GOVERNMENT COMMISSIONER view the order of the President of the Council of Ministers no. 2409 of 28 June 1995, at which the president of the regional council and 'was appointed, pursuant to art. 5 of the law 24 February 1992 n. 225, government commissioner for the water emergency in Sardinia; Given the order of the President of the Council of Ministers no. 2424 of 24 February 1996, with which you have made changes and additions to the above order no. 2409/1995; The Order of the President of the Council of Ministers of 13 December 2001 and which 'was extended, finally, the water emergency in Sardinia until the date of 31 December 2003; View the order of the Minister - Delegate for civil protection n. No 3196/2002. 3196 of 12 April 2002, Articles 13 and 14; Given that, pursuant to art. the President of the Ordinance of the Council of Ministers no. 2409/1995, the government commissioner, and 'it was delegated to define a program of measures necessary to cope with the emergency situation; Given the orders n. 25 of 31 December 1995, n. 42 of 20 May 1996, n. 52 of 9 August 1996, n. 111 of 17 November 1998 and No. 128 of 28 December 1998 and No. 148 of 16 July 1999, n. 152 of 26 July 1999, n. 171 of 11 November 1999 and No. 255 of 23 October 2001, n. 268 of 24 October 2001, n. 296 of 19 June 2002, with which the commissioner's actions to overcome the water emergency in Sardinia have been identified; Given that in order to examine the situation of water supply of the city 'of Carbonia, was' done on May 7, 2002, in Villa Devoto, a meeting between the President of the region, the Mayor of the municipality of Carbonia, the commissioner public works of the municipality of Carbonia, the President of the industrialization of Portovesme core Consortium, President ESAF, the director general of the Presidency, the director general of the Office of public works; Since in the course of that meeting we have been jointly identified several solutions, including the implementation of the intervention of "Adaptation and upgrading of the drinking water of San Giovanni Suergiu" for a total amount of Euro 1,050,000, to be carried by ESAF, with the use of all emergency procedures in derogations from law and indicating to predict the performance of works with more 'shifts; Since by order no. 274 of 1 February 2002 and 'was arranged interruption of the transfer of resources from the reservoir Cixerri all'invaso Bau Pressiu aqueduct and the consequent power of Sulcis by the Bau Pressiu resources, pending the definition of intervention the upgrading of drinking water of San Giovanni Suergiu, for use of the reservoir resources Monte Pranu; Since the ESAF with protocol note. 4823 of 30 May 2002, in connection with the imminent depletion of stocks of Bau Pressiu tank he has asked the restoration, with utmost urgency, water transfers from Cixerri for water supply of the municipalities served aqueduct of Sulcis; Given that with the restoration of this connection will be used resources of Flumendosa-Campidano system that are already 'current affairs' insufficient to meet the needs until the end of the current year; Since the urgent completion of the work of upgrading the drinking water of San Giovanni Suergiu it allows the use of water resources available in the reservoir of Monte Pranu with saving the very reduced availability 'of water Campidano and at the same time giving the chance 'to address the situation of serious aqueduct water emergency Sulcis; Since the aforementioned ordinance no. 255/01 provides, among others, the following interventions that have not yet commenced: ----> Table <---- Expected therefore, that, pending the acquisition of additional financial resources for the immediate implementation of 'intervention of the upgrading of the drinking water of San Giovanni Suergiu, can use the financial resources allocated to the above measures, for the' amount of Euro 1,050,000;
Since the eventual failure to deliver water resources, resulting in the reduced resources available at present, can result in serious health and hygiene problems as well as' public order and that therefore the conditions for the use of the procedure of realization in the utmost urgency, as regulated by decree of the President of the Republic December 21, 1999, n. 554, entitled "Regulations for the Implementation of the law 11 February 1994 framework law on public works, as amended; Since art. 147 of the aforementioned decree of the President of the Republic n. 554/1999 establishes in Euro 200,000 the maximum threshold the works executed in utmost urgency is deemed necessary to authorize the ESAF to proceed in disregard of the rule cited above; Order: Art. 1. the table of the interventions of the "program commissioner of works and interventions designed to cope with the water emergency in Sardinia" , in art. 1 of the Ordinance no. 255 of 23 October 2001, for the reasons set out above and 'cosi' modified: ----> Table <---- the allocation of any additional resources for the implementation of the intervention n. 14 of the above art. 1 will be 'it made following the establishment of the elaborate design of the intervention itself.
