HEALTH MINISTER having regard to articles 2, 13 and 14 of the Decree of the President of the Republic October 9, 1990, # 309, as amended establishing a "consolidated text of the laws concerning the regulation of narcotic drugs and psychotropic substances and of prevention, treatment and rehabilitation of their States of drug dependence», hereinafter referred to as ' text only '; Views: tables I, II, III and IV that indicate the substances with strong tossicomanigeno power and misused in order of decreasing potential for abuse and dependence;
the drugs, divided into five sections, indicating the substances with pharmacological activity and are therefore used in therapy, according to the criteria for the formation of the tables referred to in article 14 of the consolidated text; Considering that, as a result of changes to consolidated law by Decree-Law No March 20, 2014. 36, converted, with amendments, by law May 16, 2014, n. 79, the substances are included only in the table etizolam and meprobamate, attached to the same text only; Deemed necessary to include these substances in table IV of the consolidated text, according to the expected criteria laid down in article 14 of the consolidated report, as for the same are assessed induction physical or psychological dependency of hazard intensity and gravity less than those produced by the substances listed in tables I and III; Having regard to the opinion of the higher Institute of health, rendered with note prot. # 33481 of October 14, 2014, favour inclusion in table IV of the consolidated text of the substances etizolam and meprobamate; Having regard to the note of June 25, 2014 with which the Italian medicines agency has asked the Ministry of health medicines table update following the release of the first marketing authorisation for a medicinal product to parenteral based lormetazepam; Given that the criteria for the formation of the table of medicinal products referred to in article 14 of the consolidated require parenteral benzodiazepine-based medicines are included in section D of that table; Having regard to the opinion of the higher Institute of health, communicated with note prot. No 33842 of October 14, 2014, favorable to the inclusion in the table of medication, section D, of the consolidated parenteral medicines based on lormetazepam. Having regard to the opinion of the High Council of health, expressed at its meeting of November 11, 2014, favour inclusion in table IV of the consolidated substances etizolam and meprobamate and the inclusion in the table of medication, section D, of the same text only parenteral medicines based on lormetazepam.
Decrees: Art. 1 1. In table IV of the Decree of the President of the Republic October 9, 1990, # 309, as amended, are included, in alphabetical order, the following substances: Etizolam Meprobamate 2. In the table of medication, section D, of the Decree of the President of the Republic October 9, 1990, n. 309, as amended, it is noted in the "compositions for parenteral use containing", in alphabetical order, the following substance: Lormetazepam this Decree shall enter into force on the fifteenth day following its publication in the official journal of the Italian Republic.
