THE MINISTER OF AGRICULTURE AND FORESTRY Having regard to Law 18 June 1931 n. 987, containing provisions for the protection of crops and agricultural products from enemy causes and related services, as amended; Having regard to Regulation for the application of the law, approved by Royal Decree of 12 October 1933, n. 1700, as amended by Royal Decree of December 2, 1937, n. 2504; Given the Ministerial Decree of 11 July 1980 which transposed the Directive EEC No. 77/93 / EEC of 21 December 1976 on protective measures against the introduction into the Member States of organisms harmful to plants or plant products and further modifications; Having regard to Legislative Decree 30 December 1992, n. 536, concerning the implementation of Council Directive no. 91/683 / EEC of 19 December 1991 on protective measures against the introduction into Member States of organisms harmful to plants and plant products; Given the Ministerial Decree of 31 January 1996 on protective measures against the introduction and spread in the territory of the Italian Republic of organisms harmful to plants or plant products; Having regard to Legislative Decree 4 June 1997, n. 143, entitled "Contribution to the regions of administrative functions in the field of agriculture and fisheries, and central administration reorganization"; Given the Ministerial Decree of 6 March 1996, transposing Commission Directives No. 95/65 / EC and n. 95/66 / EC of 14 December 1995 concerning the amendments to the Annexes to the Ministerial Decree of 31 January 1996 concerning protective measures against the introduction and spread in the territory of the Italian Republic of pests of plants and plant products; Given the Ministerial Decree of 19 February 1997, transposing Commission Directive n. 96/78 / EC of 6 December 1996 on amendments to the annexes of the Ministerial Decree of 31 January 1996 concerning protective measures against the introduction and spread in the territory of the Italian Republic of pests of plants and plant products; Given the Ministerial Decree of 27 November 1997 transposing Commission Directives No. 96/14 / EC of 12 March 1996, n. 96/15 / EC of 14 March 1996, n. 96/76 / EC of 29 November 1996 and No. 97/14 / EC of 21 March 1997, which amend certain annexes to Directive n. 77/93 / EEC as well as' the Directive n. 92/76 / EEC recognizing protected zones exposed to particular plant health risks in the Community '; Given the Ministerial Decree of 13 February 1998 transposing Commission Directive n. 97/46 / EC of 25 July 1997 amending Directive No. 95/44 / EC laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I, II, III, IV and V of the Directive. 77/93 / EEC may be introduced or transferred from one place to another in the Community 'or certain protected zones thereof, for trial or scientific purposes and for work on varietal selections; Given the Ministerial Decree of 9 July 1998 transposing Commission Directives No. 98/1 / EC and n. 98/2 / EC of 8 January 1998 which amend certain annexes to Directive n. 77/93 / EEC on protective measures against the introduction and spread within the Community 'of organisms harmful to plants and plant products; Given the Ministerial Decree of 19 October 1998 implementing Directive No. 98/22 / EC of 15 April 1998 fixing the minimum conditions for carrying out plant health checks in the Community ', at inspection posts other than the place of destination, of plants, plant products and other objects coming from third countries; Having regard to Legislative Decree 22 May 1999, n. 192, that 'implementation of the Directive. 97/3 / EC amending Council Directive n. 77/93 / EEC on protective measures against the introduction into the Community 'of organisms harmful to plants or plant products and against their spread within the Community'; Given the Ministerial Decree of 8 July 1999 transposing Directive no. 1999/53 / EC of 26 May 1999 amending Annex III of the Directive. 77/93 / EEC on protective measures against the introduction into the Community 'of organisms harmful to plants or plant products and against their spread within the Community'; Having regard to legislative decree 30 July 1999 n. 300; Having regard to the Commission Directive n. 98/57 / EC of 20 July 1998 on the control of Ralstonia solanacearum (Smith) Yabuuchi et al .; Given the need 'to implement the Commission Directive n. 98/57 / EC of 20 July 1998 cited above; The favorable opinion of the Standing Conference between the State, regions and autonomous provinces of Trento and Bolzano expressed at its meeting on February 10, 2000, pursuant to art. 2, paragraph 4, of Legislative Decree 28 August 1997, n. 281; Under Article. 20, paragraph 1, of the law 16 April 1987 n. 183, and Art. 8, paragraph 1 of Legislative Decree 30 December 1992, n. 536; Decrees: Art. 1. A IMS '1. This ordinance is intended the plant health measures to be taken on the territory of the Italian Republic to fight the harmful organism Ralstonia solanacearum (Smith) Yabuuchi et al., Already' known as Pseudomonas solanacearum (Smith) Smith, (hereinafter indicated: Rs), of bacterial agent of the Solanaceae with specific reference to the host plants listed in Annex I, section 1. the fight to Rs aims to: a) locate it and determine the distribution; b) prevent its occurrence and spread; c) to prevent its spread and implement phytosanitary measures for its eradication if found.
