The PROJECT MANAGER and STATE PROPERTY of the MINISTRY of DEFENCE in consultation with the Director General of the AGENZIA DEL DEMANIO Saw art. 2 December 24, 2007, paragraph 628 of the law n. 244, now reproduced and coordinated in the Legislative Decree of March 15, 2010 military order bearing the code # 66, which involves alienation, from the Ministry of defence of ownership, usufruct or the bare ownership of housing no longer functional institutional needs, in number no less than three thousand, including in entire stable to be transferred in bulk; Having regard to the order of the Minister of defence May 18, 2010 # 112, now reproduced and coordinated in the Decree of the President of the Republic of March 15, 2010 # 90 on the consolidated text of provisions relating to military order; Having regard to Decree No 14/2/5/2010 of November 22, 2010, published in the Official Gazette No. 70 of March 26, 2011, supplemento ordinario No. 80, with which they were identified in annex "A" to the said Decree accommodations to be transferred, in order to implement the multiannual programme for the construction, purchase and improvement of service housing for military personnel whose art. 2 in paragraph 629 per paragraph 631 December 24, 2007 law n. 244, provisions now reproduced and coordinates in the Legislative Decree of March 15, 2010 military order bearing the code # 66; Found that the Decree of discovery accepts art. 2 that the transfer to the assets available to be transferred later to be formalized by housing transfer decrees issued in conjunction with the Agenzia del demanio, upon formalization of its declarations in the land register; Considered that housing to be transferred in annex "A" of Decree 14/2/5/2010 of November 22, 2010 belong in part to the public land of the State and in part to the heritage of stock; Considering that for accommodations that belong to public ownership of the State, by means of special decrees issued in conjunction with the Agenzia del demanio, he proceeded to their transfer to the State; Seen the need to arrange for accommodations unavailable to their State Heritage transfer the assets available in the State for disposal; Visto l'art. 9 of Royal Decree May 23, 1924, n. 827 that ranks among the real estate available those that are not intended for public or Government service; Considered that housing provided in annex "A" to Decree No 14/2/5/2010 of November 22, 2010 are no longer functional to the needs of the armed forces, Decrees: Art. 1 1. Accommodations under premises, which are identified in the list annexed to this Decree, which form an integral part thereof, shall be transferred from the assets unavailable to be alienated heritage status for the purposes of art. 2, paragraphs 629 to 631 December 24, 2008, law n. 244 (now article 306 of the Legislative Decree March 15, 2010 military order bearing the code # 66) and according to the modalities defined by the Decree of the Minister of defence of May 18, 2010 # 112, now reproduced and coordinated in the Decree of the President of the Republic of March 15, 2010 # 90, regarding the consolidated text of provisions concerning military sort.
