March 31, 1998, 107 of Legislative Decree No. 112; Having regard to the Decree-Law September 7, 2001, n. 343, converted, with amendments, by law November 9, 2001, # 401; Having regard to Decree-Law of May 15, 2012, # 59, converted, with amendments, by law no July 12, 2012. 100 laying: "urgent provisions for the reorganization of civil protection"; Visto l'art. 10 of the Decree-Law of August 14, 2013, n. 93, converted, with amendments, by law No 119 October 15, 2013; Having regard to the resolution of the Board of Ministers of December 24, 2014 by which it was declared, for 180 days, a State of emergency as a result of freak weather events that hit the territory of Liguria region from 3 to November 18, 2014; Seen the need to proceed to completion, in terms of urgency, sum of all extraordinary initiatives aimed to return to normal living conditions in the territory concerned by the events in review; Since the emergency situation, the urgent character, does not allow ordinary procedures, but requires the use of extraordinary powers by way of exception to the rules in force; Having regard to the note of November 19, 2014 of the Department of environment of the region of Liguria; Gained the agreement of Liguria with a note of December 29, 2014;
Features: Art. Appointed Commissioner 1 and plan of operations 1. In order to face the emergency resulting from disasters referred in the introduction, the Director of the Department of environment of the region of Liguria is appointed Special Commissioner. 2. For the purpose of carrying out the activities referred to in this Ordinance the Commissioner may employ subject actuators acting on the basis of specific directives from the same instructions as well as the mayors of the municipalities concerned by the events in question. Such persons may avail themselves of the collaboration of organizational structures and staffing of Liguria region, as well as the cooperation of local authorities in the region itself, without any new or increased charges for public finance. 3. The Commissioner shall, within the limits of the financial resources under art. 3, within twenty days from the enactment of this Ordinance, a plan of action to be submitted to the approval of the Head of the Civil Protection Department. This plan must contain: a) operations undertaken by local authorities in the first emergency phase aimed at removing risk situations, to ensure the necessary assistance and shelter for people affected by these disasters;
b) the activities carried out, including in terms of urgency, about the safety of areas affected by natural disasters;
c) the emergency measures taken to avoid danger or major damages to any person or property;
d) identification of common damaged. 4. The plan referred to in paragraph 3 must also contain the technical description of each action with its lifetime, as well as an indication of individual items of expenditure. 5. The aforementioned plan can be subsequently reformulated and integrated within the limits of resources under art. 3, subject to the approval of the head of the Civil Protection Department. 6. the contributions shall be granted to local authorities upon account of costs incurred and proof of the existence of the link of causation between the disaster in question and the damage sustained.
