The INTERMINISTERIAL COMMITTEE FOR ECONOMIC PLANNING having regard to Council decision 93/389/EEC of the Council of the European Union, as amended by decision 1999/296/EC establishing the monitoring mechanism for CO2 and other greenhouse gas emissions within the community; Having regard to the Commission communication COM/2000/88 of March 8, 2000 which identifies the lines of development of European policies and measures for the implementation of the Kyoto Protocol, with particular reference to energy, transport, agriculture, industry, fiscal measures, to scientific research and the development of new technologies, and the use of flexibility mechanisms; View the January 15, 1994, law No. 65, of ratification of the United Nations Framework Convention on climate change, adopted in New York in 1992, concerning the "stabilization of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous interference of human activities to climate system"; Having regard to Council decision 2002/358/EC, no April 25, 2002 concerning the approval, on behalf of the European Community, of the Kyoto Protocol to the framework Convention and the joint fulfilment of commitments thereunder that Italy leads to a reduction of greenhouse gas emissions to the extent of 6.5% from 1990 levels by the period between 2008 and 2012; Having regard to European Parliament and Council decision No 1513/2002 of June 27, 2002 to the adoption of the sixth framework programme of the European Community for research, technological development and demonstration "which identifies among the seven priority research themes of the specific programme" Integrating and strengthening the European Research Area "that of" sustainable development, global change and ecosystems "(sixth priority), including the research activities on energy and transport; Having regard to the Legislative Decree March 31, 1998, # 112, which transfers to the regions and local authorities more environmental and energy functions and competence; Having regard to act December 23, 2000, n. 388, that art. 110 established the institution of a "Fund for the reduction of atmospheric emissions and for the promotion of energy efficiency and sustainable sources of energy"; Having regard to the Legislative Decree May 18, 2001, # 227 on "orientation and modernization of the forest sector"; Having regard to act March 1, 2002, n. 39, which delegates to the Government the transposition of Council Directive No. 2001/77/EC on the promotion of electricity from renewable sources in the internal electricity market; Having regard to act June 1, 2002, # 120, by ratifying the Kyoto Protocol and the UN Framework Convention on climate change and, in particular, article. 2, paragraph 1, which provides that the Minister of environment and land protection in consultation with the Minister of economy and finance and other ministers concerned, attending this Committee a national action plan for the reduction of greenhouse gas emissions and the increase of their absorption in order to achieve the emission reduction targets with the least cost; Having regard to its resolution November 19, 1998, # 137, (Official Gazette No 33 of February 10, 1999) approving the "guidelines for national policies and measures for reducing greenhouse gas emissions"; Given the subsequent resolutions with which this Committee has approved the following national programmes, in accordance with the above guidelines: "white paper on renewable energy sources"-August 6, 1999, resolution # 126, (Official Gazette No. 253 of October 27, 1999);
"National programme for the development of agricultural and forestry biomass"-December 21, 1999, resolution # 217, (Official Gazette No. 59 of March 11, 2000);
"National programme for information on climate change"-December 21, 1999, resolution # 218, (Official Gazette No. 51 of March 2, 2000);
"National program for climate research"-December 21, 1999, resolution No. 226, (Official Gazette No 56 of March 8, 2000);
