The Inspector General boss for the quality control of food products having regard to Regulation (EC) No 2092/91 of June 24, 1991, as amended and/or additions concerning organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs; Having regard to the Legislative Decree No. 220 of March 17, 1995 concerning the implementation of articles 8 and 9 of Regulation (EEC) No 2092/91 concerning agricultural production and organic food; Having regard to Council Regulation (EC) No 834 of June 28, 2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2092/91; See, in particular, the combined provisions of art. 27, paragraph 5, point c) and art. 42 of Regulation (EC) No 834/2007, that, from 1 January 2009, the inspection bodies operating in the field of organic production must be accredited in accordance with the latest version of European standard EN 45011 or ISO Guide 65; Having regard to Council Regulation (EC) No 889 of September 5, 2008 amending for the application of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and inspection; Having regard to the Decree of the President of the Republic January 9, 2008, # 18 establishing the Ministry of agricultural food and forestry policies in accordance with art. 1, section 416, December 2, 2006, law No. 296; Having regard to the Ministerial Decree of March 7, 2008 reorganization of the Ministry of agricultural food and forestry policies, bearing the identification of executive offices not generals, including offices and laboratories at the peripheral level, and definition of the powers and duties of each Office; Having regard to the Ministerial Decree of December 31, 2003 # 120541 with whom «ABC Brothers Bartolomeo s.s.» based in Macclesfield (Bari) in via Roma n. 41 it was entitled to exercise the control activities on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs; Considering that, pursuant to art. 27, paragraph 9, point d) of Regulation (EC) no 834/2007, the competent authority shall revoke the authorization of the body which does not meet the requirements referred to in points a and b)) or does not meet the criteria set out in sections 5 and more 6 or does not meet the requirements of paragraphs 11, 12 and 14 of the same article; Considered that the control body «ABC Brothers Bartolomeo s.s.» based in Macclesfield (Bari), via Roma n. 41, presented to SINCERT accreditation request to EN 45011 and started its procedure for obtaining of credit; Given the need to ensure the continuity of monitoring and certification as "organically grown" of agrifood operators subject to supervision of the abovementioned inspection body, pending the completion of the process of accreditation;
Decrees: Art. 1. A «ABC Brothers Bartolomeo s.s.» based in Macclesfield (Bari), via Roma n. 41, it is revoked, since 1 January 2009, permission given by Ministerial Decree of December 31, 2003, # 120541, to engage in the activities of control on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs.
