THE MINISTER FOR THE ENVIRONMENT AND THE TERRITORY in concert with THE MINISTER FOR HERITAGE AND ACTIVITIES 'CULTURAL view of the art. 6, paragraph 2 and following of the Law of July 8, 1986, n. 349; The Order of the President of the Council of Ministers of 10 August 1988, n. 377; The Order of the President of the Council of Ministers of 27 December 1988 on "Technical standards for the preparation of environmental impact studies and formulating their assessment of Compatibility 'in art. 6 of the Law of 8 July 1986, no. 349 , adopted pursuant to art. 3 of the decree of the President of the Council of Ministers of 10 August 1988, n. 377 "; In view of art. 18, paragraph 5, of the law 11 March 1988 n. 67; the decree of President of the Council of Ministers on 2 February 1989, the Commission's memorandum to the environmental impact assessment and subsequent amendments and additions; the decree of the Minister for the Environment of 13 April 1989 on the organization and operation of the said Commission; the decree of President of the Council of Ministers of 15 May 2001 to renew the composition of the Commission for Environmental Impact Assessments; Given the demand for compatibility 'environmental ruling concerning the project for the airport development plan for the airport "Galileo Galilei" of Pisa - San Giusto, to be built in the municipality of Pisa presented by the Societa' Tuscan Airport (SAT) Galileo Galilei Spa , based in Galileo Galilei Airport - 56100 Pisa, on 10 April 2000; supplementary documents views transmitted by the Societa 'Tuscan Airport (SAT) Galileo Galilei Spa on July 5, September 28, 2000 and February 13, 2001; Note view n. 108/4921 / 09.02.01 of the Tuscany region of 7 August 2001, received August 14, 2001, which expresses a favorable opinion; Note view n. ST / 414/23191 of the Ministry of Heritage and Activities' cultural of 25 October 2000, received on October 31, 2000, which expressed a favorable opinion; Having consulted n. 434 issued on 3 October 2001 by the Commission for environmental impact assessments, following the investigation on the draft submitted by the Company 'Tuscan Airport (SAT) Galileo Galilei Spa; Given that in that Opinion the Commission noted that the technical documentation provided is a project of airport development aimed at adapting the current structure to the needs of development of traffic; Given that: the programmatic profile, the Airport Development Plan (PSA) allows to adapt the airport facilities to the objectives expressed by the Regional Conference of Tuscan transport (June 1997) which defined a Tuscan airport system consisting of the ports of G.Galilei Pisa and Florence A. Vespucci; This prediction is confirmed by the spatial address Plan adopted by the Tuscany regional government in 1998. The strengthening of forecasts and the development of activities 'civil airport and' also provided by the Territorial Coordination Plan of the Province of Pisa and the Structure Plan of the town of Pisa, both approved in 1998. in particular, the PS of the municipality of Pisa has welcomed the comments made by SATSpA relative to bonds initially foreseen in as conflicting with development interventions; concerning design, interventions deemed most 'significant level, and on which you and' d concentrate the environmental impact study, include: expansion of aircraft aprons; short and long-term parking; New building "A" (admission ramp vehicles, catering, state agencies, support services, underground parking); new cargo terminal and hangars aircraft; buildings for airport users services (activities' management and commercial); parkade expansion; building activities' accommodation; building for airport services, government agencies, airlines; expanding the passenger terminal;
the planned interventions are designed in view of the expected significant increase in passenger traffic (1.2 million passengers in 2000 to 2.1 million in 2010) and goods (8.6000000 to 22,000,000 tons). The necessary space to extensions will be found in part by acquiring areas currently available to the Air Force, and partly expanding the airport area through the acquisition of areas located in the north-east of the perimeter. Altogether, the surface of the airport boundary increase 'of about 100,000 m2, from 406 to 416 has around; far more 'significant is the increase of the airport area destined to the attivita' civilians who pass' from 194,000 to 471,000 m2; environmentally the SIA has taken into account the potential impact of implementation of the works and included in the PSA As for noise, the measurements and simulations carried out with reference to the current situation and future scenarios may limit the 'area of impact in the neighborhood Airport, even though there are some elements of uncertainty, mainly referring to the total absence of data relating to the Air Force's movements. The forecast scenarios (2005 and 2010) define an evolutionary framework characterized by the sound footprint reduction at ground level, in terms of ricompresa surface within isofone LVA reference. As regards air pollution, simulations carried out lead to the conclusion that, currently, the maximum concentrations of nitrogen dioxide hypothesized on an hourly basis in the maximum relapse situation simulated, they are lower by at least a factor of 5 for current and future limits; the future situation (2010) the maximum concentrations remain below the meta 'of current and future legal limits. Estimated that: the forecast scenarios elaborated by the proponent from the year 2010, based on IATA estimates, make up a substantial increase in passenger movements at the airport Galileo Galilei and goods; the expected increase in movements and 'consistent with the regional programmatic determinations, which identify the airport of Pisa one of the two Tuscan airport poly (along at Florence airport "Amerigo Vespueci"). The airport facilities are currently inadequate to the increase expected; The PSA provides for a radical reorganization of airport facilities landside and airside, as part of a substantial increase of the airport area; This increase relates to the bulk transfer of land currently in use Air Force civilian target, while remaining Pisa airport a military airport open to civilian traffic; the reorganization and modernization of the surfaces of the structures allow you to re-engineer the system for the disposal of water run-off of the yards, providing for the collection, treatment by disabbiatura and oil extraction and subsequent transfer by sewerage, sewage treatment plant to the public; estimates relating to the physical impact of the airport traffic (air and noise pollution) are sufficiently documented and detailed, consistent with the military status of the airport infrastructure; regarding in particular the contribution of the activities 'airport to air pollution, as is evident from the calculations carried out and that' in the current situation, limited, even imputing the runway all releases estimated with reference to the entire LTO cycle ; this situation remains substantially unchanged also in the future scenario (2010), in correspondence of which the contribution of the airport to the concentrations of nitrogen dioxide provided throughout the area and in particular in built-up areas is kept low; compared to the current scenario (1999), the future scenario (2010) is characterized by a significant increase of the predicted concentrations in the airport area, while remaining such concentrations at much lower values for current and future limits of quality 'air; with regard to noise pollution, estimates made lead to the conclusion for a reduction in the size of the areas included within isofone reference, as you can 'believe that the effect of reducing noise emissions resulting from the gradual replacement of the park aircraft with low-emission models proves the predominant compared to the expected effect against the increase of the movements;
despite the assessment referred to above, there remain some areas of potential criticality 'Airport in the neighborhood as well as' some potential impact situations, mainly determined at take-offs to the north; Given that conclusion, the Commission for environmental impact assessments gave a positive opinion on the compatibility with requirements' proposed work environment; Considered the note. 108/4921 / 09.02.01 of the Tuscany region of 7 August 2001, received August 14, 2001, which expresses a positive opinion on the condition that they comply with the following requirements: 1) the proposer must adopt suitable techniques to reduce production or spread of dust, such as: wetting of the slopes not paved in cementitious or bituminous conglomerate; washing the tires of trucks leaving the airport site and the areas of supply and provision of materials; wetting and covering with tarpaulins of the material transported by trucks; wetting of the material heaps in site areas. 2) the applicant must agree with the Department ARPAT and the health authority of Pisa, the modalities' of svolgimnento 'of some detection campaigns of quality' air to be performed with the moving vehicle, to coincide with the years for which PSA plans to significantly increase air traffic. There must be a survey of the current state, before work; the relief of dust suspended at sensitive receptors during periods of greater activity 'of shipyards; periodic survey of pollutants incidental to air and vehicular traffic, in order to follow the effect due to the increase in traffic on the quality 'air. The monitoring will be carried out at the applicant's expense, which will send 'timely data to the municipality, and the company ARPAT health territorially concerned; 3) the construction phase, the applicant must comply with the limits for noise emissions from the Ministerial Decree 14 November 1997, possibly using the municipal exemption for activities' temporary, of which the Regional Council Resolution no. 77 of 22 February 2000, Part III, section 3.2 .. To this end, the proposer must make a noise monitoring at sensitive receptors. The monitoring will be 'made dependent on the propanente, who will send' timely data to the municipality, and the company ARPAT health territorially concerned; 4) with regard to the transport of materials, the proponent must prepare a monitoring program structured as follows. By 31 October each year, the applicant must submit to the municipalities affected by the passage of trucks in the directions "quarry or recycling center-site" and "site-landfill or recycling center" a program for the following year in which they are reported : the viabilita 'crossed, the towns and villages affected, the average and maximum number of trips / truck per day. The town, benefit