The MINISTER of agricultural, food and forestry RESOURCES having regard to act June 18, 1931, no. 987, containing provisions for the protection of crops and agricultural products by the enemy and causes its services as amended; Having regard to regulation for the application of that law, approved by Royal Decree October 12, 1933, # 1700, as amended by Royal Decree, December 2, 1937 # 2504; Having regard to law no November 25, 1971. 1096, on the regulation of seed activity, amended by Decree of the President of the Republic, June 8, 1978 # 373; Having regard to Council Directive 77/93/EEC No EEC of December 21, 1976, on protective measures against the introduction into the Member States of organisms harmful to plants or plant products and subsequent modifications; Having regard to Legislative Decree No 536 December 30, 1992, concerning the implementation of Council Directive No. December 19, 1991 91/683/EEC on protective measures against the introduction into the Member States of organisms harmful to plants and plant products; Having regard to the Ministerial Decree of January 31, 1996, published in the ordinary Supplement No 33 to the Official Gazette No. 41 of February 19, 1996, on protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products; Having regard to Commission Directive 96/78/EC of n. December 6, 1996 amending certain annexes to Directive No. 77/93/EEC on protective measures against the introduction into the community of organisms harmful to plants or plant products and against their spread within the community; Given the need to transpose Commission Directive No 96/78/EC of December 6, 1996 above;
Decrees: Art. 1. the annexes of the Ministerial Decree of January 31, 1996 are amended as follows: 1. in annex I, part A, section I, point c) is inserted after point 15 on new point: 15.1. Tilletia indica Mitra. 2. in annex IV, part A, section I, points are added after point 52:53. Seeds of the genera Triticum, Secale and X Triticosecale originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA where Tilletia indica Mitra is known to occur. An official statement that the seeds originate in an area known to be free from Tilletia indica Mitra. The zone name must be mentioned in the phytosanitary certificate as referred to in art. 7 of Directive 77/93/EEC. 54. Grain of the genera Triticum, Secale and X Triticosecale originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA where Tilletia indica Mitra is known to occur. Official statement: i) the seeds originate in an area known to be free from Tilletia indica Mitra. The name of the area or areas should be mentioned in the "Origin" of the phytosanitary certificate as referred to in art. 7 of Directive 77/93/EEC or ii) that no symptoms of Tilletia indica Mitra has been observed on the plants at the place of production during the last complete cycle of vegetation and that representative samples of seeds were collected at the time of collection and prior to shipment and found free of Tilletia indica Mitra at the time of the trials, the last of which must be disclosed with the words "monitored and results free of Tilletia indica Mitra", in the "product name" phytosanitary certificate as referred to in art. 7 of Directive 77/93/EEC. 3. in annex V, part B, section I, paragraph 1, after the words "and of Uruguay" are added the following words: "genera Triticum, Secale and X Triticosecale originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA". 4. in annex V, part B, section I, after item 7 is added the next step: 8. Grain of the genera Triticum, Secale and X Triticosecale originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA.
