The Minister of agricultural food and forestry policies Saw the Legislative Decree March 29, 2004, n. 102 concerning, inter alia, the national solidarity fund in support of the agricultural enterprises affected by natural disasters and adverse weather events; Having regard to the Legislative Decree of April 18, 2008, # 82, adjustment of national solidarity fund legislation, legislative decree 102/2004, for conformity to the guidelines for State aid in the agriculture and forestry 2007-2013 (2006/C 319/01) and Regulation (EC) 1857/2006, of December 15, 2006; Having regard to articles 5, 6, 7 and 8 of the same legislative decree 102/04, as amended by Legislative Decree 82/2008, governing compensatory damages, emergency interventions in areas and for uninsurable risks with preferential policies, assisted by State contribution; See, in particular, article. 6 identifying the procedures and methods for enabling on-demand assistance interventions in the region or autonomous province concerned, leaving this Ministry the Declaration of the exceptionality of adverse events, the identification of damaged territories and granted as well as the periodic allocation provisions of financial resources of the national solidarity fund to enable regions the aid delivery; Having regard to the Community guidelines for State aid in the agriculture and forestry 2007-2013 (2006/C319/01), and in particular the chapter «v. risk and crisis management '; Having regard to Council Regulation (EC) No 1857/2006 of December 15, 2006 on the granting of State aid for small and medium-sized agricultural enterprises, and in particular art. 11, establishing conditions and limits for the granting of aid to compensate for losses due to weather adversity can be assimilated to natural disasters; Having regard to the notification exemption registration # XA26/09 of January 16, 2009 the EU Commission; Having regard to Council Regulation (EU) No. 1114/2013 of November 7, 2013 amending Regulation (EC) No 1857/2006 in relation to the period of application of this Protocol, and in particular the final date of the exemption that is moved from June 30, 2014 to December 31, 2014; Having regard to the proposal of the Emilia Romagna region for a declaration adverse events listed below, for the application in the territories damaged the national solidarity fund provisions; Torrential rain of September 20, 2014 in the province of Forli-Cesena. Given the Emilia Romagna region signed the necessary findings which show that the events covered by this request for declaratory judgment have assumed the character of exceptionality in art. 1, paragraph 2 of the d.lgs. # 102/04 and s; Decided to accept the proposal of the Emilia Romagna region by activating compensatory National Solidarity Fund intervention in areas affected by the corporate structures;
Decreed: it declared the existence of the exceptionality of the disasters listed alongside the below province for damage to farm structures in the following agricultural territories, where they can apply the specific intervention measures provided for in Legislative Decree March 29, 2004, n. 102, as amended by Legislative Decree No 82 April 18, 2008; Forli-Cesena: torrential rain of September 20, 2014;
provisions of art. 5 paragraph 3 in the municipalities of Castrocaro Terme e Terra del Sole, Civitella di Romagna, Dovadola, Galeata, Modigliana, Portico e San Benedetto, Tredozio. This Decree will be published in the official journal of the Italian Republic.
