TRANSPORT MINISTER Saw the Legislative Decree of April 30, 1992, n. 285, which approved the highway code as amended; Having regard to the Decree of the President of the Republic December 16, 1992, # 495, which approved the implementing regulation and of the implementation of the highway code as amended; Having regard to law no 1839 August 12, 1962 and subsequent amendments and integrations, with which it was ratified the European Agreement concerning the international carriage of dangerous goods by road. Having regard to the Decree of the Ministry of transport and navigation September 4, 1996 and its annexes A and B to Directive 94/55/EC on the approximation of the laws of the Member States, with regard to the transport of dangerous goods by road; Having regard to the Decree of the Ministry of transport and navigation May 15, 1997 implementing Directive 96/86/EC adapting to technical progress Council Directive 94/55/EC on the transport of dangerous goods by road; Having regard to Legislative Decree No 40 February 4, 2000 transposing Directive 96/35/EC on the appointment and vocational qualification of safety advisers for the transport by road, rail or inland waterway transport of dangerous goods; Having regard to the Decree of the Ministry of transport and navigation May 3, 2001 under which it was implemented Directive 2000/61/EC of the European Parliament and of the Council amending Directive 94/55/EC and was repealed on September 4, 1996 decree of the Ministry of transport and navigation with the exception of annexes A and B; Having regard to the order of the Minister of infrastructure and transport Ministerial Decree May 15, 1997 amendment incorporating «June 10, 2004 implementing Directive 96/86/EC of the Council of the European Union adapting to technical progress Council Directive 94/55/EC on the transport of dangerous goods '; Having regard to the order of the Minister of infrastructure and transport April 12, 2005 May 15, 1997 and ministerial decrees June 10, 2004 change and bearing "implementation of Directive 96/86/EC of the Council of the European Union, adapting to technical progress Council Directive 94/55/EC '; Having regard to the order of the Minister of infrastructure and transport August 2, 2005 transposing Directive 2004/111/EC of December 9, 2004 adapting for the fifth time to technical progress Council Directive 94/55/EC; Having regard to the order of the Minister of infrastructure and transport on October 12, 2005 to review the ministerial decree implementing Directive 96/June 10, 2004 laying down ' 86/CE, of the Council of the European Union, adapting to technical progress Council Directive 94/55/EC on the transport of dangerous goods '; Noting that legislation concerning vocational training for drivers carrying dangerous goods by road has been submitted in annexes A and B to Directive 94/55/EC, as amended by Directive 96/86/EC; Bearing in mind that road transport safety advisers, appointed pursuant to Legislative Decree February 4, 2000, # 40, are in possession of the necessary expertise in the field of transport of dangerous goods by road; Given the need to implement an organic collaboration between the State administration and trade associations and professionals for study and preparation of rules on the transport of dangerous goods; Deemed appropriate for the establishment of an Advisory Committee for the analysis and the study of national and international legislation concerning vocational training certificate for drivers of vehicles carrying dangerous goods by road;
Decrees: Art. 1. definitions 1. For the purposes of this Decree, the following definitions shall apply: a) Annexes A and B: annexes A and B to the European Agreement concerning the international carriage of dangerous goods by road, and amendments thereto (ADR), adopted as the technical annexes to Directive 94/55/EC, by the Decree of the Minister of transport and navigation transposition of September 4, 1996 , have become an integral part of the national legislation;
b) vocational training certificate: the certificate you must have drivers carrying dangerous goods, as provided for in Chapter 8.2 of Annex B to Directive 94/55/EC, hereinafter referred to as CFP.
