas Spa has forwarded to the Ministry of economic development the maintenance program of the natural gas transmission network for the thermal year 2014-2015; Having regard to the letter of August 27, 2014 2014, DT/PA/rme/Protocol/0835, and attachments with which society S.G.I.-Italy Pipeline Company Spa has forwarded to the Ministry of economic development the maintenance program of the natural gas transmission network for the thermal year 2014-2015; Having regard to the letter of October 23, 2014, n. 22/10/2014/0213 and annexes which Gas Transportation Infrastructures Spa company informed the Ministry of economic development not to provide for maintenance of the natural gas transmission network for the thermal year 2014-2015; Having regard to the communication of electricity and gas markets, Director of AEEGSI, Protocol 0034464 of November 27, 2014, transmitted to the Directorate General for security of supply and energy infrastructure of the Ministry with which it was expressed a favourable opinion about maintenance plans natural gas transmission companies above; Considered that the natural gas transmission network maintenance for the thermal year 2014-2015 company Snam Rete Gas Spa and S.G.I.-Italy Pipeline Company Spa contain the elements necessary for the identification of scheduled maintenance on their respective networks, its timing, and the consequent interruptions or reductions of capacity transportation while the company Gas Transportation Infrastructures Spa announced that it does not provide for maintenance work on the natural gas transmission network for the mentioned thermal year;
Decrees: Art. 1 approval of programmes of the natural gas transmission network maintenance 1. This Decree, in accordance with art. 10, paragraph 6, point f) of Legislative Decree No. 93/2011, approves the programmes of the natural gas transmission network maintenance by company Snam Rete Gas Spa and S.G.I.-Italy Pipeline Company Spa for the thermal year 2014-2015. The company's Gas Transmission Infrastructures Spa does not provide maintenance on its natural gas transmission network for the thermal year 2014-2015. 2. Maintenance programs referred to in paragraph 1 shall be communicated to the regions.
