The MINISTER of infrastructure and transport in consultation with the Minister of the Interior Seen art. 229 of the new highway code approved with legislative decree of April 30, 1992, n. 285, published in the ordinary supplement to the official journal # 114 of May 18, 1992 that delegates the Ministers of the Republic to enact, in accordance with the jurisdiction conferred, Community directives relating to matters covered by the same code; Visto l'art. 168 of the new highway code that paragraphs 2 and 6 establishes the competence of the Minister of infrastructure and transport, to determine, in consultation with the Minister of the Interior, in relation to the safety of road transport of dangerous goods inspired by Community law; Having regard to articles 11 and 12 of the new Highway Code concerning traffic police services and the performance of services of traffic police; Having regard to law no 1839 August 12, 1962, as subsequently amended and supplemented, with which it was ratified the European Agreement concerning the international carriage of dangerous goods by road, referred to ADR; Having regard to the Decree of the Ministry of transport and navigation of September 4, 1996, published in the ordinary supplement to the Official Gazette # 211 # 282 of December 2, 1996, implementing Directive 94/55/EC on the approximation of the laws of Member States with regard to the transport of dangerous goods by road, as amended; Having regard to the Decree of the Ministry of transport and navigation of March 3, 1997, published in Official Gazette No 77 of April 3, 1997, transposing Directive 95/50/EC of October 6, 1995 concerning the adoption of uniform procedures on controls of dangerous goods by road; Having regard to the order of the Minister of infrastructure and transport on December 21, 2001, published in the Official Journal No. 7 of January 9, 2002, transposing Directive 2001/26/EC of the European Parliament and of the Council amending Directive 95/50/EC on uniform procedures for checks on the transport of dangerous goods by road; Having regard to Directive 2004/112/EC of December 13, 2004 adapting to technical progress Council Directive 95/50/EC on uniform procedures for checks on the transport of dangerous goods by road, published in the official journal of the European Union # L 367 of December 14, 2004;
A d o t t a the following decree: transposing Directive 2004/112/EC of December 13, 2004 adapting to technical progress Council Directive 95/50/EC on uniform procedures for checks on the transport of dangerous goods by road. (Text with EEA relevance).
Art. 1.1. Annexes I, II and III to the Decree of the Ministry of transport and navigation March 3, 1997, as amended by the Decree of the Minister for infrastructure and transport December 21, 2001, shall be replaced by annexes I, II and III contained in the annex to this decree that forms an integral part. This Decree will be published in the official journal of the Italian Republic.
