The Minister of environment, land and sea protection having regard to law no 979 December 31, 1982 laying down rules for the defense of the sea; Having regard to act July 8, 1986, n. 349, establishing the Ministry of the environment; Having regard to the framework law on protected areas December 6, 1991, n. 394, as amended; Having regard to the agreement concluded on July 14, 2005 between the Government, the regions, the autonomous provinces and local authorities in accordance with art. 8, paragraph 6, of the law June 5, 2003, # 131, on concessions of assets of the maritime domain and sea areas within marine protected areas, published in the official journal n. 174 of July 28, 2005; Having regard to the Legislative Decree July 18, 2005, n. 171 on the new code of Yachting; Visto l'art. 3, paragraph 339, December 21, 2007, law n. 244, which changed the composition of the Board of reserve under art. 28 December 31, 1982, law n. 979, and art. 2, paragraph 16, of law December 9, 1998, # 426; Having regard to the Decree of the President of the Council of Ministers, July 10, 2014 # 142, embodying the organisational regulations of the Ministry of environment and protection of land and sea, of the independent performance assessment and direct collaboration offices and, in particular, article. 6, paragraph 1, point a), which attributes to the Directorate-General for the protection of nature and the sea the functions relating to land, mountain and marine protected areas; Having regard to the Ministerial Decree of December 12, 1997, published in the Official Gazette No. 47 of February 26, 1998, establishment of marine protected area named "Tavolara – Punta Coda Cavallo"; Having regard to the Decree of the Ministry of environment and territory of November 28, 2001, published in the Official Gazette No 42 of February 19, 2002, correction of the decree establishing the marine protected area named "Tavolara – Punta Coda Cavallo"; Having regard to the order of the Minister of the environment and territorial protection of foster care in the management of marine protected area December 12, 2003 "Tavolara – Punta Coda Cavallo" eponymous Management Consortium; Having regard to the order of the Minister of the environment and protection of land and sea. # 65 of the March 5, 2013 with which it was formed the Board of reserve of the marine protected area "Tavolara – Punta Coda Cavallo", composition established by art. 3, paragraph 339, December 21, 2007, law # 244; Having regard to the proposal for an implementing regulation and organization of the marine protected area "Tavolara – Punta Coda Cavallo", transmitted in July 24, 2013 by the Consortium's protocol note 1153 marine protected area management; Having regard to the note prot. # 9685/PNM of May 16, 2014 by which the scheme of Regulation, integrated and changed the outcome of the technical investigation carried out jointly with the consortium management, it was sent to the same consortium management for the opinion of the Committee; Having regard to the opinion required, no obligation expressed by the Commission at its meeting of June 16, 2014 stock on the proposal for an implementing regulation and organization of the marine protected area "Tavolara – Punta Coda Cavallo"; Visto l'art. the final paragraph of the law 28 December 31, 1992, # 979, as replaced by art. 2, paragraph 12, of Act July 8, 1986, # 349, under which the implementing regulation and organization and is approved by Decree of the Minister for the environment and protection of land and sea; Decided to proceed with the approval of the implementing regulation and organisation of the marine protected area "Tavolara – Punta Coda Cavallo", on the basis of preliminary investigation and of technical deep dive discussions on the proposal for a regulation submitted by the Consortium;
Decrees: Art. 1 approved the implementing regulation and organisation of the marine protected area "Tavolara – Punta Coda Cavallo", annexed to this Decree to form an integral part.