"National biofuels Program (PROBIO)-acting February 15, 2000, n. 27, (Official Journal No. 113 of May 17, 2000); Having regard to its resolution April 19, 2002, # 35, (supplement to the Official Journal No. 199 of October 22, 2002) approving guidelines for science and technology policy of the Government in which, in particular, the areas of the environment, energy and transport are considered among those in higher socio-economic relevance; Having regard to the communication of the Commission of the European Union, COM (2001) 581, on the proposal for a European Parliament and Council directive establishing a scheme for trading greenhouse gas emission allowance trading in the community and amending Directive 96/61/EC; Taking into account the findings of the Seventh Conference of the parties to the United Nations Framework Convention on climate change (COP 7) held in Marrakech from 29 October to November 9, 2001, whose decisions regarding the implementation of the Kyoto Protocol have: a) reconfirmed the commitment of the countries "Annex I" (industrialized countries and countries with economies in transition) to reduce emissions of the six main greenhouse gases , not controlled by the Montreal Protocol for the protection of the ozone layer, located in: carbon dioxide (Co2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs) and sulfur hexafluoride (SF6);
b) established the use of flexibility mechanisms set up by unlimited to the three Kyoto Protocol to complement national actions with the realization of joint actions between Countries "Annex I" (JI), or through cooperation with developing countries "not Annex I" (Clean Development Mechanism-CDM), or through the international trading of emission permits (Emissions Trading-ET);
c) recognized the role of forest management activities, management of agricultural soils and pastures and revegetation to achieve the objectives set by the Kyoto Protocol, as long as these activities are induced by human activities are, and they began after 1990. In particular, the limits on the use of forest management for each country were set equal to 15% of the net increase in forest carbon stocks are managed. These values are reflected in Appendix Z the political agreement in Bonn (COP 6 bis) and to Italy that limit it was set at a level equal to 0.18 Mt of carbon per year (equivalent to 0.66 mtco2);
d) recognized, without limitation, the role of carbon absorption achieved through national afforestation and reforestation measures undertaken since 1990 (base year of the Kyoto Protocol), to achieve the goals set by the Kyoto Protocol;
e) recognized the role of afforestation and reforestation activities under the JI mechanism;
f) recognized the role of afforestation and reforestation activities under the CDM, as long as these activities are additional and have commenced after 2000. Out of these activities shall apply the limit of 1% of 1990 emissions, which for Italy is approximately 5 MtCO2; Having regard to the note # 2002/GAB/10007/C of October 8, 2002 by which the Minister of environment and territory sent the plan referred to in art. 2, paragraph 1, of law No 120/2002 before mentioned;
Takes note of the programmatic framework, outlined in the corporate plan by the Minister of the environment and territory, and in particular: a. greenhouse gas emission values for the year 1990 and for the year 2000, reported in table 1, drawn up on the basis of the data submitted to the Secretariat of the United Nations Framework Convention on climate change and the European Commission in the framework of decision 93/389/EEC , invoked in the introduction;

Is approved the national action plan for the reduction of greenhouse gas emission levels and increasing their absorption drafted by the Ministry of environment and territory pursuant to art. 2 June 1, 2002, law No. 120, annexed to this resolution. 2. emission levels assigned to individual sectors for the period 2008-2012, the latter calculated as the average of the annual emissions for the period set out in table 8 shall be determined on the basis of the reference scenario, which is based on the results achieved with the measures already identified at June 30, 2002 by measures, programmes and initiatives in the fields of electricity generation , transport, energy consumption in the civil and in the service sector, international cooperation.

