The MINISTER of agriculture and forestry having regard to law no 526 December 21, 1999 laying down rules for the fulfilment of the obligations arising from Italy's membership of the European communities-Community law 1999; See in particular art. 14, paragraph 17, of the above Act December 21, 1999, # 526, stipulating that, by decrees of the Minister of agriculture and forestry, are laid down general provisions concerning reliability requirements for the recognition of associations as well as the criteria that ensure a balanced representation of categories of producers and transformers interested in protected designations of origin (D.O.P.) , protected geographical indications (I.G.P.) and traditional speciality guaranteed (TSG) in the corporate bodies of consortia; Having regard to the April 12, 2000 Decree concerning general provisions concerning reliability requirements ' Consortium tulela protected designations of origin (D.O.P.) and protected geographical indications (I.G.P.) and subsequent amendments; See in particular art. 2 of said Decree which provides that each consortium in charge can carry out their duties under art. 14, paragraph 15 December 21, 1999, law No. 526, for one D.O.P. or I.G.P.; Having regard to the April 12, 2000 Decree concerning the identification of the criteria of representation in the corporate bodies of the consortium of protection of designations of origin and protected geographical indications and subsequent amendments; Having regard to the September 12, 2000, Decree # 410, with whom it was adopted the regulation concerning the distribution of costs arising from the activities of consortia for the protection of appellations of origin and geographical indications entrusted by the Ministry of agriculture and forestry, published in the Official Gazette No. 9 of January 12, 2001; Considering that it was represented by various organizations and by many manufacturers the need to attribute to a single Consortium the functions referred to in paragraph 15 of article. 14 December 21, 1999, law n. D.O.P., I.G.P., 526 or over where the production of different product names concerned is the same and the production areas coincide in whole or in part; Given that the above request looks worthy of acceptance as it allows economies of management primarily to productions with a lower financial burden for which to set up and manage a consortium involves a burden not easily sustainable;
Decrees: Art. 1.1. The art. 2 April 12, 2000 Decree laying down general provisions concerning the requirements of reliability is the protection consortia of protected designations of origin (D.O.P.) and protected geographical indications (I.G.P.) It is integrated with the following paragraph: 1-bis. Notwithstanding the provisions of paragraph 1 a consortium can fulfil the obligations set forth in paragraph 15 of article. 14 December 21, 1999, law n. 526, for as long as there are more I.G.P. D.O.P. or the following requirements: D.O.P. products or I.G.P. for which it is responsible for the Consortium are in the same sector as determined by art. 2 April 12, 2000, Decree No. 61414 as amended;
the area of production of the same products as identified in the product specification, it's totally coincidental, or the area of production of one of the protected names includes within it the zone (s) of production of other protected name/and/and which the Consortium is in charge.