from the advice of the Department ARPAT concerned, may 'provide for limitations to the traffic of heavy vehicles and / or permit the continuous monitoring of noise and dust suspended in the vicinity' of receptors sensitive places along the way. The monitoring will be 'made at the applicant's expense, which will send' timely data to the municipality, and the company ARPAT health territorially concerned; 5) housing alternatives for the inhabitants of the expropriated Via Cariola, must be agreed with the town of Pisa and accepted by the population; 6) the applicant must provide for an adequate treatment of a sufficient volume of rainwater, at least equal to 150% of first rain waters, also taking account of the need 'to have a reserve volume to prevent the spill on the territory of accidental spillage of propellant and other polluting liquid material; 7) as regards the noise produced during operability 'the applicant must comply with the following considerations: the identification of the boundaries of the areas of respect in the neighborhood Airport will be' the subject of further study by the committee referred to in Article. 5 paragraph 1 of the Ministerial Decree of 31 October 1997 must 'take account only of the airport master plan, the tools of regional and urban planning systems in force and noise abatement procedures that the Board and' required to establish;
ban on night flights from 23 hours to 6, subject to the exceptions provided for by law (emergency flights, humanitarian, post, etc.); the planned installation of a permanent system of monitoring of noise pollution in the neighborhood Airport must 'ensure on the one hand the respect of antinumore procedures in the individual movements and on the other the respect of the noisy input limits within the areas of respect, in particular within the area a, for which they are not established of intended use constraints. The fixed monitoring network must be made within 24 months of compatibility 'environmental ruling. Pending the completion of the permanent monitoring system, the proposer must secure the airport noise monitoring determined by civilian traffic, with a methodology to be agreed with the Department ARPAT of Pisa, feel the common and the health authority, at last: to provide guidance to Committee provided for in art. 5, paragraph 1 of the Ministerial Decree of 31 October 1997 in order to reduce the noise impact of the activities' airport; check the parameters used in the forecast acoustic model contained in the impact study; to provide to the municipality of Pisa, in the form disclosable to the people, information on the impact noise caused from the municipal area; the study does not show, in a direct way, the presence of settlements contrary to the intended use in relation to identified areas, while refers to the need 'to acquire a residential area overlooking the airport grounds at the end of the realization of the work in the project. In any case, even if the study fails to demonstrate the presence of incompatible settlements, notes in this connection the provisions of Ministerial Decree of 29 November 2000 on plans of containment interventions and reduction of aircraft noise; the study does not consider the rumorosita 'induced by the activity' military as expressly excluded from the scope of the existing legislation. Since 'the same can' not be negligible it is detected the opportunity 'to take charge of the problem on mixed joint committee provided for by art. 3 of Law no. 898/1976 and subsequent amendments; prohibition of landing aircraft that are not included among those of Chapter 3 ICAO annex 16, a year later in 2002, subject to the exceptions provided by law; 8) during the reconstruction works of the SGC ramps to and from 1'aerostazione, it must be suspended the transit of trucks or from the quarries to the landfill, including in relation to working in the PSA. And except in cases in which the maintenance of the existing road section when the SGC, or the case where the applicant agrees with the municipality of Pisa routes and timetables for the transit of trucks; 9) in the event that during the ANAS building site for lot 13 of the SGC is not maintained the current road section, it states that the applicant agreed with the municipality of Pisa routes and timetables for the transit of trucks related to airport construction sites; 10) the applicant, in agreement with the municipality of Pisa and the subject of SGG operator for assistance to install artificial noise barriers in the roadway frieze of SGC connecting ramps - air terminal, to protection of the existing buildings; 11) the mitigation, compensation and monitoring indicated in the environmental impact study must be implemented simultaneously with progress of work included in the PSA; 12) it is recommended to the municipality of Pisa: adjusting the planning instruments to the specifications in art. 7 of the Ministerial Decree of 31 October 1997, once the Commission will have specific 'approved the boundaries of the areas of compliance with art. 6 of the Ministerial Decree of 31 October 1997; bring forward the design solution of the overpass on the Genoa-Livorno railway for access to goods, that such infrastructure is to civil and military traffic service and that the work should be executed prior to the development of the airport fully operational freight traffic.
