The HEAD of the DEPARTMENT for land transport and statistical information systems and having regard to law no 1839 August 12, 1962, as subsequently amended and supplemented, with which it was ratified the European Agreement concerning the international carriage of dangerous goods by road, referred to ADR; Having regard to the Legislative Decree of April 30, 1992, # 285, as amended, under which it was enacted the new rules of the road; Having regard to the Decree of the President of the Republic December 16, 1992, n. 495, as amended, under which it was issued the implementing regulation and of the implementation of the new highway code; Having regard to the Decree of the Ministry of transport and navigation of May 2, 2001, n. 277, which lays down provisions concerning the procedures for the type-approval of motor vehicles, trailers, agricultural machinery, construction machinery and their systems, components and technical entities; Having regard to the Decree of the Ministry of transport and navigation of September 4, 1996, concerning the implementation of Directive 94/55/EC of the Council of the European Union, dated November 21, 1994, and its annexes A and B, which form an integral part thereof; Having regard to the Decree of the Ministry of transport and navigation of May 15, 1997, concerning the implementation of Directive 96/86/EC of the European Union on December 13, 1996 adapting to technical progress Directive 94/55/EC by changing to integrating certain contents of these annexes A and B of the directive no 94/55/EC and subsequent amendments; Having regard to the Decree of the Ministry of transport and navigation of May 3, 2001, with whom he's been transposed Directive 2000/61/EC of the European Parliament and of the Council amending Directive 94/55/EC on the approximation of the laws of Member States with regard to the transport of dangerous goods as amended; Considered that the chapters 6.1, 6.3, 6.5 and 6.6 of the ADR shall bear the technical standards for the approval of packagings and large packagings, as well as the approval of large containers for carriage in bulk (IBC) intended for the transport of dangerous goods; Considered that the abovementioned Ministerial Decree of May 3, 2001 in paragraph 2 of art. 7 provides that the implementing provisions required to implement the same measures are enacted with the Department of land transport;
Decrees: Art. 1. Definitions and scope 1. For the purposes of this Decree shall define: a) ' packaging ', the containers and containers intended for the carriage of dangerous goods, as defined in ADR and subject to the requirements of chapters 6.1 and 6.3 of the ADR;
b) «GIR» large containers for bulk transport of dangerous goods, as defined in ADR and subject to the requirements of Chapter 6.5 of ADR;
c) ' large packs» external packagings containing inner packagings or objects as defined in ADR and subject to the requirements of Chapter 6.6 of the ADR;
d) «top» Centers, the Center researches and tests vehicles and vehicle devices and test centers;
e) «U.P.» the branch offices of the Department for land transport and information systems and statistics;
f) ' manufacturer ' means the natural or legal persons-subjects-responsible for building or the reprocessing of packaging, of the IBC and large packagings. 2. this Decree shall apply to packagings, IBCS and large packagings intended for the carriage of dangerous substances other than those of class 2 and class 7 according to the provisions of ADR. 3. for the purposes of the administrative procedure the packagings, IBCs and large packagings are equivalent to technical entity referred to in the Ministerial Decree of May 2, 2001, # 277.
