THE MINISTER OF INDUSTRY TRADE AND CRAFTS the Order of the President of the Republic March 23, 1998, n. 126 on the regulation laying down rules for the implementation of Directive 94/9 / EC concerning equipment and protective systems intended for use in potentially explosive atmospheres; In view of art. 8, paragraph 1 of the Decree of the President of the Republic March 23, 1998, n. 126, which provides for the authorization procedures of the certification bodies; Given the Ministerial Decree of 1 March 1983 concerning the designation of the institution authorized to carry out an examination of the electrical equipment for use in potentially explosive atmospheres and the relevant certificates, issued pursuant to art. 8 of the decree of the President of the Republic July 21, 1982, n. 727; Given the Ministerial Decree of 19 June 1990 on the appointment of the CESI (Italian Experimental electro-technical center) Giacinto Motta di Milano, as a body charged with examining the material and for issuing certificates of conformity 'and control for electrical equipment intended for used in gassy mines and mining operations in the area who are at risk of coming in contact with the grisu ', issued under law 17 April 1989 n. 150; Having regard to Directive 94/9 / EC on equipment and protective systems intended for use in potentially explosive atmospheres; Having regard to Community Law 1994, art. 4, Annex C; Given the authorization application submitted by CESI on to operate in accordance with Directive 94/9 / EC; Given the need 'and the urgency of the Italian manufacturers certify products in accordance with Directive 94/9 / EC; Given that the new Directive 94/9 / EC is the evolution of the existing Community legislation and is' based on similar principles and requirements for the safety of equipment for explosive atmospheres, and allows the adjustment of the certification process to the updated EU rules; Given the opportunity 'to extend the designation and obligations set out in the Ministerial Decree of 1 March 1983 and the Ministerial Decree of 19 June 1990 also for equipment and protective systems provided for in Directive 94/9 / EC, pending enactment of Ministerial decree that sets the requirements for definitive authorization of the certification bodies; Decrees: Art. 1.
