AND FINANCE In view of art. 18, paragraph 1, lett. a) of the Decree-Law of 29 November 2008, n. 185, converted with modifications in the law 28 January 2009 n. 2, establishing the Social Fund for employment and training; In view of art. 12 of Decree Law 31 May 2010, n. 78, converted with amendments into law July 30, 2010, n. 122 which provides, with effect from 1 January 2011, new effective dates of pension retirement treatments and seniority '; Seen paragraph 5 of art. 12 referred to in the preceding paragraph, which provides that the persons identified in the same paragraph 5 shall apply the provisions on the commencement of the current pension payments before the entry into force of Decree-Law 31 May 2010, n. 78; Given the paragraph 5-bis of the same Article. 12, introduced by art. 1, paragraph 37, letter. b) of the Law of 13 December 2010, n. 220, according to which, 'with regard to workers referred to in subparagraphs a) to c) in paragraph 5, even though they are' mature the requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of the protective performance of the income referred to on those letters, the Minister of Labour and social policy, in consultation with the Minister of economy and Finance, within the resources available from the social Fund for employment and training in Article . 18, paragraph 1, lett. a) of the Decree-Law of 29 November 2008, n. 185, converted with modifications in the law 28 January 2009 n. 2, may 'have, in derogation from the regulations in force, as an alternative to that stated by paragraph 5, the granting of the extension of the intervention of income protection for the period of time necessary to achieve the effect of pension is based on the established by this Article and, in any case, for no longer than the period of time between the date computed with reference to the provisions on the effect of existing pension obligations prior to the effective date of this decree and the date of effect of pension is calculated on the basis of the provisions of this Article '; Having regard to Section 6 of art. 12 in the preceding paragraphs, pursuant to which: INPS will monitor, on the basis of the date of cessation of employment, the retirement requests submitted by employees referred to in paragraph 5 of that article. 12 wishing to make use, as from 1 January 2011, the regime of starting provided by law prior to the date of entry into force of Decree-Law 31 May 2010, n. 78; if the predicted result monitoring the achievement of the number of 10,000 applications for retirement, INPS will not take 'consider further retirement applications designed to take advantage of the benefits provided for in paragraph 5 of that article. 12; In view of art. 3 of the Law of 14 January 1994, n. 20; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 63655 of January 5, 2012, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, as amended, by which: and 'was granted an extension of the intervention of income protection, excluding the imputed contribution, in favor of n. 677 workers in 2011 did not return to the quota of 10,000 units' in art. 12, paragraph 5, of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, even though they 'have fulfilled the requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of income protection benefits; and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 68225 of 2 October 2012, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law on July 30 2010, no. 122, as amended, by which: and 'was granted an extension of the intervention of income protection, excluding the imputed contribution, in favor of n. 3494 workers who, in 2012, not covered by the quota of 10,000 units' referred to in Article 12, paragraph 5, of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, even though they 'have fulfilled the requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of income protection performance. and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 76353 of October 16, 2013, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, and subsequent amendments and additions, by which: and 'was granted the intervention of protection extension of income, excluding the imputed contribution, in favor of workers who, in the year 2013 do not fall within the quota of 10,000 units' in art. 12, paragraph 5, of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, even though they 'have fulfilled the requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of income protection benefits; the extension and 'was granted in favor of workers for whom the same extension have started in a given ricompresa between January 1 and December 31, 2013, for a number of monthly payments' not exceeding the period of time between the date computed with reference to the provisions on the commencement of the current pension benefits before the date of entry into force of that decree-law no. 78 of 2010 and the date of commencement of the pension calculated on the basis of the provisions of Art. 12 of the decree-law, and in any case for a number of monthly payments' no later than 31 December 2013; and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 79413 of 14 February 2014, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, and subsequent amendments and additions, by which: and 'was granted an extension of the intervention of income protection, to the exclusion of social contributions, in favor of the already' recipients of the decree n workers. 76353 of 16 October 2013; the extension and 'was granted in favor of the workers, first cited limited to mensilita' remaining in the year 2014 and related to the extension of income support measures authorized by ministerial decree no. 76353 of 16 October 2013; and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 85708 of 24 October 2014, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, as amended, by which: and 'the intervention of the protection granted extension of income, excluding the imputed contribution, in favor of workers who, in the year 2014 not covered by the quota of 10,000 units' laid down 'art. 12, paragraph 5, of the Decree-Law of 31 May 2010, no. 78, converted with amendments into Law 30 July 2010, n. 122, even though they 'have fulfilled the requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of income protection benefits; the extension and 'was granted in favor of workers for whom the same extension have started in a given ricompresa between January 1 and December 31, 2014, for a number of monthly payments' not exceeding the period of time between the date computed with reference to the provisions on the commencement of the current pension benefits before the date of entry into force of that decree-law no. 78 of 2010 and the date of commencement of the pension calculated on the basis of the provisions of Art. 12 of the decree-law, and in any case for a mensilita 'number no later than 31 December 2014; and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; The Order of the Minister of Labour and Social Policy, in consultation with the Minister of Economy and Finance, n. 88332 of March 9, 2015, issued pursuant to art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122, and subsequent amendments and additions, by which: and 'was granted an extension of the intervention of income protection, to the exclusion of social contributions, in favor of the already' recipients of the decree n workers. 85708 of 24 October 2014; the extension and 'was granted in favor of the workers, first cited limited to mensilita' remaining in the year 2015, and relating to the extension of income support measures authorized by ministerial decree no. 85708 of 24 October 2014; and 'it authorized INPS to provide an extension of the intervention in favor of the income protection of workers mentioned above who have applied for retirement on the basis of the provisions on the commencement of the current pension payments before the entry into force of mentioned decree-law 31 May 2010 n. 78; Given that the monitoring carried out by INPS in 2015 that, for the same year, the workers concerned by the extension of the intervention of income protection amounted to a total no. 1490 workers for a cost to the Social Fund for employment and training equal to EUR 32,303,225.00; Considering that by the INPS monitoring is a cost-savings of Euro 1,504,965.00; It decided to grant an extension of the intervention of income protection in favor of n. 1490 beneficiaries covered workers, in the year 2015, in the provisions of art. 12, paragraph 5-bis of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 20, 2010, n. 122; Therefore considered to authorize the INPS provision of the extension of the intervention of income protection in favor of the workers targeted in the preceding paragraph, with a budget limit of € 32,303,225.00;
Decrees:
Art. 1 'granted an extension of the intervention of income protection, excluding the imputed contribution, in favor of n. 1490 workers who, in 2015, fall outside the quota of 10000 units' in art. 12, paragraph 5, of the Decree-Law of 31 May 2010, no. 78, converted with amendments into law July 30, 2010, n. 122 himself ', have the necessary requirements for access to retirement with effect from 1 January 2011 and in any event within the period of use of income protection performance. The extension and 'granted for a number of monthly payments' not exceeding the period of time between the date computed with reference to the provisions on the effect of the current pension benefits before the date of entry into force of that Decree-Law no. 78 of 2010 and the date of commencement of the pension calculated on the basis of the provisions of Art. 12 of the decree-law.
