The Minister for infrastructure and transport having regard to Directive 2004/52/EC of the European Parliament and of the Council of April 29, 2004, published in the official journal of the European Union # L166 of June 7, 2004 # April 30, 2004 and L200 of grinding on the interoperability of road toll systems in the community; Given that the directive refers to provisions governing the movement of vehicles in the toll road infrastructure; Visto l'art. 6 of Directive 2004/52/EC, which provides that the transposition thereof in the laws of the Member States must take place before the November 20, 2005; Visto l'art. April 30, 1992 Legislative Decree 229, # 285, which delegates the Ministers of the Republic to enact, in accordance with the jurisdiction conferred, Community directives relating to matters covered by the same code; Visto l'art. 11, paragraph 5, of law February 4, 2005, n. 11;
Decrees: Art. 1. objective and scope 1. This Decree lays down the conditions necessary to ensure the interoperability of electronic road toll systems in the community with those Italian State under Directive 2004/52/EC of the European Parliament and of the Council of April 29, 2004, which provides for the entry into service of a European electronic toll service for the functionality of such interoperability is essential. This Decree shall apply to the electronic collection of all kinds of tolls, the entire national road network in urban and interurban, motorways, major or minor roads and other structures such as tunnels, bridges and ferries. 2. this Decree shall not apply to: a) to road toll systems for which there are no electronic means of toll collection;
b) electronic road toll systems which do not require the installation of equipment on board;
c) to strictly local and small toll systems for which the costs of adaptation to the requirements of this directive would be disproportionate to the benefits. 3. For the purposes of paragraph 1, it established in Italy an electronic toll service, called the European electronic toll service, which provides the interoperability, throughout the community, of electronic toll systems already in use in the Member States as well as those that will be introduced in the future within the scope of this Decree. 4. The provisions of this Decree are recipients, meaning operators with such diction infrastructure owners bodies referred to in paragraph 1 and the managers thereof-for whatever reason-on behalf of the owners, the issuers of the European electronic toll service on behalf of the owners, or otherwise engaged in activities related to the implementation of electronic toll systems.
