The HEAD of the DEPARTMENT of economic and rural development policies having regard to Regulation (EC) No 510/06 of March 20, 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs; Given the circumstances on which it is founded on Regulation (EC) No 510/06, and in particular those concerning the opportunity to promote quality products having certain characteristics attributable to geographical origin and consumer information such as to enable it to make optimal choices; Given that these objectives are pursued effectively by the consortia of protection, as constituted by the persons directly involved in the production chain, with specific experience and a thorough understanding of product characteristics; Having regard to law no 526 December 21, 1999 laying down rules for fulfilment of the obligations arising from Italy's membership of the European Community-Community law 1999; Visto l'art. 14 of the above Act December 21, 1999, # 526, and in particular paragraph 15, which identifies the functions for the exercise of which the protection consortia of PDOs, PGIs and TSGS can receive, by measure of recognition of the Ministry of agricultural food and forestry policies, the corresponding assignment; Having regard to the ministerial decrees April 12, 2000, as published in the official journal-General series No 97 of April 27, 2000, bearing ' General provisions concerning the requirements of reliability is the protection consortia of protected designations of origin (PDOs) and protected geographical indications (PGI) "and" identification of the criteria of representation in the corporate bodies of the consortium of protection of designations of origin (PDOs) and protected geographical indications (PGIs)» issued by the Ministry of agricultural food and forestry policies in art. 14, paragraph 17 of the abovementioned law no 526/1999; Having regard to the September 12, 2000, Decree No. 410 published in the official journal-General Series # 9 of January 12, 2001 by which, pursuant to art. 14, paragraph 16 of law no 526/1999, adopted the regulation concerning the distribution of costs arising from the activities of consortia of protection of PDOs and PGIs entrusted by the Ministry; Seen on October 12, 2000 Decree published in the official journal-General series No. 272 of November 21, 2000 by which, in accordance with the provisions of art. 14, paragraph 15, point d) were given directives for the collaboration of the consortium of protection of PDOs and PGIs with the Ispettorato Centrale Repressione Frodi, now Central Inspectorate for quality control of food products-ICQ, in supervisory activities; Seen the Decree May 10, 2001, published in the official journal-General series n. 134 of June 12, 2001, incorporating additions to the mentioned decrees of April 12, 2000; Seen the Decree May 4, 2005, published in the official journal-General series-n. 112 of May 16, 2005 laying down these decrees of April 12, 2000 integration; Seen the Decree May 4, 2005, published in the official journal-General series n. 112 of May 16, 2005, establishing a mode of derogation from art. 2 of said Decree of April 12, 2000 laying down general provisions concerning the reliability requirements for the recognition of associations of PDOs and PGIs; Seen August 5, 2005 Decree, published in the official journal-General series-n. 191 of August 18, 2005, amending the Decree of May 4, 2005; Having regard to Council Regulation (EC) no 2325 of November 24, 1997, published in the official journal of the European Union L 322 of November 25, 1997 with which it was recorded the protected designation of origin "Terra di Bari»; November 2004 saw the legislativo19 Decree, no. 297, published in the official journal-General series # 293 of December 15, 2004 establishing a «penalty provisions under Regulation (EEC) no 2081/92 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs "; Having regard to the request submitted by the Consortium for the promotion and preservation of extra virgin olive oil with protected designation of origin "Terra di Bari» with headquarters at Bari, Corso Cavour 2, at the Chamber of Commerce, industry, crafts and agriculture, aiming to get the same recognition to perform the functions listed in art. 14, paragraph 15 of the aforementioned law No. 526/1999; Verified the conformity of the Statute of the Consortium predicted at the requirements of the abovementioned ministerial decrees; Considered that the condition required by art. 5 April 12, 2000 Decree mentioned above, reliability requirements ' the protection consortia, it is satisfied because the Ministry has verified that the participation, in the shareholder structure, the subjects belonging to the category in < (oli) fatty > found in art. 4, point d) of the same Decree, represents at least the 2/3 protected production for which the Consortium calls for the task described in art. 14, paragraph 15 of law no 526/99. The check in question was carried out on the basis of declarations made by the applicant and certificates issued by the inspection body Chamber of Commerce, industry, handicraft and Agriculture of Bari, authorized to carry out activities on protected designation of origin "Terra di Bari»; Was therefore considered necessary to proceed to the recognition of the Consortium for the promotion and preservation of extra virgin olive oil with protected designation of origin "Terra di Bari» in order to allow the exercise of the activities mentioned above and specifically indicated in art. 14, paragraph 15 of law no 526/1999;
Decrees:

Art. 1.1. The Statute of the Consortium for the promotion and preservation of extra virgin olive oil with protected designation of origin "Terra di Bari», based in Bari, Corso Cavour 2, at the Chamber of Commerce, industry, crafts and agriculture, complies with the requirements set out in art. 3 April 12, 2000 Decree laying down general provisions concerning the requirements of reliability is the protection consortia protected designations of origin (PDO) and protected geographical indications (PGI).