Within the framework of the Sixth Committee CIPE "sustainable development", it established a greenhouse-gas emissions (CTE) Technical Committee, chaired by a representative of the Ministry of environment and territory and composed of representatives of the ministries of economy and finance, productive activities, infrastructure and transport, agriculture, education, University and research, Foreign Affairs, regional affairs as well as State-regions Conference. By 30 September each year, starting in 2003, the CTE:
3.1 shall, on the basis of the information provided by the authorities concerned, a report on the status of implementation of the measures referred to in point 2 and on the trend in emissions than provided in the reference scenario, and formulates proposals for modification of the emission levels specified in table 8, in line with the progress already made or to be made to fulfil the commitments referred to in law No 120/2002 , to be submitted to the examination of the abovementioned Commission for subsequent appraisals and determination of this Committee;
3.2 given the pilot programs under art. 2, paragraph 3, of law No 120/2002 and options for further emission reductions referred to in table 7-to be confirmed on the basis of specific feasibility and cost-benefit analysis to be carried out by the authorities concerned--offers to that Commission the schedule of other measures necessary to meet the objective referred to in law No 120/2002. 4. by 30 October each year, on the basis of the results of the work of the CTE, the Minister of environment and land protection, after consulting the State-regions Conference, proposes to the Committee the adoption of other measures necessary to meet the objective referred to in law No 120/2002, taking into account the priority policy to achieve the best lens with the least cost. 5. in order to ensure the promotion and coordination of projects under JI and CDM mechanisms and the participation of Italy at both international and EU emissions permits market (ET), the Ministry of environment and territory must provide, using the ordinary human and material resources, to organize its offices so as to allow in agreement with the Ministry of productive activities, of agricultural and forestry policies, Foreign Affairs, and economy and finance: the preparation, within the Census May 31, 2003, Italian public and private initiatives, already completed or in progress, Annex I countries and the developing countries, which can generate emission credits, as determined at community and international level;
start by June 30, 2003, procedures for registration, the competent bodies established by the Conference of the parties to the Convention on climate change, projects already completed or in progress at the end of the issuance of emission credits;
start by June 30, 2003 preliminary activities aimed at the participation of Italian companies at the market of emission permits both international and community levels;
the promotion of the realization of further projects under JI and CDM mechanisms, with the aim of achieving the best results in terms of generating emission credits with the lowest incremental cost. For this purpose the Ministry of environment and territory must, among other things, ensure to Italian companies a complete, updated information on the opportunities offered by the JI and CDM mechanisms on possible incentive mechanisms provided for in national regulations, as well as on any funds made available by the World Bank, the Global environment facility, the regional development banks, the European Investment Bank as well as by international financial institutions. 6. for the purpose of compliance with the emission standards set out in table 8 by the sectors, they can use the mechanisms provided for by the Kyoto Protocol and the emission allowance trading within the community, in accordance with the decisions taken at community and national headquarters. 7. a further reduction in emissions will be achieved through interventions of afforestation and reforestation, forest management activities, management of agricultural soils and pastures and revegetation as indicated in paragraph g. and table # 6. 7.1. by April 30, 2003 the Ministry of environment and territory, in consultation with the Ministry for agricultural and forestry policies and in agreement with the State-regions Conference, detailed plan Committee has referred to the three-year period 2004-2006, for the implementation of the national activities in table 6 in the context of public resources allocated for this purpose. 7.2. by July 30, 2003 the Ministry of environment and territory, in consultation with the Ministry for agricultural and forestry policies, shall carry out reconnaissance in the context of regional, national and international legislation in force in our country from 1990 to date, of all the rules that provide for the protection of forest resources, in order to certify the "natural reforestation" occurred nationwide in the period 1990-2012 as a result of activities undertaken by humans and therefore eligible for the purposes of compliance with the emission reduction target established by law No 120/2002. 7.3. by May 31, 2005 the Ministry for agricultural and forestry policies, in consultation with the Ministry of environment and territory, carries out the national forest inventory and that of other carbon sinks in order to start the procedure for revising the limitation of claims, resulting from forest management, assigned to Italy. 7.4. by December 31, 2006 the Ministry of environment and territory, in agreement with the Ministry of agriculture and forestry, national register of agro-forestry carbon sinks for the purpose of certifying the carbon flows in the period 2008-2012 resulting from afforestation, reforestation activities, deforestation, forest management, management of agricultural soils and pastures and revegetation. 8. For the year 2003 to the costs resulting from implementation of provisions in paragraphs 7.3 and 7.4 of this resolution is going to cope with the ordinary budget appropriations of ministries concerned. 9. Since 2003, when annual economic and financial programming document preparation and financial planning document, the Ministry of economy and finance must include a section dedicated to this plan with the identification of tools necessary for achieving the objectives. 10. the implementation of the planned measures in the approved plan will be ensured, for the part under State jurisdiction, within the limits of the resources for the purpose intended by its financial statements.
