THE MINISTER OF HEALTH 'in concert with THE MINISTER OF THE UNIVERSITY' AND RESEARCH AND DEVELOPMENT and THE MINISTER OF THE TREASURY, BUDGET AND ECONOMIC PLANNING In accordance with Legislative Decree of 8 August 1991, n. 257, and, in particular, Article. 2 on the three-year planning of the number of specialists to be formed; Given the Decree dated 31 October 1991 the Minister of the University 'and scientific and technological research in consultation with the Minister of Health', published in the Official Gazette no. 262 8 November 1991 on the list of graduate schools in medicine and surgery in art. 1 of Legislative Decree No. 257/1991; Given the decrees on 30 November 1993 and 25 November 1994 the Minister of the University 'and Scientific and Technological Research in consultation with the Minister of Health', published in the Official Journal n respectively. 278 of 26 November 1993 and No. 295 of November 19, 1994 with whom and 'was rectified and integrated the above list of graduate schools; Considering that Article. 2 of the aforementioned Legislative Decree no. 257 of 1991 states that every three years to be determined the number of specialists to form the basis of the health needs of the country, taking into account the capacity 'receptive structures and financial resources available; Having regard to Legislative Decree 30 December 1992, n. 502, and subsequent amendments and additions; Considering that, pursuant to paragraph 2 of art. 6 of the aforementioned Legislative Decree no. 502 of 1992, in order to plan the number of specialists to be trained, it must also take into account the specific needs of the national health service linked to the provisions on access to the leadership in art. 15 of the same decree; Considering that, pursuant to art. 16 of the Legislative Decree n. 502 of 1992, specialized training is carried out full-time participation in the totality 'of the attivita' medical and the gradual assumption of care tasks; Given the decrees of the Minister of Health 'in consultation with the Minister of the University' and Scientific and Technological Research and the Minister of the Treasury, by 17 December 1991 and 17 May 1995, with whom and 'was determined in total 6,500 united 'the annual needs of medical specialists to form in graduate schools for three-year periods 1991/1993 and 1994/1997; Given the overall need of health services for the 1997/2000 triennium communicated by the individual regions and autonomous provinces; Considered that the above regional forecasts and autonomous provinces are to be assessed with reference to the performance epidemiologically related to particular classes of diseases, the development of diagnostic and therapeutic guidelines, the methods of intervention and the performance of specific socio-demographic groups of the population; Considered, altresi ', the role of some sectors of employment outside the NHS and the different flexibility' of use of the various specializations, including in relation to the possibility 'offers from circulation in Europe; Given the expected number of young people who will graduate in medicine and surgery in the next three years and the number of those already 'graduates who have failed to enroll in a graduate school; Therefore considered to determine the requirements for the academic years 1997-98, 1998-99 and 1999-2000 in 6,000 specialists annually, subject to any changes that may be necessary as a result of the reorganization process of health services and any changes the type of graduate schools; It decided to establish simultaneously, for each specialization, the total number of bags to be distributed among the individual schools in relation to the available financial resources and the needs of medical specialists; Considered the need to enable the trainees to carry out activities' training necessary for their professionalization using appropriate quantitative and qualitative parameters, to share the same time the predicted number of specialists and scholarships among the various autonomous regions and provinces in relation to total volume of care, for each discipline, health facilities present within the territory of each region and autonomous province, at the national level through the DRG; Given the opportunity 'to apply this additional programming policy in the academic 1998-1999; Considering that, in the academic year 1997-98, the holders of the State grants, enrolled in years subsequent to the first course, a total of about 16,470 at a cost, for the 1997-98 academic year, Lit. about 370 billion; Given the availability 'in the balance sheet total, amounting to Lit 487 500 000 000 intended to finance the training of specialist doctors referred to 172.5 billion lire in accordance with art. 6, paragraph 2, of the law 29 December 1990 n. 428, and 315 billion lire in accordance with art. 32, paragraph 12 of the Law of 27 December 1997, n. 449; Considering that, for grants not allocated or not fully take advantage in the academic year 1996-97, were ascertained total amounts to 13.473 billion lire; It considered that such amounts can be used to finance additional scholarships, given the specific purpose of the sums in question; Considering that, on the basis of the indicated availability 'budget Lit. 487.5 billion, as well as' the aforementioned economies around Lire 13 billion, are available lire 500.5 billion for the funding of scholarships; Since lire 370 billion are destined to graduate already 'enrolled in the academic year 1996-97 and previous years; Therefore considered that there are available for scholarships to be awarded to members in the first year of the course of the academic year 1997-98, cash of about 130 billion lire; Considered, in relation to available financial resources, to determine in 5,575 units' bags to be assigned to members of the first year in the academic year 1997-98; In view of art. 1 of the law 28 March 1997 n. 82, which provides that, notwithstanding the provisions of Decree-Law of 11 June 1996 n. 314, converted into Law July 3, 1996, n. 43, any surplus allocated to graduate schools in the academic year 1995-96 are deducted from those to be allocated in the academic year 1997-98, in the context of the Article programming. 2 of Legislative Decree of 8 August 1991, n. 257; Considered, in implementation of the prescription of the law n. 82 of 1997, to deduct from 5,575 seats to be allocated in the academic year 1997-98 the 925 extra places allocated in the academic year 1995-1996; Therefore considered to determine in 4,650 scholarships to be awarded in the academic year 1997-98; It decided to proceed to the determination of the scholarships for the academic years 1998-99 and 1999-2000 in subsequent provisions in relation to the annually available financial resources; The Order of the President of the Republic March 10, 1982, n. 162, and in particular, Article. 2, paragraph 5, which provides for a rate of additional seats, no more than 30% of the ordinary, to be reserved, in graduate schools, medical employees by the institutions and structures affiliated with the University '; Considering that, pursuant to art. 6, paragraph 2, of Legislative Decree n. 502 of 1992, the hospitals, the units' local health and the health institutes in a scientific nature are necessarily involved in the training of interns and that, therefore, called on the 30% limit to be considered passed against the medical personnel service in the aforesaid facilities at which the training takes place, recognizing to the personnel the right to participate in training in the discipline of membership notwithstanding the predicted maximum limit; Considered, therefore, that all medical personnel on duty at the facilities where the training takes place should be permitted surplus to specialized courses in the discipline of belonging, to the extent and in the manner 'set out in memoranda of understanding between the universities' and regions; Having regard to Articles 15 and 18, paragraph 2-bis and 3, of the aforementioned Legislative Decree no. 502 of 1992 concerning access to the initial functional position of the medical professional profile; In view of art. 16 of the aforementioned Legislative Decree no. 502 of 1992 which provides that the medical training involves participation in guided or direct to totality 'Activities' health, including preventive medicine, the guards, the attivita' of first aid, the activities' outpatient and activities' surgery for surgical disciplines as well as' the gradual assumption of care tasks and the implementation of actions autonomously bound by directives received; Decrees: Art. 1. 1. For the academic years 1997-98, 1998-99, 1999-2000 annual needs of medical specialists to form in the graduate schools of Articles 1 and 8 of the Legislative Decree of 8 August 1991, n . 257, and 'resulted in 6,000 doctors, like the chart 1, which forms an integral part of this Decree.
