The AUTHORITIES 'FOR ELECTRICITY AND GAS its meeting of 22 December 1999; Given that: in accordance with art. 2, paragraph 14, of the law 14 November 1995 n. 481 (hereinafter: Law no. 481/1995) shall be deemed transferred to the Authority 'for Electricity and Gas (hereinafter: authorities') all the administrative functions exercised by state bodies and other bodies and public administrations, including autonomous, relating to its powers; pursuant to art. 3, paragraph 1, of Law no. 481/1995, are especially transferred to the authority 'functions in the field of electricity and gas attributed by art. 5, paragraph 2, letter b) of the Decree of the President of the Republic 20 April 1994, n. 373, the Minister of Industry, Trade and Crafts; between the above functions include those relating to the supply of natural gas price controls as required by resolutions of the Interministerial Economic Planning Committee (hereinafter: CIPE) June 26, 1974 and September 20, 1974; some associations have reported to the authority 'that the price of natural gas in Italy, net of taxes, are on average higher than those charged in the other EU Member States; prices of oil and its derivatives have been during 1999 a sharp rise and tariffs, for the part related to the cost of raw material, in the service of distribution of gas in the middle of urban networks, they are indexed to those prices under the resolution of the authority 'April 22, 1999, n. 52/1999, published in the Official Gazette - General Series, no. 100 of 30 April 1999 (hereinafter: Resolution no. 52/99); Having regard to the Decree Law 19 October 1944, n. 347, Legislative Decree of the Provisional Head of State 22 April 1947, n. 283, and the decree of the President of the Republic March 30, 1968, n. 626; Having regard to Directive 98/30 / EC of the European Parliament and of the Council of 22 June 1998 concerning common rules for the internal market in natural gas, published in the Official Journal of the European Communities', L 204 of 21 July 1998; The resolutions of the CIPE June 26, 1974 and September 20, 1974, by which it is expected that the gas (industrial, natural and technical) distributed by means of urban networks for domestic use, trade and industrial is subject to administered price system and that natural gas sales prices are subject to the regime of supervised prices; Given the decision of the Interministerial Committee of prices December 23, 1993, n. 16/1993, published in the Official Gazette - General Series - n. 303 of 28 December 1993, as amended by Decree of the Minister of Industry, Trade and Crafts August 4, 1994, published in the Official Journal, - general series - n. 184 8 August 1994 and the Decree of the Minister of Industry, Trade and Crafts of 19 November 1996 published in the Official Gazette - General Series - n. 300 of 23 December 1996; In view of art. 5 of the Regulation laying down general provisions on the operation of procedures for the formation of the Authority 'competence decisions, approved by that Authority' with Resolution 20 May 1997, n. 61/97; The resolution of the Authority 'April 23, 1998, n. 40/98, which initiated the procedure for the formation of the measure to fix and update, in relation to market trends, in gas tariffs as required by art. 2, paragraph 12, letter e) of Law no. 481/1995 and the decision of the Authority 'April 22, 1999, n. 52/99 published in the Official Gazette - General Series - n. 100 of 30 April 1999 defined the criteria for the indexation of tariffs in the gas distribution service in the midst of urban networks, for the part related to the cost of raw materials; Considering that: by resolution 28 October 1999, n. 164/99, the Authority 'has requested information and documents relating to the natural gas networks and infrastructures to Snam Spa, Edison Spa and Spa Sgm also to define the technical and economic conditions of access and interconnection to the gas network pursuant to art. 2, paragraph 12, letter d) of Law No. 481/1995;