It should be noted, finally, the Ministry of the Environment the need to enable more 'appropriate forms of cooperation with the authorities' military to facilitate the activities' monitoring and control that will be necessary, taking into account the particular type airport . Considering the opinion of the Ministry of Heritage and Activities' cultural prot. n. ST / 414/23191 of 25 October 2000, received on 31 October 2000, in which it endorses the environmental impact assessment required, provided that you comply with the following requirements: the merits, the Superintendence for environmental goods, architectural, artistic and historic Pisa by letter prot. n. 5631 of 04/05/2000, here received on 8 May 2000, he expressed a favorable opinion and without prejudice, however, the quality 'of the new architecture built and proper planning of the green outline. The same Superintendence has altresi 'noted that interventions insist on an area located outside the perimeters of the bond landscape, far enough away from the Natural Park Migliarino San Rossore Massaciuccoli and the historic and monumental center of Pisa. The project in fact involves an area currently of little environmental value device but that 'borders on the Natural Park and is the filter between it and the City' historic. Interventions should therefore be made towards a redevelopment respecting through careful design of the green, the rural character of the area. In addition, the Archaeological Superintendence of Tuscany - Florence, with prot. n. 14384 of 20 June 2000, received here on June 23, 2000, prot. n. ST / 414/14433/00, gave a favorable opinion to the realization of the work in the project provided that "... if, during work involving removal of soil or sub-surface, may occur in material discoveries or archaeological deposits, and 'obliged to immediately suspend the works and notify this office promptly or more' nearby police station. this Ministry, examined the acts, after considering the various legal provisions mentioned in the subject, view the documentation submitted by Soc.ta ' environment in a note dated March 27, 2000, and produced before the Court on 6 April 2000, with Protocol. ST / 409/8112, and in accordance 'with the views expressed by the competent Superintendents, believes it can express a favorable opinion to such a request for compatibility 'environmental ruling for the development plan of the airport of Pisa according to the requirements imposed by the Superintendency with the notes above. Noting that received instances, comments or opinions from citizens, in accordance with art. 6. Law No. 349/1986, for the ruling request on compatibility 'environmental consultant indicated that briefly below are reported: company USL 5 - Prevention Department - UO hygiene and health' public - Pisa. construction phase. In order to limit the inconvenience caused by traffic of vehicles engaged in the activities' of the construction site and the materials transported by them, the following precautions should be taken: follow paths that avoid passing through residential areas and not causing an obstruction to vehicular traffic, identifying the more 'time appropriate for transit; washing the tires at the exit of the building site; the collection material transported must 'be covered in order to avoid the dispersion of the powder into the atmosphere; humidification of the yards and heaps in the yard; installation of anti dust screens in the yard. in scheme phase. Atmospheric emissions: Regarding pollution arising from the activities' airport, in the study were considered to CO, CO 2, NO x, SO x and VOC. The estimated increase in these pollutants when the development plan Airport will be 'completed (2010) will be' more than 70% for VOC and about 100% for all other parameters. The increase will cause the road traffic ', for each of the parameters taken into account (CO, HC, NO x, SO 2 and dust), an increase of about 60%. These increases will result in the inevitable increased concentrations of secondary pollutants first of all ozone that recognizes the NO x and VOCs in its main precursors. The impact on air matrix must be carefully assessed and have to check which of the mitigation measures proposed in the study, may be implemented. Noise:
in order to contain the rise in rumorosita 'caused by the increase in air traffic, it remains to evaluate the effectiveness of the interventions prescribed by the regulations to be adopted; It must 'be maintained the direction of north-south flight (except in exceptional cases) to avoid overflights over the city' and night flights will be banned (from 23 to 6); and 'to be considered the greatest impact that the increase in air traffic potra' cause the area of Coltano and all those living there. This location 'fact' to the south of the city 'and then will be' affected by overflights in the area which are among other things at low altitude due to proximity to the airport. It would be to provide for a provisional verification of noise and air pollution impact on this town; and 'to assess the problem represented by the Via Cariola residents who will be turned away following the expropriation of the area and whose homes will be demolished; Deemed it necessary to provide for the terms and for the effects of paragraph 4 of Art. 6 of Law no. 349/1986, the pronunciation of compatibility 'sopraindicata work environment; It delivers a favorable judgment on the compatibility 'environmental project related to airport development plan of the airport "Galileo Galilei" of Pisa - San Giusto to be built in the municipality of Pisa presented by the Societa' Tuscan Airport (SAT) Galileo Galilei Spa provided it complies with the following requirements: a) preliminary startup of the operations covered by the structure Plan Airport (PSA) must 'be prepared an environmental redevelopment of the areas included within the margin Airport not intended for operational use. In particular, in compensation for the waterproofing of new surfaces is considered appropriate to carry out interventions such as gratings parking in draining green background, green roofs roof of the buildings, tanks ecosystem filter for water draining output; such interventions can be designed and manufactured unless interfering with the functionality 'of the airport operations; b) the volume of stormwater to be treated should be determined on the basis of total sealed areas and the estimated capacity in the event of critical rain correspondence (925 l / s) increased by 50%, even taking into account the need 'to have a reserve volume to prevent sversaniento the territory of accidental releases of polluting liquid propellants or other material; c) considered the considerable extension of the area that will be 'waterproofed and also the presence of surface water tables that are fed from these areas, it requires the realization of a phreatic levels of the monitoring system that allows to highlight any impacts induced by the implementation of the works in the project and early identification of related mitigation and / or compensation measures. d) must be complied altresi ', where not included in earlier, all regulations and recommendations identified by the Tuscany Region and the Ministry of Heritage and Activities' cultural, appear in full in the introduction. It provides that this decision be communicated to the Company 'Tuscan Airport (SAT) Galileo Galilei Spa, Enav, ENAC, at the Ministry of Transport and DiCoTer infrastructure and the Tuscany region, which provide' to deposit it at the office established by section. 5, paragraph 3 of the Decree of the President of the Council of Ministers no. 377 of 10 August 1988 and to bring it to the attention of other authorities possibly concerned.
